COMMUNICATIONS & REPORTS
Summary of Applications for 2020 and 2021
Mrs. Melson-Williams stated that last year there were two (2) items. This year (2021) there has
been a little more activity and today the Commission will be considering their sixth application of
the year. There have been a number of Permits referred to the Commission over the past year. She
noted that the Application for the parking lot at 30 The Green, Lands of King of Clubs, LLC has
recently filed their Final Site Plan and Staff will work on getting the Final Approval.
Ms. Horsey questioned the comments listed under “Status” what was meant by the comments
“demolition of entire building and site” for the People’s Church of Dover. Mrs. Melson-Williams
replied that it was a typing error.
Summary of Architectural Review Certifications for 2021
Mrs. Melson-Williams stated that for the year 2021 through October there have been a total of
twenty-nine (29) applications in the Historic District. Three (3) of the 29 Applications/Permits
involved action by the Historic District Commission. Most of the permits are roof, interior and
signage permits.

Item 1.
CITY OF DOVER HISTORIC DISTRICT COMMISSION NOVEMBER 18, 2021
Ms. Horsey mentioned that she noticed that there was at least one crane that was painting part of
Priscilla Block Building on State Street. She asked if it was required to go through the Permitting
process? Mrs. Melson-Williams replied that painting does not require a Permit. In that general
area, the Verizon Building has a roof project underway.
Ms. Horsey asked when did the Historic District Commission need to learn of the paint colors that
are not appropriate. Mrs. Melson-Williams replied that the Design Standards & Guidelines for the
City of Dover Historic District Zone do not regulate color. They make some recommendations in
general about color, but it is not regulated as in some districts.
Ms. Horsey asked if a Permit was needed for the crane? Mrs. Melson-Williams replied if they are
using a crane it may be likely that there is some permitting through the Public Works Office if it
involves a sidewalk or adjacent street closure.
Mr. Czerwinski mentioned that he was not aware of the “no paint regulations”.
Ms. Horsey asked if they were getting a grant for the façade program? If they are, this could be a
problem on color. Mrs. Melson-Williams replied that the Façade Program is administered by the
Downtown Dover Partnership and she is not aware of a grant application for that location.
Ms. Mason asked about Staff Approval for Coney Island Grill Restaurant at 108 W. Loockerman
Street and Tastees Chicken & Seafood at 147 S. New Street. She wanted to know if these projects
were approved, and they are going to be tenants. Mrs. Melson-Williams replied that the Coney
Island Grill project is a restaurant that will occupy the first floor of that building. She knows that
they have had some supply issues in getting certain materials. She does not know the opening
timeframe. Tastees Chicken & Seafood was a Sign Permit. She believes that location was already
set up as a restaurant. She is not aware of the opening timeframe.
Mr. Czerwinski mentioned the window that is accessible to the outside that was discussed at the
last meeting. It falls within the purview because they are modifying the front of the window to be
accessible as a walkup verses a regular casemade window. The Historic District Commission really
needs to establish a baseline. If a façade project has two or more projects assigned to it, then it
should go before the Historic District Commission to avoid this idea of what they have a Permit
for, and it been approved, and it does not come before the Historic District Commission. Therefore,
it is a huge project changing the whole façade of the building. This a discussion we have had in
the past. He was not for sure that this project falls within that purview. Similar to the corner
building on Loockerman and State Street that never came before the Historic District Commission.
He mentioned that he was not sure if the Coney Island Grill Restaurant project should come before
the Historic District Commission because it does change the front appearance of the building.
Ms. Mason mentioned that the Black Swamp Artisanal Market at 204 W. Loockerman Street
looked very nice. It’s good and very positive. Mrs. Melson-Williams mentioned that the Black
Swamp Artisanal Market was just a Sign Permit. The Building was done years ago, and they are
the first tenants in that building space. There might have been some minor interior fit-out work
roughly a year ago.

