SPECIAL ES ACTION (PUBLIC) - Land, Litigation and Contract Negotiations

SPECIAL CITY COUNCIL MEETING A Special City Council Meeting was held on June 28, 2021 at 5:30 p.m. with Council President Sudler presiding. Members present were Mr. Anderson, Mr. Boggerty, Mr. Neil, Mr. Hare (arrived at 5:49 p.m.), Mrs. Arndt, Mr. Rocha, Mr. Taylor (arrived at 5:34 p.m.), and Mr. Lindell. Mayor Christiansen was also present. Council staff members present were Mr. Harline, Ms. Peddicord, Mrs. McDowell, Mr. Rodriguez, and Mr. Hugg (6:08 p.m. - 6:50 p.m.). Other staff members present were Mrs. Hawkins (6:50 p.m. - 7:19 p.m.), Chief Johnson (7:12 p.m. - 7:19 p.m.), Mr. Lyon (5:30 p.m. - 6:05 p.m.), and Ms. Mills (5:30 p.m. - 6:05 p.m.). Also present were Ms. Victoria Petrone, Esquire, of Baird Mandalas Brockstedt LLC (5:30 p.m. - 6:05 p.m.) and Ms. Linda Parkowski, Executive Director Kent Economic Partnership (6:08 p.m. - 6:50 p.m.). ADOPTION OF AGENDA Mr. Neil moved for adoption of the agenda, seconded by Mr. Rocha and unanimously carried. Mr. Neil moved to recess into Executive Session pursuant to 29 Del. C. §10004(b)(2) - Preliminary discussions on site acquisitions for any publicly funded capital improvements, or sales or leases of real property and Pursuant to 29 Del. C. §10004(b)(4) - Strategy sessions, including those involving legal advice or opinion from an attorney-at-law, with respect to collective bargaining or pending or potential litigation, but only when an open meeting would have an adverse effect on the bargaining or litigation position of the public body. The motion was seconded by Mr. Anderson and unanimously carried. The Special Council Meeting recessed into Executive Session at 5:31 p.m. The Executive Session adjourned at 7:19 p.m. ACTION RESULTING FROM THE EXECUTIVE SESSION Update on Pending Litigation During the executive session members were provided an update on pending litigation. Mr. Neil moved for approval of the mediation agreement. The motion was seconded by Mr. Anderson and unanimously carried. Tentative Labor Agreements During the executive session members were briefed on the terms of the following tentative labor agreements: Dover Organization of Employees (DOE) Mr. Anderson moved for approval of the Dover Organization of Employees (DOE) contract. The motion was seconded by Mr. Neil and unanimously carried. Fraternal Order of Police (FOP) Mr. Anderson moved for approval of the Fraternal Order of Police (FOP) contract. The motion was seconded by Mr. Neil and unanimously carried.
