Application involving the Scull Mansion Property
The Planning Office provides the following information:
• Site Development Master Plan Application S-20-10 was filed for Planning Commission
Public Hearing and Review in the Fall of 2020. The project was described as:
S-20-10 Bayhealth Staff Parking Lot Expansion at Scull Property - Review of a
proposed Site Development Master Plan Application to permit construction of 453
new parking spaces over the course of three phases for the Bayhealth Medical
Center Campus. This expands the existing parking from 227 spaces to a total of 680
parking spaces on the Scull Property. Phase 1 proposes 290 parking spaces; Phase
2 proposes 72 new parking spaces and Phase 3 proposes an additional 91 parking
spaces and a connection to S. State Street at the South Street intersection. The Plan
shows the demolition of existing buildings in each phase for a total of seven (7)
buildings demolished including the Scull Mansion to accommodate the increased
volume of parking. The properties measure 11.43 acres +/- and are located on the
east side of S. State Street in the block between South Street and Scull Terrace. The
properties are zoned IO (Institutional and Office Zone) and subject to the SWPOZ

Medical Center, Inc. and KGH Development Corp. The parcels are proposed to be
consolidated before the project begins. Property Addresses: 605 S. State Street,

RE: Bayhealth Medical Center
BAYHEALTH KENT CAMPUS / SCULL PROPERTY
SITE DEVELOPMENT
Dover, Delaware
2019184.07
Dear Dave:
I am writing as a follow-up to our telephone conversation this week concerning
reactivating the review process for the above-referenced site plan on behalf of
Bayhealth Medical Center. We are formally requesting the project be removed from
the “table” and be scheduled for the April 19th, 2021 Planning Commission hearing.
Since we requested to be tabled last year, Bayhealth has held a series of meetings
with both neighbors and stakeholders. Specifically, we have had meetings with
neighbors on Elm Terrace, Holy Cross Church, and a series of three (3) meetings with
the Friends of Old Dover. We have listened to the various groups and have modified
our plans to account for the feedback. Specifically, we are offering the following
revisions:
1. We have removed the demolition of the Scull Mansion from Phase I of our
project. The attached plan shows the modification to the parking area
eliminating thirty-nine (39) total parking spaces to accommodate the building
allowing it to remain.
2. We are willing to donate the building to the Friends of Old Dover to allow
them to renovate, utilize, and relocate the structure. We will assist them in
relocation of the structure and are willing to donate funds to them to facilitate
a move.
3. We agree to keep the structure on site for a period of eighteen (18) months
from the April hearing allowing the Friends of Old Dover time to raise money
and organize a move of this structure, or otherwise develop a resolution
acceptable to Bayhealth. If after the 18 months the structure has not been
relocated or otherwise resolved, we reserve the right to seek demolition.
4. We will develop a landscape plan for the stie that exceeds the city code
requirements and enhances the visual impact on the hospital and State Street.
We have heard comments concerning the need to adequately screen the
7

Item 4.
parking lot and we want the area to be a visually appealing. We will present a
graphic of the plan at the Planning Commission meeting.
5. Our final phases of the master plan will be the demolition of the outpatient
surgery center and the childcare facility located on the eastern side of the
property. Bayhealth will not be removing those two (2) functions from
operation and will relocate each likely on the main campus. We currently
believe that relocation will be at least five (5) years away and could be longer.
We look forward to appearing before the City of Dover Planning Commission in
April. We will make a presentation to them outlining the various public outreach we
have done and the changes to the plan.
Sincerely,
BECKER MORGAN GROUP, INC.

