City of Dover DETERMINATION of HISTORIC OR SIGNIFICANT SIGN Referral by City Planner to Historic District Commission Meeting of March 20, 2014 Project: Pylon Sign at Kirby & Holloway Family Restaurant Location: 656 North DuPont Highway Located on the west side of North DuPont Highway/Route 13, north of intersection with Lepore Road Tax Parcel: ED-05-068.09-01-09.01-000 File Number: HI-14-02 The following application is referred by the City Planner to the Historic District Commission for consideration to determine the historic and/or cultural/aesthetic significance of a pylon sign. Sign The sign is located at the Kirby & Holloway Family Restaurant at 656 North DuPont Highway. It is a pylon sign consisting of multiple geometric shapes with the lettering reading as “Kirby & Holloway, Family Restaurant, Established 1948.” It also includes a manual changeable copy sign box. The Sign, constructed in an Art-Deco style, is double sided making it visible from the north and south. It sits within a small grass lawn area with a landscaped stone planter. See photograph on Page 3. The Restaurant is currently closed due to a fire. Sign Regulations The Zoning Ordinance, Article 5 §4 Supplementary Sign Regulations outlines the regulations for signage. The frontage of this property on North DuPont Highway, which is considered a urban principal arterial street, allows for the placement of the pylon sign type of freestanding signage subject to regulations on setbacks from property line, overall height, sign area, etc. It is believed that this Sign at Kirby & Holloway is a “non-conforming sign.” The Sign Regulations also include provisions pertaining to “abandoned signs” when a business has not been conducted on the property for 90 days. These provisions could dictate removal of this Sign since the business is not currently in operation or may require the Sign to come into compliance with the current provisions of the Sign Regulations. Referral for Determination Given the current status of the Restaurant and this Sign, Planning Staff is referring the Kirby & Holloway Sign for consideration under the provisions of Zoning Ordinance, Article 5 §4.12 – Historic or Significant Signs. The Sign Regulations give the Historic District Commission the authority to determine the historic and/or cultural/aesthetic significance of a Sign. See the following Code citation. P. O. Box 475 Dover, DE 19903 Community Excellence Through Quality Service

HI-14-02 Kirby & Holloway Sign Staff Report to the Historic District Commission Page 2 of 3 Article 5 §4.12 Historic or significant signs. A. Preservation of historic or significant signs. Signs that are at least 50 years old and considered historic or to have cultural/aesthetic significance shall be protected and preserved. If these signs are legally nonconforming they shall maintain their nonconforming status indefinitely. The determination of the historic or cultural/aesthetic significance of the sign shall be determined by the historic district commission. 1. The owner of the premises on which these signs reside shall maintain the signs to ensure they work and are in good condition. Consideration of the Kirby & Holloway Sign under the provisions of Historic or Significant Signs appears to appropriate given the establishment date of 1948 for the restaurant. The Sign is an example of the commercial signage along highway corridors in the early to mid-twentieth century. Historic District Commission Action The Historic District Commission should consider this request and take action in regards to determining the historic, cultural, or aesthetic significance of the Kirby & Holloway Sign. Advisory Comments and Recommendations: 1. Staff recommends the following as it relates to the Kirby & Holloway Family Restaurant freestanding pylon sign (as described and depicted in the attached photographs): a. Confirmation of the Sign as a Historic and Significant Sign under the provisions of Zoning Ordinance, Article 5 §4.12 finding that the Sign is representative in form and shape of Art-Deco style commercial signage of the mid-twentieth century. b. As per the Sign Regulations, the owner of the premises shall maintain the Sign to ensure the Sign works and is in good condition. c. The Sign will maintain its non-conforming status indefinitely and can remain in its current form. 2. The property owner shall be aware that a Sign Permit is required prior to any changes to the signage. 2
