CITY OF DOVER BOARD OF ADJUSTMENT DECEMBER 21, 2016
Notice was published in the DSN-on December11, 2016. The public was notified in accordance
with regulations.
Vice Chairman Ericson questioned if there was any member present who had a conflict of
interest and there was none.
Representative: Mr. Thomas Bugbee, Owner.
Mr. Thomas Bugbee was sworn in by Mr. Pepper.
Mr. Bugbee testified that he is the owner of the property. On April 15, 2015 the Board gave him
permission to go to the 6-foot contour line on the property so that he and his wife could build.
Since that time things have changed in their lives. They decided that they could not build on the
property and would put the property back up for sale. They sold their house and had to downsize
to a smaller lot and home. Things did not work out for them so the property is back up for sale and
the folks who are wanting to buy the property are needing to go back to the 6-foot contour line so
that they can place the home on the property as they asked back on April 15, 2015.
Responding to Mr. Keller’s question clarifying that the property had not yet transferred, Mr.
Bugbee replied correct, he stills owns the property.
Mr. Keller commented that the report indicates that Mr. Larlham and Ms. Hettinger are the
applicants and that Mr. Bugbee was in concert with their application to bring about the variance.
Mr. Bugbee replied yes.
Responding to Mr. Hufnal’s question whether the home that the applicants plan to put on the lot
is in the same footprint as what is in the diagram in the exhibit, Mr. Bugbee replied that the
applicant has a different footprint than what they were going to use.
Ms. Karen E. Hettinger was sworn in by Mr. Pepper.
Ms. Hettinger testified that she assumed that Mark J. Larlham and I are considered applicants
because they are not the owners. They have entered into a real estate agreement to purchase 74
Laurel Drive property. Exhibit C is their proposed site plan and they used Scott Engineering as
well. The footprint of the house although different from Mr. Bugbee still falls within the 6-foot
contour line as the Board had previously approved.
Responding to Mr. Hufnal’s particular interest whether the house fell within the same footprint
line of the floodplain, Ms. Hettinger replied yes. She also used the same engineer as Mr. Bugbee.
Although, the footprint looks a little different than Mr. Bugbee plan it stills fall within the 6-foot
contour line.
Responding to Mr. Senato’s question whether the perimeter is the same as Mr. Bugbee and there
is not increase or decrease in the design or size of the house or where it is going to meet with the
6-foot contour line and floodplain, Ms. Hettinger replied that although the house may be a different
2
Página 4
CITY OF DOVER BOARD OF ADJUSTMENT DECEMBER 21, 2016
style as you can compare the footprint of what Mr. Bugbee submitted and what they submitted.
Their plan is Exhibit C and it is in accordance with the previously approved variance.
Responding to Mr. Senato’s question whether the perimeter of Ms. Hettinger home meets the
perimeter that he sees in the original plan and that there was no change, Ms. Hettinger replied yes,
the 6-foot contour line and there is no change.
Responding to Mr. Hufnal’s question if they were planning to build soon and why were they
requesting a variance now, whether it was necessary to get the mortgage or something the applicant
is getting ready to build, Ms. Hettinger replied that the plan is to purchase the property, and of
course they do not want to purchase the property if the Board is not going to approve, and then be
holding a property that they cannot build upon.
Responding to Mr. Hufnal’s question whether they need the approval to go to settlement, Ms.
Hettinger replied correct.
Vice Chairman Ericson opened the public hearing.
Mr. John W. Warren was sworn in by Mr. Pepper.
Mr. Warren of 82 Laurel Drive testified that he owned a vacant lot next door to the lot in
question and he was present to speak out in favor of the variance. He thinks it will enhance the
appearance of the neighborhood.
Mr. Keller stated that he recalls that Mr. Warren spoke rather highly of the property and upkeep
and his contribution of the surrounding area.
Mr. Warren stated that he thinks it was in April 2016 that he came before the Board to get
approval to put an extension on his shed. He thanked the Board for their approval. The project is
complete and it gave him a lot more storage. He appreciates the approval.
Vice Chairman Ericson closed the public hearing after seeing no one else wishing to speak.
Vice Chairman Ericson questioned if there was any additional correspondence for the record.
There was none.