Item 1.
CITY OF DOVER HISTORIC DISTRICT COMMISSION NOVEMBER 18, 2021
Mrs. Melson-Williams mentioned that there was a question regarding the Kirby & Holloway Sign.
The sign is not at the property at the current time. The site on Route 13 and Lepore Road is
undergoing redevelopment as a Car Wash facility. It is currently under construction. As part of the
conditions of approval from the Planning Commission, the sign that had been designated as a
historically significant sign under our sign regulations and the Historic District Commission was
part of that. It is required to be there. The sign has been lowered and removed to a sign company
for refurbishment. The refurbished sign will have the new business name.
Mr. Czerwinski asked about the sign. He mentioned that the Historic District Commission voted
whether or not the sign would remain in place because the historic sign outside of the Historic
District stay with the purview of the Historic District. He asked if this was correct. Mrs. Melson-
Williams replied that the Sign Regulations have an ability to designate a “historic and culturally
significant” sign. It was a piece that was added to the Sign Regulations a number of years ago for
situations such as this. There are certain signs and if they meet that criteria, it can be designated
by the Historic District Commission. It will allow the sign to continue to be in place even if the
business goes away. If a business vacates a location, then the signage has to be removed after a 6-
month timeframe. The designation years ago allowed the sign to remain in place although the
business (Kirby & Holloway Restaurant) was no longer there. If there are other signs that the
Historic District Commission feels meet that criteria, then it could be pursued for designation. Mrs.
Melson-Williams mentioned that she could include some training for an upcoming meeting
regarding provisions of Sign Regulations and afterwards there could be discussion.
Mr. Czerwinski mentioned that the Kirby & Holloway sign was left there because there was a
possibility that the restaurant was going back there, and the Historic District Commission needed
to extend the six-month period so it would allow them to come back. The sign was left there with
that in mind (the historic context). The sign should have been retired once the restaurant was no
longer coming back, as much as he loved the sign. Now you have the shape of the sign which is a
Car Wash which does not fit within the City Code.
Mrs. Horsey asked if the old panels was going to be kept. Mrs. Melson-Williams replied that she
was not sure what was happening with that. It was a series of metal panels and some of it may
have deteriorated.
Mr. Czerwinski asked if it was something that should have come before the Historic District
Commission instead of being approved by Staff. Mrs. Melson-Williams replied no, the designation
does not require a revisit to the Historic District Commission if something is going to happen to
the sign.
Ms. Mason asked who owned the sign, was it Kirby & Holloway Restaurant? Mr. Czerwinski
replied the new property owners. The City of Dover required the new property owners to keep the
sign.
Ms. Horsey asked what if the Car Wash does not hang around for any more than a year and the old
panels (content is lost). Can you ask the new owners can you or have you kept the sign company
that is doing the renovation? As a concern, which should be everyones, we were under the
impression that the sign and what it said was going to be kept as a point of clarification. Members

continue to have a brief discussion regarding the sign.
Department of Planning & Inspections Update
Mrs. Melson-Williams mentioned that in the members’ meeting packet was information about a
small grant funding program that is part of the Delaware Preservation Fund. Applications are due
by December 17, 2021. This year the grant has additional funding available for archaeological
projects. Grants and loans are available for buildings which are on, or eligible for listing on the
National Register, or which are in a designated local or National Historic District. The grant
amounts range from $1,000 to $5,000.
Mrs. Melson-Williams mentioned that as of the end of October 2021 our Director Mr. Dave Hugg
has been appointed the Interim City Manager and Mrs. Melson-Williams was appointed by
Council as the Interim City Planner & Building Inspector. There is also a new Assistant City
Manager Mrs. Sharon Duca. They are still searching for a new City Manager. Mr. Mark Nowak is
the Interim Public Works Director.
The Historic District Commission members thanked Mrs. Melson-Williams for everything that she
does for the City of Dover. They mentioned that they all greatly appreciate all that she does.
NEW BUSINESS
HI-21-06 Referral of Building Permit #21-1501 The Peoples Church at 46 South Bradford Street
Referral by the City Planner to the Historic District Commission for Review of Architectural
Review Certification for a Building Permit Application #21-1501 for drainage improvements
including an infiltration drainage feature and building system elements. The property is zoned RG-
1 (General Residence Zone) and subject to the H (Historic District Zone). The property is located
at the northwest corner of S. Bradford Street and Reed Street. The owner of record is The Peoples
Church. Address: 46 S. Bradford Street. Tax Parcel: ED-05-077.05-03-71.00-000. Council District
3.
Mrs. Melson-Williams gave an overview of Staff’s review of Permit Request. Staff found three
key findings from the Review of Administrative Building Permit regarding Building System
Elements, Infiltration Basin, and Removal of Water. Suggested Recommendations for
consideration to achieve Architectural Review Certification for the exterior drainage improvement
project focus on Building System Elements, Infiltration Basin and Removal of Existing Tree(s).
See Staff Review Report document (HI-21-06).
Representative: Mr. Brian Turner, Mountain Consulting Inc.
Mr. Turner who joined (virtually via WebEx) gave additional statements on the proposed
exterior drainage improvements at The Peoples Church. He mentioned the drainage issues that
the Church is currently experiencing. He mentioned the downspouts on the west side of the
building and the pavements in the alley that are not in great shaped and are cracked. They will
also be looking at the lawn with various landscaping. The point is to pick up the roof water in the
back and preserve the integrity and foundation of the building. They are getting water and
infiltration in the basement when it rains that is directly from surface drainage. An infiltration
test was completed and favorable results were received. There are three specific areas where
water is infiltrating into the basement: (1) kitchen stove-there is some negative slope with the

