SPECIAL COUNCIL MEETING - ES ACTION (PUBLIC) - City Clerk and Personnel Matters

SPECIAL CITY COUNCIL MEETING A Special City Council Meeting was held on September 13, 2021 at 5:15 p.m. with Council President Sudler presiding. Members present were Mr. Anderson (arrived at 5:17 p.m.), Mr. Boggerty, Mr. Neil, Mr. Hare, Mrs. Arndt, and Mr. Rocha. Mr. Lindell and Mr. Taylor were absent. Council staff members present were Mr. Rodriguez and Mrs. Sapp. ADOPTION OF AGENDA Mr. Hare moved for adoption of the agenda, seconded by Mr. Neil and unanimously carried. Mr. Hare moved to recess into Executive Session pursuant to 29 Del. C. §10004 (b)(1) Discussion of an individual citizen's qualifications to hold a job or pursue training unless the citizen requests that such a meeting be open, 29 Del. C. §10004(b)(6) - Discussion of the content of documents, excluded from the definition of "public record" in §10002 of this title where such discussion may disclose the contents of such documents (§10002(o)(1) - any personnel, medical or pupil file, the disclosure of which would constitute an invasion of personal privacy, under this legislation or under any State or federal law as it relates to personal privacy) and 29 Del. C. §10004 (b)(9) - Personnel matters in which the names, competency and abilities of individual employees are discussed, unless the employee requests that such a meeting be open. The motion was seconded by Mrs. Arndt and unanimously carried. The Special Council Meeting recessed into Executive Session at 5:16 p.m. The Executive Session adjourned at 5:59 p.m. ACTION RESULTING FROM THE EXECUTIVE SESSION Personnel Matters - City Clerk Search During the executive session, members of Council considered the selection of a City Clerk. Mr. Rocha moved that Council accept the City Manager/City Clerk Selection Committee’s recommendation to hire for the City Clerk’s position. The motion was seconded by Mr. Hare and unanimously carried. Personnel Matters During the executive session, members of Council were briefed on the progress of the investigation on the submitted complaints. Mr. Anderson moved to authorize the City Solicitor to choose and appoint a firm to investigate the submitted complaints. The motion was seconded by Mr. Boggerty and unanimously carried. Responding to Mr. Rodriguez, Mr. Anderson stated that he thought the contractual service budget should stay under $10,000, unless they approve otherwise. Mr. Sudler suggested that Mr. Rodriguez come up with two alternatives, if necessary, and contact him or Mr. Hare, who has been working as his liaison.