HI-21-03 Referral of Demolition Permit #21-316 at 129 South Governors Avenue
Architectural Review Staff Report for Historic District Commission
April 15, 2021 Meeting
Permit Proposal
Demolition Permit #21-316 at 129 South Bradford Street seeks demolition of a vacant two-story
masonry and frame building. The building was previously utilized as offices and then as
apartments (4 units). The property is zoned C-2 (Central Commercial Zone) and is subject to the
H (Historic District Overlay Zone). The property is located on the east side of South Bradford
Street about mid-way between West Loockerman Street and Reed Street. However, the building
has been vacant for several years and it is was registered as part of the Vacant Building Program
of the City’s Code Enforcement Division (Case #09-00001625). The property has been the
subject of Code Enforcement cases related to building exterior/interior condition and property
condition.
Property Information
The building appears to be of at least early twentieth century construction for the (rear) frame,
hipped roof portion of the building and with a later masonry (brick exterior finish) flat roofed
addition to the front of the building. There is a parking lot at the rear of the property that is
partially surrounded by chain-link fencing.
This building is located within a National Register Historic District, specifically the Victorian
Dover Historic District. Provided below is the building summary from the building inventory
listing found within the National Register nomination completed for the Victorian Dover Historic
District (nomination completed 1977-78).
K0396.146 – 129 S. Bradford Street – Early-20th century, 2-story, frame dwelling; enlarged in 20th
century by 2-story brick section added to façade and converted into business and office space,
hipped roof, hipped roof dormers on frame section, flat roof on brick section, windows
modernized.
The property is located within H (Historic District zone) as established by the City of Dover.
A series of historic maps was reviewed by Planning Staff for preliminary information on this
block of South Bradford Street. The 1868 Beers Map published by Pomeroy & Beers shows the
established street grid and rear alley but no buildings on the east side of the street in the area of
the subject parcel. The 1885 Bird’s Eye View of Dover shows a series of appears to be
residential buildings on this east side of S. Bradford Street and smaller detached structures along
the alley. The series of Sanborn Fire Insurance Maps is also be a reference source for
information on the series of buildings which occupied this property over time. A 1950 Sanborn
Map shows the building form of the 2-story concrete block addition and the rear 2-story main
portion of the building.
PROPOSAL
The applicant has filed a Demolition Permit #21-316. The Permit submission only lists
demolition of the building and information on the Asbestos Evaluation and Abatement. See
attached Permit. The project is described below.
1. Demolition of Building: The project involves the demolition of the existing two-story

Information on the stabilization of the surfaces following removal of the building was not
provided. The rear of the existing property is paved for parking with access from a rear alley.
The future use of the property is not clearly identified in the permit submission.
Planning Staff has attached an Aerial Map of the property and street view photographs for
reference.
Review of DESIGN STANDARDS AND GUIDELINES
The subject property is located in the Dover Historic District Zone within the Loockeman
Historic Context. The Loockerman Historic Context is described on pages 2-7 through 2-8.
Location within the Dover Historic District Zone requires proposals for specific types of
construction activities such as new construction, additions to existing buildings, exterior
renovations, and demolition of buildings to receive an Architectural Review Certificate.
As stated in the Design Standards and Guidelines for the City of Dover Historic District Zone,
an Architectural Review Certificate will be granted for the project “if it is found that the
architectural style, general design, height, bulk and setbacks, arrangement location and materials
affecting the exterior appearance are generally in harmony with neighboring structures and
complementary to the traditional architectural standards of the historic district.”
The proposal for demolition of the building must be reviewed for conformity with the design
criteria guidelines found in Chapter 4: New Construction, Additions, Demolition and Relocation.
Demolition
The Design Standards and Guidelines gives guidance to the Historic District Commission by
listing specific criteria to be evaluated when considering applications for the demolition of
buildings (or portions of buildings) in the historic district. (Chapter 4: pages 4-10 to 4-12)
These guidelines are summarized below (see Design Standards and Guidelines for the complete
text).
1. Determine the financial implications of maintaining a property versus demolition.
2. Regardless of economic issues the relative significance of the individual buildings
slated for demolition should be evaluated.
3. In development related applications the City should review the schematic plans for
the new structures to weigh the virtues of the new structure versus what exists.
4. Determine the extent of adequate recordation of a property the applicant would be
required to complete if demolition were approved.
5. Lots left vacant by demolition should be treated in a manner that is sympathetic to
the historic context.
The Design Standards and Guidelines note that parking should not be permitted on vacant lots
and suggests alternative uses. Also provided is information about development of parking lots
(page 3-27) in the Historic District. The Guidelines recommend appropriate screening and
landscaping with at least 20% of the area unpaved and planted.