concrete, (2) make sure the drain on the north side is clear and direct water away from the
building, and (3) the south parking area makes a slope towards the building. There is an issue
with one of the existing downspouts in the corner. The entire property has been surveyed
(utilities).
Mr. Street asked why the application was coming before the Historic District Commission. Mrs.
Melson-Williams replied that it is an unusual type of project that is related to the area around the
building. It is a type of development activity even though it is a type of stormwater management
facility. It triggers a Permit under the Zoning Ordinance. Because it was a little unique in what
they were asking for we felt it would be best to at least refer it to the Historic District
Commission for any additional thoughts for how to approach this. Your Design Standards &
Guidelines, as mentioned, talks about landscaping, but they are really talking about planting
gardens, etc. on a property. This is a change to part of the lawn area. Staff noted their findings.
She mentioned that the fence that is currently there.
Ms. Horsey asked about the design and the looks. The slope is less drastic than what the plans
show. How much from the surface are you going down (lowest level) more or less? Mr. Turner
replied they will be going down 4-4 1/2 feet. We want to keep it as shallow is possible, but still
providing some storage and keeping it deep enough so that the pipes that are discharging into the
basin would be able to do what it is supposed to do in the lawn area. The intent is to also have it
function and operate as it is intended and designed for a long period of time before maintenance
is needed. The stones in the bottom will help filter out a lot of the debris that may collect at the
bottom over time.
Ms. Horsey asked what it meant by the bituminous or concrete, (400 square feet of ground). Mr.
Turner replied the “bituminous” represents the pavement that will be removed and replaced with
the underground piping in the parking area.
Ms. Horsey asked what the stone berm was going to be made of and how large is it? Mr. Turner
replied that the berm is just a filtration berm (2-inch stone about a foot high in the bottom of the
basin). It will also help to filter out water to the main stone core and trench.
Ms. Horsey mentioned that most of the stones won’t be seen if you are just walking down the
sidewalk. Mr. Turner replied from the sidewalk it will not be that noticeable. It is a foot high, and
it is at the bottom. The top of the berm will be 3-feet from the top bank of the basin. You will see
the landscaping and grass side slopes.
Ms. Horsey asked about the safety of the area (especially regarding children). It’s not like a
water retention pond that needs be fenced off. It appears to be a nice design and she just wanted
clarification. Mr. Turner replied that you are not going to see any standing water in the bottom of
the basin.
Mr. Czerwinski asked if any of the trees in the area would be saved. Mr. Turner replied that all of
the trees that are along the southern boundary of the property will be saved. One evergreen tree
will be removed and replaced with a new tree in that lawn area.

