SPECIAL COUNCIL MEETING - ES ACTION (PUBLIC) - Land Acquisition, NAES, and Koenig Evaluation Follow-Up

SPECIAL COUNCIL MEETING A Special Council Meeting was held on January 23, 2017 at 6:00 p.m. with Council President Slavin presiding. Members present were Mr. Anderson, Mr. Cole, Mr. Hare, Mr. Hosfelt, Mr. Hutchison, Mr. Lewis (arrived at 6:39 p.m.), Mr. Neil, and Mr. Sudler. Mayor Christiansen was also present. Council staff members present were Mr. Koenig (departed at 6:29 p.m.), Mrs. Mitchell (departed at 6:29 p.m.), and Mrs. McDowell (departed at 6:29 p.m.). Mr. Hudson was also present (departed at 6:29 p.m.). ADOPTION OF AGENDA Mr. Hutchison moved for approval of the agenda, seconded by Mr. Neil and unanimously carried. Mr. Neil moved to recess into Executive Session pursuant to 29 Del. C. §10004 (b)(2) - Preliminary discussions on site acquisitions for any publicly funded capital improvements, or sales or leases of real property; §10004(b)(4) - Potential litigation and collective bargaining strategy session; and §10004(b)(9) - Personnel matters in which the names, competency and abilities of individual employees are discussed, unless the employee requests that such a meeting be open. The motion was seconded by Mr. Hosfelt and unanimously carried. The Special Council Meeting recessed into Executive Session at 6:01 p.m. The Executive Session adjourned at 6:58 p.m. ACTION RESULTING FROM THE EXECUTIVE SESSION Contractual Interpretation - NAES Corporation During the Executive Session, Mr. Scott Koenig, City Manager, informed members of a NAES Corporation employee settlement. Mr. Hare moved to withhold payment until such time as this issue has been clarified in writing to the satisfaction of both parties. The motion was seconded by Mr. Neil and unanimously carried. Mr. Hare moved to adjourn the Special Council Meeting, seconded by Mr. Sudler and unanimously carried. The Special Council Meeting adjourned at 7:01 p.m. TRACI A. McDOWELL CITY CLERK