Architectural Review Staff Report for Historic District Commission
April 15, 2021 Meeting
STAFF COMMENTS AND RECOMMENDATIONS
The following are the Staff comments and recommendations for this application regarding
project activities and an Architectural Review Certificate.
1) The Design Standards and Guidelines outline specific criteria to be evaluated in considering
demolition applications (page 4-10 and 4-12). The building is registered in the Vacant
Building Program of the Code Enforcement Division and may be the reasoning for
demolition of the Building. However, more specific information may be requested from the
applicant.
a) Staff notes condition of the building is unknown especially after being vacant for a
number of years. The demolition of the Building may be warranted depending on the
building’s condition (structural soundness, rehabilitation needs, etc.)
b) Information on the applicant’s consideration of options for adaptive reuse of the building
discussing suitability or feasibility for rehabilitation was not provided.
c) It is Staff’s observation that the integrity of the original building was somewhat
compromised by the masonry addition in the mid-twentieth century. However, the basic
form of the frame portion of the hipped roof building remains visible to the rear.
2) Staff is not aware of any documentation/recordation of the existing building. The Historic
District Commission could require additional documentation/recordation of the building if
deemed appropriate.
3) Staff recommends consideration of opportunities for adaptive reuse and/or rehabilitation of
the existing building.
4) Staff recommends the following pertaining to the demolition of the building to improve the
project’s compliance with the recommended guidelines for consideration of demolition in the
Design Standards and Guidelines and other code provisions:
a) Clarification of the site stabilization of the building footprint/pad area and site following
demolition of the building including information on the following:
i) Clarification if a building foundation/slab and other paved, hard surface areas will
remain or be removed from the site.
ii) Identify the type of stabilization proposed for the building area (following removal of
foundation, basement, etc.) and other site surfaces.
iii) The location of any proposed landscaping elements such as lawn areas, shrub
plantings, tree plantings, planters, etc.
iv) The location of any proposed fencing. Staff does not recommend installation of solid
(opaque) fencing or chain link fencing on the site. If areas need to be segregated on
the site, other alternative fence styles such as ornamental metal fencing, short posts
with roping, etc. less than four feet in height may be more appropriate.
b) The estimated timeframe for demolition activities and site stabilization activities.
5) Clarification of the future intended use for the property. If a parking area is proposed then
additional plan review and approvals is necessary to address compliance with the Zoning
Ordinance including items such as use of property as a parking lot, paved surface,

appropriate traffic control measures, striping, signage, etc. and for compliance with the
Design Standards and Guidelines for development in the Historic District.
a) In the C-2 zoning district, the use of the property as only a parking lot (principal use as a
parking lot) requires Conditional Use approval as per Zoning Ordinance, Article 3 §13.2.
involving review by the Historic District Commission and Planning Commission.
6) If the property is to remain vacant, then appropriate stabilization and/or beautification
measures may need to be taken to stabilize surfaces, limit access, and to ensure maintenance.
a) There appears to be a grade difference between the rear of property and the South
Bradford Street frontage of the property. Stabilization of exposed soil with grass,
retainment methods, etc. may be necessary.
b) Removal of the chain-link fencing is recommended. Any replacement fencing should be
of materials complying with the Design Standards & Guidelines and is limited to a height
of four (4) feet.
ADVISORY COMMENTS:
1) The applicant shall be aware that a Demolition Permit is required to proceed with any
demolition activities on the property should Architectural Review Certification be granted for
the demolition proposal. The Demolition Permit application must comply with the conditions
of approval granted through the Architectural Review Certification process.
2) In the event, that major changes and revisions to the project proposal occur, contact the
Department of Planning and Inspections. These changes may require resubmittal for review
by the Historic District Commission.
3) Any future construction activities such as redevelopment of the site for a building or for a
parking facility are subject to additional review processes for permitting and plan review.
4) The applicant should be aware of the potential for historic archaeological resources which
may include previous building locations, wells, privies, etc. on this property. The State
Division of Historical & Cultural Affairs can provide technical assistance when dealing with
archaeological resources including previous studies at the subject location.
Historic District Commission Action Required
The Historic District Commission shall consider the Demolition Permit and take action in
regards to the Architectural Review Certification for the demolition proposal. The action should
reflect consideration of the Design Standards and Guidelines.