laws state that the Historic District Commission must meet quarterly.
OLD BUSINESS
Update of Certified Local Government (CLG) Grant Program Activities
Mrs. Melson-Williams mentioned that she did not have anything new to report. We are still
members of the program. Previously, we had a grant opportunity to seek consulting services. We
still have money allocated in this fiscal year Budget that can assist with that potential project. She
mentioned she will keep the Historic District Commission updated on any other future grant
opportunities coming out of that program. At the federal level, there are a number of different grant

related programs that are coming out of some of the various infrastructure and general focus on
what this country has for programs.
Implementation of 2019 Comprehensive Plan
Mrs. Melson-Williams mentioned that maybe in the new year we will take a look at the
Preservation Chapter of the Comprehensive Plan again. We will take a look at the goals and action
items that are identified and see if there are any items we want to focus on. We are finding that
education is always a key.
Mr. Czerwinski had one issue that he wanted to clarify about the paint. If someone paints a house
in the Historic District; there is no requirement for a permit. Mrs. Melson-Williams replied correct.
Mr. Czerwinski asked if someone painted zebra stripes on the Priscilla Block (Building) no one
could say anything about it. Mrs. Melson-Williams replied correct.
Mr. Czerwinski asked if there was anything the Historic District Commission could do to address
because it is a big hole in the permitting except for murals. We voted on murals that they needed
to be approved. Mrs. Melson-Williams replied if you want to look at your Design Standards &
Guidelines on page 3-21 there is a discussion about painting. It has a discussion and mentions the
guidelines.
Mr. Czerwinski mentioned that he thinks it needs to be addressed. What would be the process for
amending the Design Standards & Guidelines for the Historic District Commission to require a
Architectural Review Certification for painting? This is something that he is afraid of because
someone could paint something terrible within the purview or Historic District Guidelines.
Ms. Mason mentioned that this have been going on forever and ever. With the Victorian houses,
you have a lot of weird greens and purples. So far, we have not seen anything like that. Mr.
Czerwinski stated that we have been lucky. Ms. Mason mentioned that the chance of someone
painting something zebra striped is very small. Mr. Czerwinski mentioned it’s small, but it’s a big
enough loophole that it should be addressed. If you are talking about painting on the front of the
building, then you are changing the entire appearance of the building. Mrs. Melson-Williams
mentioned that there are some things if you are painting a surface that is not currently painted.
There is some information in the masonry section that talks about not painting brick. If it was a
painted surface before, there’s not a limitation. In order to make changes, it would be a different
section of Design Standards & Guidelines in the document. Additionally, it would involve some
changes in the Zoning Ordinance as well. Currently, it does not list painting as one of the things
that would require a permit for activity. It would be a multiple set process. Some Historic District
Commissions regulate heavily on painting and others do not.
Ms. Horsey mentioned when the Guidelines were created decades ago, painting was a huge amount
of contention because she sat on the committee. That was one thing they definitely left out on
purpose.

Mr. Street mentioned it is interesting and hard to regulate. At the same time, he does not disagree
with Mr. Czerwinski, but he does disagree. It’s a valid discussion. Perhaps, a stipulation could be
added to the Zoning Ordinance that zebra stripes is not permitted.
Ms. Horsey mentioned perhaps the Historic District Commission could make a recommendation
to stay within the character of the building.
Mrs. Melson-Williams suggested the members read through the Guidelines and Ordinances.
Ms. Mason moved to adjourn the meeting, seconded by Mr. Horsey, and unanimously carried 4-

ARCHITECTURAL REVIEW REPORT
Referral by City Planner to Historic District Commission
Meeting of January 20, 2022
Permit: Fence Permit #21-1556
Location: 502-506 South State Street, Dover
Located at the southwest corner of West Water Street and South
State Street
Tax Parcel: ED-05-077.09-03-70.00-000
File Number: HI-22-01
Present Zoning: RGO (General Residence and Office Zone)
H (Historic District Zone)
SWPOZ (Source Water Protection Overlay Zone)
Referral of Permit:
The following application Fence Permit #21-1556 for 502-506 South State Street is referred by
the City Planner to the Historic District Commission for consultation regarding the issuance of
the Architectural Review Certificate for a Fence project. Applications for certain types of
construction activity within the Historic District Zone (H) are reviewed by the City Planner (or
Staff as designated) for Architectural Review Certification as part of the Building Permit
application review process. Staff is referring the Permit for review under the provisions of
Zoning Ordinance, Article 10 Section 3.22(A) and (B). See below.
Section 3.22 Architectural review certification by the city planner.
(A) An architectural review certificate for specific classes of building permits, including
fences, signs, siding, window and door replacement, roofing, the addition or replacement
of decorative features, minor demolition, residential additions, and other construction of a
minor nature, may be issued by the city planner, after a review and determination that the
proposed construction is in general accordance with the standards set forth in subsection
3.25.
(B) The city planner may refer any permit application for demolition or construction in the
historic district for consultation with commission.
Permit Proposal:
Fence Permit #21-1556 was filed on November 8, 2021 for a project to construct an eight-foot
black aluminum fence along the north property line with a five-foot wide gate (along the Water
Street frontage) and between the two buildings along the State Street frontage. A letter dated
December 9, 2021 received by the applicant notes that the fence is to keep the vagrant population
out and to “allow a safe approach to the building for general maintenance, employees, and the
public.”