He was pleased to hear that the request will assist hopefully in the near future the sale and
ultimate construction of the dwelling on this property as the Board have in fact seen it before in
relation to the historical nature of the variance request for the property and in support of Staff’s
report the testimony given today and the comments made.
Mr. Keller moved to approve application V-16-16 to allow for the building to be constructed
within the flood hazard area, the 100-year floodplain to the 6-foot contour line for reasons stated
and supported by the Staff Report. The motion was seconded by Mr. Senato and was
unanimously carried 4-0. Mr. Sheth was absent.

Project Description
The applicant is requesting an area variance from the requirements of Article 4 § 4.16 of the
Zoning Ordinance Zoning Bulk and Parking Regulations pertaining to the maximum permitted
building height in the IPM (Industrial Park Manufacturing Zone- Planned Industrial Park).
Specifically they are requesting a variance to exceed the maximum height requirement by 115
feet in order to allow construction of a 150 foot telecommunications tower and associated
facilities at the selected location on the site.
Previous Variance
Variance V-15-13 was approved by the Board of Adjustment at its meeting of September 16,
2015. The variance expired after one year because construction did not commence. The Notice of
Decision is attached (Exhibit A).
Adjacent Zoning and Land Use
The monopole and compound are planned to be located in the northeast corner of the 6.71 acre
site located east of Starlifter Avenue with frontage on Galaxy Drive to the north and Horsepond
Road to the south and addressed as 118 Galaxy Drive. The subject parcel presently is
undeveloped.
Immediate surrounding properties are also zoned IPM (Manufacturing Zone-Planned Industrial
Park) and consist of commercial and industrial uses. There is an R-8 (One Family Residential)
zoned lot to the southwest of the site and across Horsepond Road.
A Zoning Map exhibit (Exhibit B) prepared by staff is found in the Appendix of this Report
showing the subject property location and surrounding zoning.

Applicant’s Proposed Project
The applicant has submitted nine (9) pages illustrating the proposed plans for the site, found in
Exhibit C attached. References are made to the sheet numbers printed on the right side of the
pages.
The overall site plan, shown on Sheet Z-1 identifies the location of the proposed tower and
compound and the relationship to the subject property, surrounding properties, and adjacent
rights of way.
Sheet Z-2 shows a more detailed plan of the compound layout including equipment location,
surfaces and fencing. An elevation view of the compound and monopole is on Sheet Z-3.

Please Note: References in Exhibit C on sheets Z-1, Z-2, and Z-3 to a height of 158 feet to the
top of the lightening rod should be corrected to 150 feet at the top of the lightening rod. The
variance request is for a total height of 150 feet, which is the same as the request granted by
variance V-15-13. See V-15-13 Notice of Decision (Exhibit A) attached.
Exceptional Practical Difficulties Tests
Zoning Ordinance Article 9 §2 dictates the specific powers and duties of the Board of
Adjustment with regard to granting variances. Specifically the Board must determine:
2.1 Variance – The board shall have the authority to authorize variances from provisions of the
Zoning Ordinance that are not contrary to public interest where the board determines that a literal
interpretation of the Zoning Ordinance would result in undue hardship or exceptional practical
difficulties to the applicant. In granting variances, the board shall determine that the spirit of the
Zoning Ordinance is observed and substantial justice is done.
2.11 Area Variance. A variance shall be considered an area variance if it relates to bulk
standards, signage regulations, and other provisions of the Zoning Ordinance that address lot
layout, buffers, and dimensions. In considering a request for an area variance, the board shall
evaluate the following criteria and document them in their findings of fact:
(a) the nature of the zone in which the property lies;
(b) the character of the immediate vicinity and the contained uses therein;
(c) whether, if the restriction upon the applicant’s property were removed, such removal
would seriously affect neighboring properties and uses; and
(d) whether, if the restriction is not removed, the restriction would create unnecessary
hardship or exceptional practical difficulty for the owner in his efforts to make normal
improvements in the character of that use of the property that is a permitted use under
the provisions of the Zoning Ordinance.
Review of Application
As part of the application, the applicant was asked to summarize how the requested variance
relates to the criteria.
