Dear Sir/Madam:
On June 26, 2006, the Dover City Council adopted the Vacant Building
Ordinance to reduce the negative impact vacant buildings have on the
surrounding businesses and neighborhoods. This letter is to inform you that
your building has been found to be vacant as defined under Article 12,

In accordance with this ordinance, this building must be registered with the
City of Dover. Enclosed with this notice is a registration form. Please
return this form by July 13, 2026 to the City of Dover Department of Planning
and Inspections. Failure to return the form within 30 days of mailing will
result in the building being registered by this department.
An annual registration fee shall be paid at the time of registration. If the
building inspector registers the building as vacant the fee shall be due not
later than 30 days after the building is registered as vacant. Please read
the enclosed leaflet for more information on fees and any exemptions that may
apply to the fees. You have the right to appeal to the construction and

writing, on or before 5pm July 13, 2026.
The building inspector shall inspect any premises in the city for the purpose

Please contact this office between the hours of 8:30 a.m. and 4:30 p.m. at

Good afternoon,
I received a notice taped to my door at 236 N Governors Ave regarding my home being
vacant. This is the first time I’m learning of any such attempt to register my home as such. I
spoke to John England a few moments ago and he informed me that several months have
shown “less water usage than is normal for a single family home.”
I live at this address. It is my primary place of residence and has been since I moved in. I
cannot imagine why my water usage would not be considered normal as I live here full time
by myself. The only reason I can think of is that I have been unemployed since March 2025
and was diagnosed with major depressive disorder since before that time. Perhaps I don’t do as
many loads of laundry as one should, but that doesn’t mean I don’t live here, flushing toilets
regularly.
I can provide numerous and consistent receipts of food deliveries to this address over the
periods Mr England indicated. I’m not sure what other proof of habitation I can provide, other
than I cannot imagine my water/sewer numbers were 0 and my electric usage would have had
to fluctuate on a regular basis.
I hope this information is sufficient. If not, please let me know what information I need to
provide to dispute this assessment.

Dear Sir/Madam:
On June 26, 2006, the Dover City Council adopted the Vacant Building
Ordinance to reduce the negative impact vacant buildings have on the
surrounding businesses and neighborhoods. This letter is to inform you that
your building has been found to be vacant as defined under Article 12,
Chapter 22 of the Dover Code of Ordinances.
In accordance with this ordinance, this building must be registered with the
City of Dover. Enclosed with this notice is a registration form. Please
return this form by June 23, 2026 to the City of Dover Department of Planning
and Inspections.
You have the right to appeal to the construction and
property maintenance code board of appeals. Such an appeal must be filed, in
writing, on or before 5pm June 23, 2026.
The building inspector shall inspect any premises in the city for the purpose
of enforcing and assuring compliance with the provisions of this article.
Upon request of the building inspector, the owner shall provide access to all
interior portions of a vacant building to permit a complete inspection.
Please contact this office between the hours of 8:30 a.m. and 4:30 p.m. at
(302) 736-7011 with any questions or concerns regarding this letter.
Sincerely,

To the Dover City Clerk,
Thereby appeal Citation No. 25-307409, 26- 1774-01 issued against the property located at
838 Monroe Terrace, Dover, Delaware.
I respectfully request that this citation be dismissed in its entirety. If the City declines to
dismiss the citation, this letter shall serve as my formal demand for a full hearing on the
matter.
The citation alleges a violation of PM 302.1 (Sanitation) for "Failure to Remove Junk and
Debris." However, the City has failed to establish that any of the items located on my property
constitute garbage, trash, junk, debris, or an unsanitary condition as required by the ordinance.
All of the items depicted in the City's photographs are my personal property and were being
retained for future use. None of the items were garbage, refuse, abandoned materials, or waste.
The City has not alleged or demonstrated that any item created a health hazard, safety hazard,
vermin infestation, environmental concern, or any other condition that would reasonably be
considered unsanitary.
Furthermore, neither the citation nor the prior notices identified which specific items allegedly
violated the ordinance. I was never provided a written list of items that the City considered
noncompliant. Instead, I received generalized demands to remove property without any
explanation of why specific items constituted "junk" or "debris" under the code.
The photographs show stored personal property, including vehicle parts, tires, fencing
materials, windows, bicycles, and yard equipment. These items were located in the rear yard
of my property and were not visible from the public street. Ownership and storage of personal
property does not, by itself, transform that property into garbage, trash, junk, debris, or an
unsanitary condition.
mn wong
The ordinance relies upon subjective terms such as "clean," "sanitary," "junk," and "debris,"
yet the City has failed to explain how any specific item met those definitions. The citation
therefore lacks sufficient specificity to support enforcement and fails to provide adequate
notice of the alleged violation.
Talso note that the violation documentation references an inspection date of June 23, 2025,
while the citation was issued on May 7, 2026. The basis for this timeline is unclear and further
supports the need for disclosure of all records associated with this matter.
Accordingly, I request immediate dismissal of Citation No. 26-1774-01, 25-307409. If the
City declines to dismiss the citation, I demand a full hearing and request that the City preserve
and produce all evidence it intends to rely upon, including but not limited to:
+ All inspection reports and inspection notes
Paj 59
+ All photographs and video recordings
« All complaints received regarding the property
+ All reinspection records
¢ Any written standards, policies, or guidelines used to determine what constitutes "junk,"
"debris," or an unsanitary condition under PM 302.1
« Any documents identifying the specific items alleged to be in violation
I reserve all rights and defenses available under applicable law and will present evidence and
testimony at the hearing if dismissal is denied.
Respectfully,
Michele Staats

114
Paj 115
+ All photographs and video recordings
« All complaints received regarding the property
+ All reinspection records
¢ Any written standards, policies, or guidelines used to determine what constitutes "junk,"
"debris," or an unsanitary condition under PM 302.1
« Any documents identifying the specific items alleged to be in violation
I reserve all rights and defenses available under applicable law and will present evidence and
testimony at the hearing if dismissal is denied.
Respectfully,
Michele Staats

Paj 155
+ All photographs and video recordings
« All complaints received regarding the property
+ All reinspection records
¢ Any written standards, policies, or guidelines used to determine what constitutes "junk,"
"debris," or an unsanitary condition under PM 302.1
« Any documents identifying the specific items alleged to be in violation
I reserve all rights and defenses available under applicable law and will present evidence and
testimony at the hearing if dismissal is denied.
Respectfully,
Michele Staats
