CONSTRUCTION AND PROPERTY MAINTENANCE CODE BOARD OF APPEALS The Construction and Property Maintenance Code Board of Appeals meeting was held on May 29, 2019 at 4:04 p.m. with Chairman Anderson presiding. Members present were Mr. Neil and Mr. Martin. ADOPTION OF AGENDA Mr. Neil moved for approval of the agenda, seconded by Mr. Martin and unanimously carried. Property Maintenance Code Citations (Chapter 22 - Buildings and Building Regulations, Article XII - Vacant Buildings, Section 22-403 - Registration and Registration Fee) - Appeal of Decision and Registration Fee - 119 Spruance Road (John Forbes) Mr. Ron Coburn, Code Official, reviewed the case history for 119 Spruance Road. Mr. Forbes advised that he had moved into the property on January 8, 2019. He stated that he is at the property in the evenings and uses very little electricity. Responding to Mr. Martin regarding the claims of the failed septic system, Mr. Forbes stated that he is not aware of any issues with the septic system and has not had any problems arise during his ownership of the dwelling. Mr. Forbes informed members that he hopes to move back to West Denneys Road and sell the property located at 119 Spruance Road. Mr. Anderson asked if there was any documentation or evidence that the property was occupied. In response, Mr. Forbes stated that all of his City of Dover mail is now sent to 119 Spruance Road and that he maintains the residence according to City Code. Mr. Coburn advised that the City of Dover utility bills were transferred from Mr. Forbes’ West Denneys Road address to 119 Spruance Road on May 13, 2019, after this appeal was submitted. Mr. Coburn provided documentation from the City of Dover Customer Service Department regarding Mr. Forbes’ change of address. (Attachment #1). Mr. Martin moved to recognize that the property is currently occupied and thereby forgiving or releasing the current vacant building receipts. The motion was seconded by Mr. Neil and unanimously carried.
