Hugg, III, City Manager and Lori Peddicord, Controller / Treasurer SUBJECT: GIS Utility Network Wastewater Upgrade – Sole Source Vendor TIMETABLE: Notice to Proceed to be issued within thirty (30) days of Council approval. Project anticipated to be completed within three hundred and sixty five (365) calendar days from issuance of Notice to Proceed. RELATED PROJECT: X REFERENCE: CIP- Wastewater Projects EXPENDITURE REQUIRED: $138,700 AMOUNT BUDGETED: $150,000 FUNDING SOURCE (Dept./Page in CIP & Budget): Department of Water & Wastewater, Wastewater Division – CIP page 159, WW2404 GIS Utility Network Upgrade No.: 403-41-69-99-000- 54031. STAFF RECOMMENDATION: Award the contract to Environmental Systems Research Institute, Inc. (ESRI), for the GIS Utility Network Wastewater Upgrade, for the amount of $138,700. BACKGROUND AND ANALYSIS: The Fiscal Year 2023 Capital Improvement Plan includes funding to upgrade the existing wastewater data that is currently housed in the city’s geographical information system (GIS). This is necessary due to the phasing out of the existing platform that the city utilizes. The company that the Department of Water & Wastewater will be utilizing is a sole source vendor, ESRI. The city is currently engaged in a Small Enterprise Agreement County and Municipality Government with ESRI that will expire in FY27. Additionally, ESRI has proprietary use over the Utility Network platform that we will be utilizing. City staff reviewed the submission and found that the ESRI proposal met all requirements for the of the project. Staff recommends awarding the contract to ESRI in the amount of $138,700 the GIS Utility Network Wastewater upgrade. 3

ACTION FORM Item 1. PROCEEDING: Council Committee of the Whole (Leg & Fin) DEPARTMENT OF ORIGIN: Fire/Robbins Hose DATE SUBMITTED: August 29, 2023 PREPARED BY: David Carey, Fire Chief SUBJECT: Replacement of Squad 2 REFERENCE: Capital Investment Plan, FY27 Budget RELATED PROJECT: N/A REVIEWED BY: EXHIBITS: EXPENDITURE REQUIRED: $1,142,791.00 FINANCING/LEGAL COST ESTIMATED: $20,000 AMOUNT BUDGETED: $1,200,000.00 in CIP ($166,113.00 annual payments over 7 years) FUNDING SOURCE (Dept./Page in CIP & Budget): Fire Department Budget TIMETABLE: Upon Approval the Apparatus will be ordered, Estimated Delivery would be November 2026. STAFF RECOMMENDATION: Safety Advisory Committee and City Council Approval BACKGROUND AND ANALYSIS During the August 15,2023, Council Committee of the Whole meeting, Chief Carey was instructed to report back to the committee on September 12, 2023, with a CAF to replace a second fire engine. This derived from a question about purchasing two fire engines by the council due to cost savings of over $336,051.00. The Fire Chief complied with the direction of Council committee and reported back to the Robbins Hose Company membership who authorized the Fire Chief to follow through with the direction given by the Council Committee of the Whole to replace the second Engine. This engine will be 18 years old in 2026, it is a 2008 Pierce Impel. Our fire apparatus was originally on a 15-year replacement program in accordance with the National Fire Protection Association (NFPA) standards, Due to economic fallout, manufacturing lead times are 28 months (about 2 and a half years). The Fire Chief is requesting the ability to order the replacement fire apparatus to ensure delivery in November 2026. Our apparatus replacement will remain on schedule for fire apparatus replacement with this purchase. Since the Council Committee of the Whole meeting Controller/Treasurer Lori Peddicord, Chief Carey and Fire Company Treasurer Terry Whitham have met regarding finance options for future fire apparatus purchases. The Fire Chief has created a spec based off the current apparatus with fire suppression and safety upgrades to the apparatus. An HGAC request was made and the proposal for the specification came in at $1,142,791.00 which brings the truck under budget by $88,883.00 per the city ‘s projected (CIP) budget of 1,200,000.00 to finance. This will save the city approximately $336,051.00 by ordering the apparatus now versus 2027. The Fire Department will work to ensure that the new fire engine will come within the budgeted amount to include any finance charges, legal/bond council cost and fees. Controller/Treasurer Lori Peddicord is investigating financing and line of Credit options for the purchase of the apparatus. The apparatus will be financed with a seven-year bank qualified tax- exempt loan or a line of credit. Annual payments will be reflected in future budgets starting in FY 2027. A Bond Resolution will be presented to the City Council prior to the apparatus' delivery. The request is for $1,162,791.00 to include authorizing the adjustment in the fire department CIP which would move the apparatus replacement of Squad 2 from FY 27. The requested amount includes estimated finance and Legal cost and approving placing the order for the replacement engine with delivery in November of 2026. 11

