OPEN FORUM The Open Forum was held at 6:15 p.m., prior to the commencement of the Official Council Meeting. Council President Hare declared the Open Forum in session and reminded those present that Council was not in official session and could not take formal action. Denise Hicks Barnes, 317 Alder Road, spoke to members of council regarding a grass violation she received from the City of Dover. Ms. Hicks Barnes explained that she was cited for failure to maintain grass/weeds at a proper height. She further explained that she normally maintains her grass on a regular basis, however, because of the cost of a car repair, she told her grass service to skip one week of cutting. Ms. Hicks Barnes explained that she called and spoke to Mr. Morris, and he suggested that she call Mr. Eddie Kopp, Code Enforcement Supervisor. When she spoke to Mr. Kopp, he told her she would need to speak to Mary Ellen Gray. Ms. Hicks Barnes explained that Ms. Gray told her she would need to go before the City Council and ask them to change the ordinance. She further stated that Ms. Gray explained that if it is done for her, it will have to be done for all 1,100 people that were cited. Ms. Hicks Barnes stated that as a tax-paying, law-abiding, community-serving citizen of Dover, she felt completely disrespected and undervalued. Ms. Hicks Barnes made several recommendations to members of the council on revising the ordinance and making changes that empower the homeowner, not just penalize them for the offense that is being cited. Mr. Anderson stated that council will make sure this matter is placed on the agenda next month. INVOCATION The invocation was given by Elder Ellis Louden. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Councilman Anderson ADOPTION OF AGENDA Mr. Neil moved for adoption of the agenda, seconded by Mr. Boggerty, and unanimously carried. There will be no separate discussion of these items unless a member of Council so requests, in which event the matter shall be removed from the Consent Agenda and considered a separate item. Mr. Neil moved for adoption of the consent agenda, seconded by Mr. Rocha, and carried by a unanimous roll call vote.

Iriowen ITEMS NOT ON THE CONSENT AGENDA RESOLUTION NO. 2023-08 – SUPPORTING THE CREATION OF LIBRARY TAX DISTRICTS IN KENT COUNTY Mr. David S. Hugg, III, City Manager explained that Brian Sylvester, Library Director, does a great job keeping the city informed of what the State and Kent County libraries are doing. He further explained that the county has had a method for distributing revenues to libraries based on borrowing from residents that live outside the jurisdictions that have a public library in their community, which is known as reciprocal borrowing. Mr. Hugg stated that it is a flawed system that is not predictable and susceptible to epidemics, or anything that might drive up the usage of the library or the delivery of library books. Kent County has offered to create a library tax district program. Mr. Hugg stated that Milford has a library tax district, and the new Smyrna and Harrington Libraries are asking to set up the same. Mr. Hugg explained that if this were to happen, reciprocal borrowing would become unnecessary and unworkable, and the new county administrator asked if the City of Dover would support a library tax district program. Mr. Hugg stated that all the residents of the city would not be subject to the county’s library tax. Mr. Neil moved for the adoption of Resolution No. 2023-08. The motion was seconded by Mr. Anderson, and by a unanimous roll call vote, Council adopted the following Resolution: A RESOLUTION SUPPORTING THE CREATION OF LIBRARY TAX DISTRICTS IN KENT COUNTY WHEREAS, the libraries of Kent County currently participate in a Reciprocal Borrowing Agreement in which a County Library Tax is assessed to the residents of the unincorporated parts of Kent County, and funds are distributed to libraries in proportion to the number of items they circulate; and WHEREAS, not all funds raised by the County Library Tax are effectively distributed via this method; and WHEREAS, the Kent County Levy Court is considering establishing Library Tax Districts corresponding to the five school districts in Kent County to replace the Reciprocal Borrowing Agreement; and WHEREAS, the city limits of Dover are within both the Capital and Caesar Rodney School Districts; and WHEREAS, the residents of the city of Dover already fund the Dover Public Library through their property taxes and would effectively be double taxed for library services if a library tax were levied on them;