Staff Report to the Historic District Commission

The project site is located with the local Historic District Zone (H) and subject to the provisions
of the Zoning Ordinance, Article 3 §21 and referenced sections. This building is also located
within the boundaries of a National Register Historic District, specifically the Dover Green
Historic District.
Staff Review of Permit for Architectural Review Certification:
Project activities are reviewed for compliance with the Zoning Ordinance and the Design
Standards and Guidelines for the City of Dover Historic District Zone as stated in Zoning
Ordinance, Article 10 Section 3.25(A).
3.25 Architectural review standards.
(A) An architectural review certificate may be issued if it is found that the architectural
style, general design, height, bulk and setbacks, arrangement, location and materials
and structures affecting the exterior appearance are generally in harmony with
neighboring structures and complementary to the traditional architectural standards of
the historic district as set forth in the historic district design guidelines and standards
adopted by the planning commission and as set forth in the United States Secretary of
the Interior's Standards for Rehabilitation.
In reviewing the proposed project for Architectural Review Certification, Staff referenced
various sections of Chapter 3: Maintenance, Repair, Preservation and Restoration of Existing
Historic Buildings of the Design Standards and Guidelines for the City of Dover Historic
District Zone which presents the Recommended, Not Recommended, and Inappropriate
approaches to construction of various elements in the Historic District.
This Request should be reviewed for conformity with the design criteria and development
guidelines found in the Design Standards and Guidelines for the City of Dover Historic District
Zone. Specifically, Chapter 3 page 3-26 includes the discussion of fences in the Historic District
zone where it states that site fences and walls “should not exceed 4’0” in height and then
discusses the Recommended, Not Recommended, and Inappropriate practices associated with
fences and walls as related to materials. Chapter 3 presents the information on the appropriate
fence materials for use in the Historic District. Wood picket style fences and cast iron (metal)
fencing are Recommended. The proposed material (black aluminum) has been used throughout
the Historic District as it mimics cast iron.
Staff also looked at the provisions for fences in the Zoning Ordinance. The Zoning Ordinance
limits the height of fences to four (4) feet within the front yard setback (Article 5 §1.55) with
other provisions for increases fence height to 6.5 feet for side yards, rear yards, and the second
front yard on corner lots. The portion of fence along South State Street would be considered the
front yard and would be permitted at 4 feet in height. The portion proposed along West Water
Street would be considered the second front yard and in a residential district, not in the Historic
District, the fence is permitted to be up to 6.5 feet in height. The only materials discussed in the
Zoning Ordinance are related to the use of barbed wire or if the fence is serving as an Opaque
Barrier which requires a method of solid screening.
Historic District Commission Action
The Historic District Commission should consider the proposal for the fence project and take action
in regard to the Architectural Review Certification for the Fence Permit #21-1556. The Historic