Project Narrative FFY2019
Addendum to Design Standards & Guidelines for the City of Dover Historic District Zone: Modern
Materials & Technologies
The City of Dover is proposing a preservation planning project to evaluate and update portions of the
Design Standards & Guidelines for the City of Dover Historic District Zone document. The result of
the project will be a Draft Addendum document focusing on modern and technological advancements
in materials and construction activities of items discussed in the Design Standards & Guidelines.
The current Design Standards & Guidelines for the City of Dover Historic District Zone document
was created1 and adopted in 1992-1993 with the formal establishment of the City’s Historic District
Commission (HDC) by ordinance adopted July 26, 1993. The ordinances of the City of Dover allow
for the designation and protection of historic properties. The purpose of Historic District regulations
is:
“to preserve and enhance that unique character and value of the old portion of Dover as an area of
special charm and interest. It is particularly intended that the regulations prevent, in the historic district,
any change of conditions that would be deemed to be a disfigurement or degradation of the present
unique visual and architectural qualities of the district.” (Zoning Ordinance, Article 3, Section 21)
The geographic boundaries of the Historic District (H) zone are established as a zoning
classification. The original boundaries of the Historic District established in 1961 were generally
described as extending from just north of Division Street south to South Street inclusive of the
properties fronting on South State Street and The Green then east to the St. Jones River. In 1997, the
boundaries of the Historic District Zone were expanded to include properties fronting on West
Loockerman Street from Bradford Street to the railroad corridor and areas in the vicinity of South
Governors Avenue, South Bradford Street, North Street, and Bank Lane. The areas of expansion
included many commercial and residential properties listed in the National Register of Historic
Places as part of the Victorian Dover Historic District. See attached Map of City of Dover Historic
District showing the current boundaries (shaded in orange).
As a preservation and redevelopment tool, the Design Standards and Guidelines provide guidance
for property owners, design professionals, staff and the Historic District Commission (and Planning
Commission). The “historic district design guidelines and standards” are defined by the Zoning
Ordinance as follows:
“Historic district design guidelines and standards: The document adopted by the City of Dover
Planning Commission as being the source reference document for construction and maintenance of
buildings, structures, and additions with the Dover Historic District and which is the guiding document
for the historic district commission and city planner in their review of applications for architectural
review certification.”
Therefore, it is utilized as a guiding document in the decision making process of reviewing of
construction activities in the Historic District zone for issuance of Architectural Review
Certification (Zoning Ordinance, Article 10 Section 3). Applications for Architectural Review
Certification are reviewed by the City Planner (Staff), the Historic District Commission, and
Planning Commission. See the following code excerpt regarding the architectural review standards.
1
The current document Design Standards and Guidelines for the City of Dover Historic District Zone was prepared in
1992 by John Milner Associates Inc. with funding by a grant from the National Park Service, U.S. Department of the
Interior and administered by the State Historic Preservation Office. City Planning Staff, the State Historic Preservation
Office, the Friends of Old Dover, Main Street Dover, and other interested parties participated in the development of
the document. 30

