ATTACHMENT #2 LF&A Committee M eeting of 03/10/2008 CITY OF DOVER ORDINANCE #2008-17 1 BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER, IN 2 COUNCIL MET: 3 That Chapter 22 - Buildings, be amended by deleting the phrase “department of planning and 4 inspections” and replacing it with “licensing and permitting office.” 5 BE IT FURTHER ORDAINED: 6 That Chapter 22 - Buildings, Section 22-32 Additional Powers and Authority, be amended by adding 7 the following: 8 (5) The building inspector or his duly authorized assistant(s) shall have the right to enter any 9 building or enter upon any land at any reasonable hour, as necessary, in the execution of their 10 duties. 11 a. The building inspector shall notify the owner and tenant before conducting any inspection. 12 b. The building inspector or his duly authorized assistants shall display identification signed 13 by the city manager upon commencing an inspection. 14 c. Inspections shall be commenced in the presence of the owner, or his representative or tenant. 15 BE IT FURTHER ORDAINED: 16 That Chapter 22 - Buildings, Article VI Property Maintenance Code, Section 22-224 Enforcement, be 17 amended by deleting the phrase “building inspector” and replacing it with “city planner.” 18 BE IT FURTHER ORDAINED: 19 That Chapter 22 - Buildings, Article VIII Leases, Section 22-333, subsections (a) and (b) be amended 20 by inserting “or city planner” after the phrase “building inspector.” 21 BE IT FURTHER ORDAINED: 22 That Chapter 26 - Businesses, Section 26-32 be amended by deleting the phrase “department of planning 23 and inspections” and replacing it with “City of Dover.” 24 BE IT FURTHER ORDAINED: 25 That Appendix A - Subdivisions, Article VI, Section F General Grading, be amended by deleting the 26 phrase “city manager” and replacing it with “city engineer.” 27 ADOPTED: * 28 S:\ClerksOffice\Attachments and Exhibits\Committee Attachments\2008\03-10-2008 LF&A\03-10-2008 LF&A-2 - Chapters 22, 26, and Appendix A.wpd 29 SYNOPSIS 30 In March 2006, the City began a reorganization of the Department of Public Works and the 31 Department of Planning and Inspections into the Public Services Group. ATTACHMENT #3 LF&A Committee M eeting of 03/10/2008 CITY OF DOVER ORDINANCE #2008-18 1 BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER, IN 2 COUNCIL MET: 3 That Appendix B - Zoning Ordinance, Article 3 - District Regulations, Section 8 (Mobile Home Park 4 Zone, Subsection 8.2 be amended by deleting the phrase “building inspector” and replacing it with 5 “city planner.” 6 BE IT FURTHER ORDAINED: 7 That Appendix B - Zoning Ordinance, Article 5 - Supplementary Regulations, Section 8 - 8 Performance Standards, be amended by deleting the phrase “building inspector” and replacing it 9 with “city planner.” 10 BE IT FURTHER ORDAINED: 11 That Appendix B - Zoning Ordinance, Article 5 - Supplementary Regulations, Section 16 - Tree 12 Planting and Preservation, be amended by deleting the phrase “building inspector” and replacing 13 it with “city planner.” 14 BE IT FURTHER ORDAINED: 15 That Appendix B - Zoning Ordinance, Article 7 - Nonconforming Buildings and Uses, Section 1 - 16 Nonconforming Buildings and Uses, Subsection 1.4 be amended by deleting the phrase “building 17 inspector” and replacing it with “city planner.” 18 BE IT FURTHER ORDAINED: 19 That Appendix B - Zoning Ordinance, Article 8 - Enforcement and Penalties, Section 3 - Duties of 20 the Building Inspector, be amended by deleting it in its entirety and replacing it with the following: 21 Section 3. Duties of the City Planner 22 2.1 It shall be the duty of the city planner to enforce the provisions of this ordinance and all of the 23 rules, conditions and requirements adopted or specified pursuant thereto. 24 2.2 It shall be the duty of the city planner to interpret the provisions of this ordinance. Appeals of 25 the city planner’s interpretation shall be heard by the Board of Adjustment in accordance of 26 Article 9. 27 2.3 The city planner shall maintain files, open to the public, of all applications filed, along with 28 plans submitted therewith pursuant to this Appendix.

PROPOSED ORDINANCE 2008-18 - APPENDIX B PAGE 2 29 2.4 The city planner shall maintain files, open to the public, of all complaints of violations of 30 provisions of this of this ordinance, as well as any action taken as a result of this complaint. 31 The names of complainants shall not be open to the public. 32 2.5 The city planner and his duly authorized assistants shall have the right to enter upon any land 33 that is the subject of an application under this appendix during any reasonable hour, as 34 necessary in the execution of the requirements of this appendix. 35 BE IT FURTHER ORDAINED: 36 That Appendix B - Zoning Ordinance, Article 9 - Board of Adjustment, Section 3 - Procedure, be 37 amended by deleting the phrase “building inspector” and replacing it with “city planner.” 38 BE IT FURTHER ORDAINED: 39 That Appendix B - Zoning Ordinance, Article 10 - Planning Commission, Section 1 - Approval of 40 Conditional Uses, and Section 2 - Site Development Plan Approval be amended by deleting the 41 phrase “building inspector” and replacing it with “city planner” and by deleting the phrase “planning 42 director” and replacing it with “city planner.” 43 BE IT FURTHER ORDAINED: 44 That Appendix B - Zoning Ordinance, Article 10 - Planning Commission, Section 3 - Historic 45 District Commission and Architectural Review, Subsection 3.42 - Responsibility of the Historic 46 District Commission, Paragraph (b), be amended by deleting the phrase “building inspector” and 47 replacing it with “planner.” 48 ADOPTED: * 49 S:\ClerksOffice\Attachments and Exhibits\Committee Attachments\2008\03-10-2008 LF&A\03-10-2008 LF&A-3 - Appendix B.wpd 50 SYNOPSIS 51 In March 2006, the City began a reorganization of the Department of Public Works and the 52 Department of Planning and Inspections into the Public Services Group. The reorganization 53 has progressed well, and the proposed ordinance would codify the changes in operations and 54 reporting. These specific changes are recommended to the Zoning Ordinance to assign the 55 responsibility for administering the Zoning Ordinance to the City Planner, rather than the 56 Building Inspector. Currently and previously, the City Planner has been the appointed 57 Building Inspector as well.