1. The nature of the zone in which the property lies.
Applicant Responses:
“The subject property is typical of other properties in the IPM (Industrial Park
Manufacturing Zone- Planned Industrial Park) Zoning District. A portion of the lot
contains environmental constraints, such as wetlands, that limit development.”
Staff Response:
The lot is larger than immediately surrounding lots zoned IPM, however a portion of the
subject lot has environmentally protected areas that preclude development.
Página 10
V-17-01 Cellco Partnership dba Verizon Wireless at 118 Galaxy Dr
Board of Adjustment Report
2. The character of the immediate vicinity and the contained uses therein.
Applicant Responses:
“The subject property is unimproved, and includes wooded areas and wetlands. The
subject property is located in an industrial park.”
Staff Response:
The area of wetlands noted is found in the northwestern corner of the property south of
Galaxy Drive (Exhibit D). Approximately the same area is also wooded. There are single
story commercial buildings on surrounding parcels as well as undeveloped parcels in the
industrial park subdivision known as Kent County AeroPark.
Private communications antennae and towers such as that which the applicant has
proposed, as well as public infrastructure, are permitted uses and are found with the IPM
zone throughout the city.
The property is also within the AEOZ (Airport Environs Overlay Zone-Noise Zone Area
A). Communications facilities are a permitted use within the applicable sub-area of the
AEOZ zone. This zone poses no additional restrictions related to height. Regulations
related to noise attenuation do not apply to this project as it is not inhabited.
3. Whether, if the restriction upon the applicant’s property were removed, such removal
would seriously affect neighboring properties and uses.
Applicant Responses:
“The construction of a 158' [sic] monopole would not adversely affect neighboring
properties and users, because the subject property is within an industrial park in the
Planned Industrial Park Zoning District. The proposed monopole will benefit
neighboring properties and users, by improving telecommunications service.”
Staff Response:
Staff does not believe the granting of a variance would adversely impact neighboring
properties. The proposed location is distant from the primary population centers and main
thoroughfares of the city. The use is in keeping with the permitted uses in the zone and
the types of uses found in surrounding properties.
4. Whether, if the restriction is not removed, the restriction would create unnecessary
hardship or exceptional practical difficulty for the owner in his efforts to make normal
improvements in the character of that use of the property that is a permitted use under the
provisions of the Zoning Ordinance.
Applicant Responses:
Página 11
V-17-01 Cellco Partnership dba Verizon Wireless at 118 Galaxy Dr
Board of Adjustment Report
“The imposition of a 35' height restriction would result in exceptional practical difficulty
to Verizon Wireless. Verizon would not be able to satisfy its service objectives and fill
significant gaps in coverage and/or capacity if unable to construct a 158' [sic]
telecommunications monopole at the subject property. A 35' tall monopole would not
provide adequate coverage or even have the ability to communicate with the rest of the
Applicant's telecommunications network. Telecommunications uses are permitted as
utility uses in the Planned Industrial Park Zoning District. The existing environmental
constraints on the property pose exceptional practical difficulties related to improving the
property or finding tenants. The location of the designated wetlands likely poses
challenges related to building and utility siting therefore denial of the variance would
further limit the ability of the owner to make improvements or secure tenants.”
Staff Response:
Staff cannot comment on the issue of service capacity, but notes that the proposed site is
on the east side of town, and near uses, jobs and residences associated with Dover AFB.
The proposed site is also near the important Route 1 transportation route as well as Route
13.
From the perspective of the lessee, the denial of a variance may create degradation in
service for Verizon Wireless customers in the area, which could be an exceptional
practical difficulty if the company were unable to maintain adequate service in the area to
meet demand.
From the perspective of the property owner, staff believes that the existing environmental
constraints on the property pose exceptional practical difficulties related to improving the
property or finding tenants. The location of the designated wetlands likely poses
challenges related to building and utility siting therefore denial of the variance would
further limit the ability of the owner to make improvements or secure tenants.
Variance Recommendations:
Staff recommends approval of the area variance for reasons as follows:
With regard to previously approved and subsequently expired variance V-15-13, the facts,
site conditions, and proposed construction are unchanged.
The placement of a monopole and associated compound is in keeping with the surrounding
commercial and industrial uses and the character of an industrial park.
The placement of a monopole and associated compound is in keeping with the permitted uses
of the IPM zone as private utility infrastructure.
