SPECIAL COUNCIL MEETING A Special Council Meeting was held on December 9, 2015 at 8:11 p.m. with Council President Slavin presiding. Members present were Mr. Anderson, Mr. Cole, Mr. Hare, Mr. Hosfelt, Mr. Hutchison, Mr. Lewis, Mr. Neil, and Mr. Sudler. Council staff members present were Mr. Koenig, Mrs. Mitchell, and Mrs. McDowell. Mayor Christiansen was also present. ADOPTION OF AGENDA Mr. Hutchison moved for approval of the agenda, seconded by Mr. Hosfelt and unanimously carried. Mr. Neil moved to recess into Executive Session pursuant to 29 Del. C. §10004(b)(6) - discussion of the content of documents excluded from the definition of "public record" in §10002 of this title where such discussion may disclose the contents of such documents (§10002 (l)(2) - trade secrets and commercial or financial information obtained from a person which is of a privileged or confidential nature); pursuant to 29 Del. C. §10004(b)(4) - strategy session; and pursuant to 29 Del. C. §10004(b)(9) - personnel matters. The motion was seconded by Mr. Hare and unanimously carried. The Special Meeting recessed at 8:11 p.m. Mr. Hare moved to adjourn the Executive Session, seconded by Mr. Neil and unanimously carried. Executive Session adjourned at 9:28 p.m. ACTION RESULTING FROM THE EXECUTIVE SESSION Consideration of Hardship Created by Commercial Electric Rates During the Executive Session, Mr. Scott Koenig, City Manager, advised members of a proposed Economic Retention Rate for the purpose of attracting new businesses and retaining existing businesses. Mr. Hare moved to authorize the City Manager to compose a letter releasing the tariff to the party in question. The tariff will be effective January 1, 2016 and continue for six (6) months. On July 1, 2016, if the party is expanding as anticipated, the rate will be extended for one (1) year. At the end of that year, Council will evaluate continuation of the tariff. The letter is to be reviewed by Mr. Hare and Mayor Christiansen prior to its release. The motion was seconded by Mr. Hosfelt and unanimously carried. Resolution of Employee Grievance During the Executive Session, Mr. Scott Koenig, City Manager, advised members of an employee grievance and its proposed resolution.

Mr. Hare moved for adjournment, seconded by Mr. Neil and unanimously carried. The Special Meeting adjourned at 9:32 p.m. TRACI A.
