SPECIAL COUNCIL MEETING - ES ACTION (PUBLIC) - Status Report - Non-Conforming Use Project

SPECIAL COUNCIL MEETING A Special Council Meeting was held on January 10, 2017 at 5:01 p.m. with Council President Slavin presiding. Members present were Mr. Anderson, Mr. Cole, Mr. Hare, Mr. Hutchison, Mr. Neil, and Mr. Sudler. Mr. Hosfelt and Mr. Lewis were absent. Mayor Christiansen was also present. Council staff members present were Mr. Pepper, Mr. Koenig, Mrs. Townshend, and Mrs. McDowell. Mr. Hudson was also present. ADOPTION OF AGENDA Mr. Hutchison moved for approval of the agenda, seconded by Mr. Neil and unanimously carried. Mr. Neil moved to recess into Executive Session pursuant to 29 Del. C. §10004(b)(4) - Strategy sessions, including those involving legal advice or opinion from an attorney-at-law, with respect to collective bargaining or pending or potential litigation, but only when an open meeting would have an adverse effect on the bargaining or litigation position of the public body. The motion was seconded by Mr. Anderson and unanimously carried. The Special Council Meeting recessed into Executive Session at 5:02 p.m. The Executive Session adjourned at 5:30 p.m. ACTION RESULTING FROM THE EXECUTIVE SESSION Status Report - Non-Conforming Use Project During the Executive Session, members of Council were provided a status report on the non- conforming use project. Mr. Hutchison moved to proceed with contacting the Alcoholic Beverage Control Commissioner (ABCC) and proceed with an enforcement action. The motion was seconded by Mr. Sudler and unanimously carried. Mr. Sudler moved to notify the Elks Club, via certified and hand-delivered letter, and to the Exalted Ruler, via certified mail to his home address, to cease operations. The motion was seconded by Mr. Anderson and unanimously carried. Mr. Neil moved to adjourn the Special Council Meeting, seconded by Mr. Cole and unanimously carried.
