SPECIAL COUNCIL MEETING - ES ACTION (PUBLIC) - Pending and Potential Litigation and Attorney Services

SPECIAL COUNCIL MEETING A Special Council Meeting was held on January 27, 2020 at 6:00 p.m. with Council President Hare presiding. Members present were Mr. Anderson, Mr. Neil, Mr. Slavin, Mr. Polce, Mr. Taylor, and Mr. Lindell. Mr. Sudler and Mr. Cole were absent. Mayor Christiansen was also absent. Council staff members present were Mr. Gary Junge in the absence of City Solicitor Rodriguez, Mrs. Mitchell, and Mrs. McDowell. Mr. Harline, Assistant City Manager, was also present. ADOPTION OF AGENDA Mr. Neil moved for adoption of the agenda, seconded by Mr. Lindell and unanimously carried. Mr. Polce moved to recess into Executive Session pursuant to 29 Del. C.§10004 (b)(l) Discussion of an individual citizen's qualifications to hold a job or pursue training unless the citizen requests that such a meeting be open and pursuant to 29 Del. C. §10004(b)(4) - Strategy sessions, including those involving legal advice or opinion from an attorney-at-law, with respect to collective bargaining or pending or potential litigation, but only when an open meeting would have an adverse effect on the bargaining or litigation position of the public body. The motion was seconded by Mr. Anderson and unanimously carried. The Special Council Meeting recessed into Executive Session at 6:01 p.m. The Executive Session adjourned at 6:19 p.m. ACTION RESULTING FROM THE EXECUTIVE SESSION Attorney Services for Potential Litigation During the executive session, members of Council considered engaging outside counsel to handing potential litigation. Mr. Slavin moved to engage Ms. Victoria K. Petrone of Baird Mandalas Brockstedt LLC. The motion was seconded by Mr. Neil and unanimously carried. Mr. Polce moved for adjournment, seconded by Mr. Lindell and unanimously carried. The Special Council Meeting adjourned at 6:21 p.m. TRACI A.
