Uh well, that that's going to
Play from 2:20:11Oct 27, 2026, Council Committee of the Whole
Well, you're right. Which it looks like it would be the the state representatives, and that meeting would not happen until after uh well, I would say, till after the election is certified, which would be uh I believe uh November 5th. So, that'd be at least the 6th would be the soonest it could happen.
Play from 2:20:20Oct 27, 2026, Council Committee of the Whole
And uh and, of course, as you say, that's based on, you know, getting getting them together is um that it might have to be several meetings, quite frankly.
Play from 2:20:41Oct 27, 2026, Council Committee of the Whole
Uh thank you. Uh Mrs. Arndt?
Play from 2:22:47Oct 27, 2026, Council Committee of the Whole

I think that fell.
Play from 2:27:05Oct 27, 2026, Council Committee of the Whole
Are you talking about for the um Yeah.
Play from 2:27:10Oct 27, 2026, Council Committee of the Whole
And uh it's and uh now it's Oh, okay. Please.
Play from 2:27:34Oct 27, 2026, Council Committee of the Whole
Thank Thank you, and I And and I think that's the response to us that statement being made not that not to you, but to the general uh statement being made because that as we all believe asking if the tough questions are going to be asked, and they better be asked in here. And I'm sure everybody agrees with that, right? Uh Dr. Sudler?
Play from 2:28:33Oct 27, 2026, Council Committee of the Whole
Uh there is um It It thanks to me that if um quite frankly, if um we believe that it was illegal, I I um uh City Manager Duca and I would have definitely pulled the plug on it. Uh reading from the solicitor's opinion, he says succinctly, "It is my opinion the proposed legislation can withstand legal challenges so long as the city can establish uh that, regardless of the label being placed on the charges, the fees are proportional to the additional strain the affected entities place on the city infrastructure, i.e., proportionality, and two, there is a reasonable relationship between the charges the city uses uh use of the fees generated by the charges and access." And uh that is uh yeah and that that's why I raised I had those concerns and raised a lot of those questions uh right from the beginning, and uh yeah, and those are questions that that um haven't been fully answered yet, but uh but, my view, we information.
Play from 2:31:16Oct 27, 2026, Council Committee of the Whole
But I'm not with for um just uh putting that spending money for that information. However, in my humble opinion, we need to do it anyway for three reasons. Uh one, we already passed, and it is law now, that we are going to do a study like this because of the data center moratorium. Um so we may as well, while we're doing this, uh make it broader, so we can have a better understanding of everything because once we understand our our cost inputs, uh we can do better for our budgeting uh, you know, in in all levels in all funds. Uh, number two, I I look at it as as uh once we have this information, maybe we can finally get PILOT fairness. If they won't do CAMSA, I'm okay with that. But then let's talk. Uh let's talk other issues. And let let's talk about why are we getting 1/3 uh, less than a third, uh for PILOT when Wilmington gets 100%? Uh why don't we get PILOT on uh on other state-affiliated properties? Uh that I mean, we don't get it at all on that. Um we we have to have a discussion. Um and that discussion is better had with information and data that can't be refuted. Uh so whether we uh I'm not married to any particular proposal, and I'm not opposing any particular proposal. Uh but I but I see the value that this proposal has generated when it comes to getting the information. And that information can be used in a lot of ways that I think will benefit the city. Uh, in the third way, uh when we're doing this, we'll actually have uh certainly more information when it comes to stormwater and stormwater fee infrastructure.
Play from 2:32:28Oct 27, 2026, Council Committee of the Whole
So, what I I mean for instance, uh one way that we can approach this if this is not the way we go would be to have a stormwater infrastructure fee for 50,000 above. Um you know, there uh as well, you know, which the state has already um amended the law to give us the authority to do.
