Request for Waiver - Appendix B - Zoning, Article 5 - Supplementary Regulations, Section 17
- Emergency Access Requirements - Waiver of Emergency Rear Access Requirements - 35 and
39 North New Street (Planning Reference Number SB-18-03)
Mr. David Hugg III, Director of Planning and Community Development, reviewed a Petition to
Waive Zoning Ordinance Provision: Elimination of Emergency Access Requirements for 35 and 39
North New Street.
The Planning Commission recommended approval of the Waiver for the Elimination of the
Emergency Rear Access requirement for a sixteen-foot alley, with the understanding that the
applicant will satisfy the Fire Marshal’s concerns.
Responding to Mr. Neil’s question regarding what would happen if the property owner did not take
protective measures, Mr. Hugg stated that the property owner had committed to the Planning Staff
and Fire Marshal that he would take appropriate fire prevention, and explained that the Fire Marshal
would take action. Mr. Hugg advised that the property owner would most likely install residential
sprinklers, as proposed on the submitted plans.
Mr. Neil noted that he did not see an egress or escape mechanism other than the standard doorway
and asked if there was a back doorway. In response, Mr. Hugg stated that he did not believe that
there was a back doorway. He explained there is no rear access because of the configuration of the
lots and they have several cross-access arrangements to accommodate the parking for the three (3)
townhouses. Mr. Hugg stated that one of the lots is accessible from a City alley, however, there is
not direct access to the back of the units.

OF SEPTEMBER 25, 2018 PAGE 2
Mayor Christiansen stated that he liked the concept of the residential fire sprinkler system and
thought that it might be something that the City would want to heartily encourage in the future. He
indicated that he thought that, based on the configuration of these properties, a residential fire
sprinkler system would be an ideal way to suppress a fire before the Fire Department gets there. In
response, Mr. Hugg stated that this is not something that the City deals with on a regular basis,
however, he thought that there were some properties in the Senator’s Lake development that had the
same limitation and were sprinklered. He stated that this is the recommendation of the Fire Marshal.
Mr. Hare moved to recommend approval of the Planning Commission’s recommendation for
approval of the Waiver for the Elimination of the Emergency Rear Access requirement for a
sixteen-foot alley, with the understanding that the applicant will satisfy the Fire Marshal’s
concerns. The motion was seconded by Mr. Lindell and carried with Mr. Anderson voting no.
Mr. Neil moved for adjournment of the Safety Advisory and Transportation Committee
meeting, seconded by Mr. Hare and unanimously carried.
Meeting adjourned at 6:07 p.m.

Evaluation of Proposals - Underground Utility Locating Services
Mr. James Robinson, Electric Director, reviewed the background and analysis regarding the
evaluation of proposals for Underground Utility Locating Services.
Staff recommended awarding a one (1) year contract with the option for two (2) one (1) year
extensions to W Locco, LLC as per the proposal submitted in response to RFP #19-0004COD.
Mrs. Doyle noted that there was a big difference in the rate proposals and asked if staff knew why
W Locco, LLC’s rates were almost half of what the other company proposed. Responding,
Mr. Robinson stated that he was unable to answer that question because he did not do the evaluation,
it was done by Mr. Jason Lyon, Water/Wastewater Manager. Mr. Robinson noted that he found it
interesting that it was the same differential that occurred last time. Mr. Sudler stated that he thought
that the scope and specifications were similar for both requests and stated that he would also like
additional information regarding the cost differential. Mr. Robinson stated that he was not familiar
with the two (2) entities, however, he would follow up regarding the requested information.
(City Clerk’s Office Note: Subsequent to the Council Committee of the Whole/Utility Committee
meeting of September 25, 2018, Mr. Jason Lyon, Water/Wastewater Manager, advised that the
two (2) firms were fully aware of the scope of work. He explained that W Locco, LLC pays their