Item 3. ACTION FORM PROCEEDING: Council Committee of the Whole DEPARTMENT OF ORIGIN: Planning and Inspections DATE SUBMITTED: September 1, 2023 PREPARED BY: Mary Ellen Gray and Eddie Kopp SUBJECT: Code Revision: Chapter 114- Vegetation, Article II- Weeds, Article III Bamboo, Appendix F – Fees and Fines, Chapter 114 Vegetation REFERENCE: N/A RELATED PROJECT: N/A REVIEWED BY: EXHIBITS: Ordinance Number 2023-10 EXPENDITURE REQUIRED: n/a AMOUNT BUDGETED: n/a FUNDING SOURCE (Dept./Page in CIP & Budget): n/a TIMETABLE: Review of ordinance language September 12, 2023; First Reading October 9, 2023; Public Hearing and Final Action October 23, 2023 STAFF RECOMMENDATION: Amend Code as requested BACKGROUND AND ANALYSIS Summary/Synopsis This is a text amendment to the Weeds Ordinance that allows for a 48-hour notice to property owners of a violation of the weeds ordinance without penalty. This revision also adds a provision for a fine exemption to a violation of the weeds ordinance by city staff due to hospitalization or illness and an appeal process to Council should this exemption be denied by city staff. This revision also revises Appendix F – Fees and Fines for this Chapter to set a minimum payment for the City’s mowing contractors due to rising costs. This revision also includes some clarification of the bamboo ordinance. Background As a result of a discussion during the public comment period at a Council meeting in the recent past regarding concerns with the violation process for tall grass, Staff was asked to come back to Council to offer some suggested changes to this ordinance to improve the process for Council discussion. Staff suggested changes were presented to the Legislative, Finance and Administrative Committee at the June 13, 2023 Council Committee meeting of the Whole. These changes are articulated in the attached June 8, 2023 memo to Council Committee Meeting of the Whole. During the Council discussion, Council overall concurred with the Staff recommendations and directed Staff to add a fine exemption for a tall grass violation by City Staff due to hospitalization or illness and an appeal process to Council should this exemption be denied by City Staff. In addition, Staff also drafted a revision to Appendix F – Fees and Fines to set a minimum payment to the City’s mowing contractors due to rising costs. Also, Staff drafted some minor revisions to Article III Bamboo to remove the term “encroaching” and deleted the exemption section to clarify City enforcement of the bamboo ordinance. 17

Item 3. MEMORANDUM Department of Planning, Inspections & Community Development P.O. Box 475 Dover, DE 19903 Phone: (302) 736-7196 Fax (302) 736-4217 DATE: June 8, 2023 TO: Council Committee Meeting of the Whole FROM: Mary Ellen Gray, AICP, Director of Planning, Inspections and Community Development SUBJECT: Potential Revisions to Chapter 114 Vegetation, Article II Weeds Ordinance Introduction The Weeds Ordinance was revised on October 10, 2022, regarding the fines section of this ordinance (enclosed). However, the rest of this ordinance was not reviewed for any potential revisions. At a recent City Council meeting during the public comment period, there was a discussion regarding concerns with the violation process for tall grass. Staff was asked to come back to Council to offer some suggested changes to this ordinance to improve this process for Council discussion. Background By way of background, 80-90% of complaints that come into the Code Enforcement office during warmer weather months are grass violations. As of June 6, 2023 there are 533 grass cases reported since March 28, 2023. Suggested Changes Prior to articulating suggested revisions in the Ordinance, I thought it would be helpful to discuss potential changes in concept form and then based on Council input, language revisions will be presented to Council for further discussion and review at a future meeting. These suggested revisions include: • Upon a tall grass violation, Code Enforcement Staff will leave a door hanger (enclosed) that includes a measuring rule that gives the property owner 48 hours to cut the grass. Vacant and dangerous buildings are exempt. Discussion: Staff should not measure the grass height due to concerns about trespassing on the property. Staff uses reference points in photos for measurement. Previously there was a seven (7) day grace period for tall grass and Staff found this time period to be too long. • The property owner should get a limited number of door hanger warnings a year. Perhaps one (1) every eighteen (18) months. Discussion: this will prevent repeat offenders from building this time into their lack of response and thereby prolonging the time the property is out of compliance. 19

Página 20

Item 3. • Do not recommend changing the first offense to $0.00 and suggest keeping it at the current $50.00 fine. Discussion: Staff feels that since the fine change from $25.00 to $50.00 on October 10, 2022, repeat grass cases have gone down. • Staff do not recommend adding grass violations to the Construction, and Property Maintenance Code Board of Appeals. Discussion: Whether the grass is eight (8) inches, or more is either pass or fail. Should a property owner have a question as to whether the grass is eight (8) inches or higher, then they can call the Code Enforcement Officer and/or the Code Enforcement Supervisor to come out and measure to verify. I and Staff look forward to discussing these suggestions and yours at the June 13 Council Committee Meeting of the Whole. In the meanwhile, please don’t hesitate to reach out to me with any questions or concerns at 302-736-7196 or mgray@dover.de.us. Thank you.