Play from 2:34:52Oct 27, 2026, Council Committee of the Whole
Uh and, you know, so so there's so more There's a lot of different ways that you can can look at things. Um
Play from 2:35:22Oct 27, 2026, Council Committee of the Whole
that that's all can look at things. I think part of the pressure's going to be relieved within the next 2 years because of the current build-outs. For instance, like Garrison, uh which will bring hundreds of millions of dollars of infrastructure in place. Uh we will be getting, most likely within 2 years, uh a net of 8 to within 2 to 3 years, we'll be getting a net of at least $8 to $10 million from just from Garrison, which is going to help out tremendously. It turns around our entire fiscal picture.
Play from 2:35:29Oct 27, 2026, Council Committee of the Whole
And that's been something It doesn't happen overnight. We start before any of us were in council, uh 20 years ago. And then we accelerated, of course, once we came on, um some the members here. Um uh but it is um but anyway, that's Well, um that's that's my view of it, uh and vote your conscience.
Play from 2:36:20Oct 27, 2026, Council Committee of the Whole
Uh all in favor?
Play from 2:36:47Oct 27, 2026, Council Committee of the Whole
All opposed?
Play from 2:36:51Oct 27, 2026, Council Committee of the Whole
Uh had any online?
Play from 2:36:54Oct 27, 2026, Council Committee of the Whole
Uh well, it doesn't matter. Having uh failed to receive six votes, the motion fails.
Play from 2:36:59Oct 27, 2026, Council Committee of the Whole
Uh the uh yes, uh Dr. Sudler?
Play from 2:37:07Oct 27, 2026, Council Committee of the Whole
All right. Thank you. So, we'll found- so, we'll just continue. So, is there- continue as is. Um, is there any other business for the leg- Yep. Dr. Sudler.
Play from 2:37:20Oct 27, 2026, Council Committee of the Whole
I think- I concur.
Play from 2:38:32Oct 27, 2026, Council Committee of the Whole
I think we can, uh, definitely achieve that. We may have a, uh, maybe we'll have a- a special meeting, uh, just dedicated towards this again maybe in December. Um, and just, uh- and- and invite the, uh, invite people pro and con and- and, uh, because that do- one thing even if we don't go this way, there could be, uh- um, if we build, uh, a committee- because we have not been able to achieve on our own, for instance, PILOT fairness.
Play from 2:38:34Oct 27, 2026, Council Committee of the Whole
Maybe, um, maybe, uh, if all of us, if this whole community goes to the General Assembly, uh, united, maybe we can achieve PILOT fairness, then we don't have to have this discussion. Um, that's- but to do that, we need help. Anyway, that's...
Play from 2:38:59Oct 27, 2026, Council Committee of the Whole
Then maybe I want that meeting in November. [laughter]
Play from 2:39:49Oct 27, 2026, Council Committee of the Whole
I- I don't think- I don't think tough questions are criticisms. I think they're- they're either going to make the proposal better, or they're going to give us a better direction. One of the two. And I- I think, uh, I think no one should be hesitant to- to voice concerns, because, um, uh, that's part of, uh, what makes it work. I'd rather hear concerns now than in the courtroom, if something could have been addressed and- and changed or whatever. Anyway, that's- well, if, uh- okay. For real this time, second? Without objection, we stand adjourned, and turn it back over to Council President.

Play from 01:39Oct 26, 2026, Regular Council Meeting
Thank you, um, being that I have a, uh, statement from, uh, People's Community Center in regards to the withdrawal. By signing below, the authorized representative confirms that this withdrawal is made on behalf of PCC and that PCC has no further claim against the city for reimbursement for expenses associated with CDBG allocation. This is not an acknowledgment of anything except the withdrawal of it. That is all. And on behalf of the People's, both for the withdrawal on June 24th, 2026, and I am here by motion to accept, uh, this withdrawal."
Play from 03:19Oct 26, 2026, Regular Council Meeting
In relation to this, uh, quite simply they've waited um 2 years now for the application like anyone else. They, uh, put in bids and uh, quite frankly, one of the they did—it's quite frankly, $40,000 isn't worth uh, the hassle. It's not worth the date because, uh, they have, um, contracts of and they're getting and they'll continue doing this. Not worth it, and then they'll whether the, uh, situation to find valuable for them.