The applicant has demonstrated exceptional practical difficulty as a 35 foot tall monopole
would be insufficient at providing adequate services.

Project Description
The property is located at 341 Saulsbury Road and is occupied by Whatcoat United Methodist
Church.
The applicant is requesting an area variance from the requirements of the sign regulations in
Zoning Ordinance Article 5 §4.7 to allow an increase in the maximum sign area for a monument
sign located on frontage of an Urban Minor Arterial street, located within a residential zoning
district. The use of the property as a place of public assembly, such as a church, is a Conditional
Use within the RG-1 (General Residence Zone).
Adjacent Zoning and Land UseThe subject property is zoned RG-1. A portion of the property
is also within the COZ-1 (Corridor Overlay Zone). This overlay zone includes provisions related
to building and site design that apply to new development, but there are no provisions related to
signage.
The immediately adjacent properties are primarily professional office and multi-family
residential uses. Properties to the north and across Saulsbury Road to the west are zoned CPO
(Commercial and Professional Office Zone) and feature numerous office uses and a day care
center. To the south of the subject property is Whatcoat Village Apartments, recently rezoned to
RG-2 (General Residence Zone) from RG-1. Further south lies Edgewell Personal Care
(formerly Playtex) zoned IPM (Industrial Park Manufacturing Zone).
A Zoning Map exhibit (Exhibit A) prepared by staff is attached to this report showing the subject
property location and surrounding zoning.

Signage
The City of Dover sign regulations found in Zoning Ordinance Article 5 §4 determine the
allowable number, type and dimensional characteristics of signage on a property according to:
● The type of use
● Proximity to residential uses
● Classification of roads on which the property has frontage
The subject property is considered a conditional, non-residential use located in a residential zone
as defined by Article 3 §2.11 and §1.14, and Article 5 §4.3 of the Zoning Ordinance. RG-1 is
among the residential zones:
Residence zones: R-20, R-15, R-10, R-8, R-7, RM-1, RM-2, RG-1, RG-2, RG-3, RG-4, RG-
5, RGO, or MHP zone.
The City of Dover sign regulations distinguish three (3) types of roads for purposes of
determining allowable signage. Saulsbury Road is an “Urban Minor Arterial” as defined by
Article 5 §4.3.
Página 29

Board of Adjustment Report
The entire “Sign Table” from Zoning Ordinance Article 3 §4.7 is presented in Exhibit B. The
section pertaining to this project is at the top of the table and colored with a light blue
background.
This section is what applies to “Residential Uses and Nonresidential Uses in Residential
Districts” as shown in the vertical text on the left, and shows the maximum number, sign area,
height, and minimum required setbacks and exclusion zones for signs on “All Streets.”
The provisions of the Zoning Ordinance in Article 3 §1.19, related to signs for permitted
conditional uses in the RG-1 district refers to the provisions of the Sign Regulations in Zoning
Ordinance Article 5 §4. When referring to the “Sign Table” in Exhibit B, and the listing of
specific uses in “Residential Uses and Nonresidential Uses in Residential Districts,” the code
does not specifically address Conditional Uses in such situations.
Existing Signage
Building Permit #012577 was issued September 28, 1994 for a 32 square foot internally
illuminated monument sign with a brick base and a changeable message area. This sign is shown
in Exhibit C. There is also lettering on the wall of the structure, however this and other existing
signage on the site is not pertinent to this application.
Proposed Signage
The applicant submitted a Building Permit Application #16-1734 on November 1, 2016 for a 24
square foot internally illuminated monument sign with an electronic message center display in a
new proposed location on the site. An image of the sign with measurements is found in Exhibit
C.
While the proposed new sign is smaller in area than the sign it is intended to replace, because the
sign is completely new and in a new location, the current sign regulations apply and there are no
existing legal non-conformities which would allow the 24 square foot sign.

(a) the nature of the zone in which the property lies;
(b) the character of the immediate vicinity and the contained uses therein;
(Exhibit A: Page 2)
1. The nature of the zone in which the property lies.
Applicant Responses:
“The property is a conditional use in a residential zone. RG-1. The maximum
permitted sign area for this site is 12 square feet. We are asking permission to
remove the existing 32 square foot sign and install a 24 square foot Electronic
Message Board sign.”