Item 6.
Zoning Ordinance, Article 10 Section 3.25 Architectural review standards.
(A) An architectural review certificate may be issued if it is found that the architectural style,
general design, height, bulk and setbacks, arrangement, location and materials and
structures affecting the exterior appearance are generally in harmony with neighboring
structures and complementary to the traditional architectural standards of the historic
district as set forth in the historic district design guidelines and standards adopted by the
planning commission and as set forth in the United States Secretary of the Interior's
Standards for Rehabilitation.
(B) The city planner, historic district commission or planning commission shall not consider
normal maintenance and repair (see definitions, article 12), interior arrangement, or
building features not subject to public view.
The Zoning Ordinance references the Design Standards & Guidelines when establishing the
Architectural Review Certification process for the City of Dover’s Historic District zone (H). An
Architectural Review Certificate is required for a demolition, erection, reconstruction, alternation,
restoration or exterior repairs on properties within the Historic District. Most projects within the
Historic District are eligible for administrative review of the Architectural Review Certificate as
part of the Building Permit process for such projects as signs, roof and door or window
replacement, and exterior finish/siding/trim work renovations. Project activities only involving
interior renovations are not subject to the Architectural Review Certification process. For example,
in calendar year 2018, a total of forty-seven (47) applications (permit activity in the Historic
District) were reviewed under this process with 38 Permits requiring Architectural Review
Certification and 9 Permits not requiring Architectural Review Certification. 2
Historic Preservation Planning is part of a comprehensive approach to land use planning in the City
of Dover. In Dover’s current plan, the 2008 Comprehensive Plan (as amended) this information is
presented in Chapter 6 - Historic Preservation and associated Map 6-1. The 2008 Comprehensive
Plan includes sets forth goals and a series of recommendations for each goal. The Historic
Preservation Goals are as follows:
Goal 1: Preserve and Protect Historic Resources
Historic Goal 2: Provide and Promote Incentives for Preservation Activities
Preservation Goal 3: Increase Public Information on Historic Resources
Goal 4: Collaborate with Diverse Groups and Governments
2008 Comprehensive Plan, excerpt from Table 1-1: Plan Chapter Goals
To achieve Goal 1, one of the adopted Recommendations was the Evaluation of Design Standards
and Guidelines since the original document was adopted in the early 90s. The recommendation also
suggested consideration of the standards and guidelines for the levels of protection for The Green
and the Loockerman Street areas.
For this project for an Addendum to the Design Standards & Guidelines, the City of Dover will
seek to hire a consultant through a Request for Professional Services process to assist the Historic
District Commission and Planning Staff with the project. The consultant will be required to have a
Principal Investigator (PI) who meets the professional qualification standards in 36 CFR 61. Also
involved in the project, the Historic District Commission consists of five (5) appointed members
and the Planning Commission3 consists of nine (9) appointed members. The Planning Staff serves
as staff support to the Historic District Commission and will manage the activities of this project.

The volume of Permit Activity in the Historic District over the past five years has averaged 52 applications a year with
a majority of them eligible for Architectural Review Certification review by Staff.
3
The Planning Commission, per the Zoning Ordinance, Article 10 Section 3.25(A), is involved in the formal adoption
process for the Historic District guidelines. 31

Item 6.
With the project, we hope to create an Addendum to the Design Standards & Guidelines that
focuses on the modern and technological advancements in materials and construction activities. In
recent years, the use and role of alternative and composite materials in construction has increased
with options for wood composites, PVC/vinyl products, and others. In addition, features like solar
panels and other conservation related measures have become more common place. This Addendum
will focus on these types of materials and items as associated with the practices for maintenance,
preservation and construction activities within the Historic District. Components of the Addendum
document will continue to provide guidelines for treatment of historic properties and features
focusing on maintenance, repair, alternations, and preservation or restoration of existing buildings;
guidelines for new construction activities (additions and new buildings), guidelines for demolition
activities; guidelines for landscaping and site elements, and guidelines for signage. The document is
to be consistent with the Secretary of Interior Standards for Treatment of Historic Properties
(Rehabilitation Standards and Guidelines).
The project will consist of a series of phases: Planning, Public Outreach, Guidelines Revision and
Refinement, and Preparation of Draft Addendum Document. The following chart outlines the
