SPECIAL COUNCIL MEETING - ES ACTION (PUBLIC) - Pend Litigation and Potential Land Acq

SPECIAL COUNCIL MEETING A Special Council Meeting was held on June 24, 2019 at 6:00 p.m. with Council President Hare presiding. Members present were Mr. Anderson (arrived at 6:02 p.m.), Mr. Sudler, Mr. Neil, Mr. Slavin, Mr. Cole, Mr. Polce, and Mr. Taylor. Mr. Lindell was absent. Mayor Christiansen was also present. Council staff members present were Mr. Rodriguez, Mrs. Mitchell, Mr. Hugg (arrived at 6:17 p.m.), and Mrs. McDowell. Other staff members present were Mr. Harline. ADOPTION OF AGENDA Mr. Sudler moved for adoption of the agenda, seconded by Mr. Neil and unanimously carried. Mr. Neil moved to recess into Executive Session pursuant to 29 Del. C. §10004(b)(4) - Strategy sessions, including those involving legal advice or opinion from an attorney-at-law, with respect to collective bargaining or pending or potential litigation, but only when an open meeting would have an adverse effect on the bargaining or litigation position of the public body and pursuant to 29 Del. C. §10004 (b)(2) - Preliminary discussions on site acquisitions for any publicly funded capital improvements, or sales or leases of real property. The motion was seconded by Mr. Cole and unanimously carried. The Special Council Meeting recessed into Executive Session at 6:01 p.m. The Executive Session adjourned at 6:55 p.m. ACTION RESULTING FROM THE EXECUTIVE SESSION Potential Land Acquisition During their Executive Session of May 13, 2019, Council approved the actions recommended by the City Manager regarding the potential land acquisition, all of which are contingent upon the successful completion of the due diligence. During the Executive Session, Mrs. Donna Mitchell, City Manager, provided an update on the due diligence conducted regarding the potential land acquisition. Mr. Sudler moved to reject the contract. The motion was seconded by Mr. Neil and carried with Mr. Anderson voting no. Mr. Slavin moved for adjournment, seconded by Mr. Anderson and unanimously carried.