Staff Report to the Historic District Commission

District Commission may add conditions for the fence in order to comply with the character of the
property within the Historic District.
Staff Findings from Review of Building Permit:
Staff findings and recommendations are summarized as follows for the proposed fence project as
presented in Permit #21-1556 and accompanying letter.
1. Fence Location: The proposed fence is to be located along a front property line (S. State
Street) and along a secondary front (W. Water Street) because of the nature of the
property as a corner lot. The fence would create a sort of courtyard area between the ‘L’
shaped building that fronts on both Water Street and State Street and the building
addressed as 502 S. State Street at the corner.
2. Fence Height – 8 ft. along a front yard: The Design Standards and Guidelines say that
generally the height of a fence should not exceed 4 ft. The suggested 8 ft. fence is double
of what is recommended by the Design Standards and Guidelines.
3. Fence Material: The proposed fence is to be made of black aluminum and to be in a
picket style with 4 horizontal rails. The black aluminum is to mimic the look of cast iron
fences.
Suggested Items for consideration to achieve Architectural Review Certification:
Staff notes the following items that could be considered to allow a better fit of the proposed
fence within the Historic District.
1. Fence Height: Staff recommends adhering to the recommended 4 ft. fence height in the
Historic District. Simply defining the space using the 4 ft. fence may be enough to show
people where they are not welcome unless they have a purpose for being at this location.
2. Fence Design: Staff recommends the use of decorative ornamentation to picket tops to
further deter people from trying to climb over the fence.
Advisory Comments and Recommendations:
1. The applicant shall be aware that issuance of a Fence Permit is required prior to the
commencement of construction. The Fence Permit Application will be subject to the
conditions of approval established and may be required to be updated if necessary, to
comply with these conditions established through the Architectural Review Certification
process.
2. Upon inspection by the Fire Marshal’s Office, it has been determined that the gate would
require panic hardware as the Water Street frontage acts as an egress path for both the
rear of 502 S. State Street Building and a side exit for 100 W. Water Street Building.

RE: Referral of Fence Permit #21-1556 to Historic District Commission, HI-22-01
Proposed Fence at 502 – 506 S. State Street, Dover DE
Tax Parcel: ED-05-077.09-03-70.00-000
Dear Applicant:
This letter is to inform you that Fence Permit application #21-1556 has been referred to the
City of Dover Historic District Commission for consultation. Fence Permit #21-1556 was
filed on November 18, 2021 for a fence project at 506 S. State Street in Dover, Delaware. The
Project outlined in the Permit submission involves placement of an eight-foot black aluminum
fence along the north and east property lines spanning between the buildings addressed as 502
and 506 S. State Street and 100 Water Street.
The location of the subject property within the City of Dover’s Historic District zone requires the
review and issuance of an Architectural Review Certificate (ARC) for construction and
demolition activities. Fences are eligible for Staff review of the ARC during the Building Permit
application process. Project activities are reviewed for compliance with the Zoning Ordinance
and the Design Standards and Guidelines for the City of Dover Historic District Zone as stated in
Zoning Ordinance, Article 10 Section 3.25(A).
In reviewing the proposed project for Architectural Review Certification, Staff referenced the
Chapter 3: Maintenance, Repair, Preservation and Restoration of Existing Historic Buildings of
the Design Standards and Guidelines which present the Recommended, Not Recommended, and
Inappropriate approaches to activities in the Historic District. The Design Standards and
Guidelines limit the height of fences to four feet and specifies appropriate materials for fencing.
This project proposes the placement of an eight-foot fence which far exceeds the recommended
height in the Historic District. Therefore, I am referring the Fence Permit application to the
Historic District Commission for consultation. See Zoning Ordinance, Article 10 Section 3.22
(A) and (B) listed below.

Person at the City Hall Conference Room and as a Virtual Meeting using WebEx, an audio
and video conferencing system. A separate meeting invitation to Join the Meeting virtually
will be sent by email to the applicants. This Permit Referral has been assigned Application
#HI-22-01. You are encouraged to participate in this meeting to discuss the project. Staff will
provide the Historic District Commission with the permit application materials and other
background information for their review and action.
Also attached to this Letter are the Design Standards and Guidelines for the City of Dover
Historic District Zone pertaining to Fencing (pages 3-26 and 3-27). If you choose to revise your
application and amend the fence height to four feet which would comply with the Historic
District Guidelines, I can approve the fence permit. If you have questions or wish to discuss
alternative options, please contact the Planning Office at (302)736-7196.

There is a rear exit at 502 and a side exit at 100. This is the egress path which has to go to
the public way (the road). A gate can go here, but it will need panic hardware so people can
exit properly/easily. There is already a Knox Box on the 100 building. They would need a key
to access this which would be placed in the Knox Box. Let me know if there are any
questions or concerns. Thank you.