Staff Response:
As previously noted by Staff, Conditional Uses are not expressly specified in the “Sign
Table” in Exhibit B pertaining to the location of this property, but Staff would generally
interpret the permitted maximum sign area to be 12 square feet.
Conditional Uses, such as churches or places of public assembly, are permitted in
residential districts. Such uses would be consistent with the nature of the zone, and it is
common for churches to be found in residential zones around the city.
2. The character of the immediate vicinity and the contained uses therein.
Applicant Responses:
“There are several other businesses and an apartment complex that surround
the subject site. We have enclosed photos of the businesses showing the
existing signs on their property all of which are larger than the 12 square feet
that we are limited to under the zoning for our property.”
Staff Response:
Staff concurs with applicant’s description of the surrounding area, and additionally notes
that the adjacent Whatcoat Apartments property located to the south has an existing
Página 31

Board of Adjustment Report
monument sign of undetermined size. Staff notes that under the provisions of the current
sign regulations, a “Multi-Family Residential Use” would be permitted a 32 square foot
monument sign.
3. Whether, if the restriction upon the applicant’s property were removed, such removal
would seriously affect neighboring properties and uses.
Applicant Responses:
“We do not feel removing this restriction would have any adverse effects on the
neighboring properties as we currently have a 32 square foot sign and are
requesting to decrease the size down to 24 square feet. The new proposed
sign would be located further away from the apartment complex than the
current sign.”
Staff Response:
The Saulsbury Road corridor contains a mix of uses, primarily professional office and
institutional along this segment, with retail and other commercial uses located farther
south. There are numerous monument signs located along the road frontage, and most
appear to be about 32 square feet or less.
The proposed sign is smaller than the sign it is intended to replace. The proposed location
is farther away from the adjacent apartment complex and also sited closer to the road.
“We are looking to remove our existing outdated sign and upgrade to a more
functional sign for the church. We cannot accomplish this with a 12 square
foot sign. If we were required to go from our existing 32 square foot sign down
to the allowable 12 square foot sign it would create exceptional practical
difficulty.”
Staff Response:
The proposed sign area at 24 square feet would not be out of character with the use of the
property as a church. Many churches throughout Dover have similar signs that display the
name of the congregation, hours of services, and also include a message area (either
electronic or non-electronic) to display inspirational messages, announcements of events,
etc. Other churches may be Conditional Uses in residential zones, or they may be
permitted uses in non-residential zones.
Página 32
V-17-02 Whatcoat UM Church Signage at 341 Saulsbury Road
Board of Adjustment Report
In the absence of specific direction in the Zoning Ordinance pertaining to the maximum
allowable sign area for a Conditional Use in this location, Staff would likely permit a
monument sign at a maximum of 12 square feet, which is the most restrictive standard.
Variance Recommendations:
Staff recommends approval of the variance for the 12 square feet increase in sign area for the
monument sign to permit a 24 square feet sign for reasons as follows:
● The proposed sign is in keeping with the character and nature of the zone and the
permitted Conditional Uses for the zone.
● The proposed sign is in character with the immediate surroundings and would not
seriously impact surrounding uses.
● The proposed sign represents a decrease in overall sign area compared to the sign it is
intended to replace.
● The sign regulations are generally based on a relationship between the classification of
street and its typical traffic conditions. Staff believes that a 24 square feet monument sign
presents a legible sign design that could be safely read but not be distracting. A 12 square
foot sign would be somewhat undersized relative to the prevailing speeds on the street
and the size of the property’s road frontage.
● The Zoning Ordinance does not specifically address Conditional Uses in this particular
situation, which is an oversight that is intended to be corrected in future amendments to
the Zoning Ordinance.
● Limiting the sign area to 12 square feet may impose a hardship on the property since
similar establishments are typically entitled to a larger sign area for the same type of use.
Advisory Comments to Applicant:
● Variances become null and void if work has not commenced within one (1) year of the
date the variance was granted. At present there is no provision for extension of variance
approvals.
● The placement and size of address numbers are not regulated by the Sign Regulations.
Contact the Fire Marshal’s Office at 302-736-7010 to confirm size and placement.
