SPECIAL COUNCIL MEETING - ES ACTION (PUBLIC) - Extension of Benefits & Land Acquisition

SPECIAL COUNCIL MEETING A Special Council Meeting was held on September 26, 2016 at 6:01 p.m. with Council President Slavin presiding. Members present were Mr. Anderson (arrived at 6:03 p.m.), Mr. Cole, Mr. Hare, Mr. Hosfelt, Mr. Hutchison, and Mr. Neil. Mr. Lewis and Mr. Sudler were absent. Mayor Christiansen was also present. Council staff members present were Mr. Koenig (departed at 6:31 p.m.), Mrs. Mitchell (departed at 6:31 p.m.), and Mrs. McDowell (departed at 6:31 p.m. and returned at 6:36 p.m.). Other staff members present were Chief Bernat (departed at 6:31 p.m.) and Mr. Hudson (departed at 6:31 p.m.). ADOPTION OF AGENDA Mr. Neil moved for approval of the agenda, seconded by Mr. Hutchison and unanimously carried. Mr. Hare moved to recess into Executive Session pursuant to 29 Del. C. §10004 (b)(6) - Discussion of the content of documents, excluded from the definition of "public record" in §10002 of this title where such discussion may disclose the contents of such documents (§10002 (l)(1) Any personnel, medical or pupil file, the disclosure of which would constitute an invasion of personal privacy, under this legislation or under any State or federal law as it relates to personal privacy) and §10004(b)(2) - Preliminary Discussions on Site Acquisitions for Any Publicly Funded Capital Improvements, or Sales or Leases of Real Property). The motion was seconded by Mr. Hosfelt and unanimously carried. The Special Council Meeting recessed into Executive Session at 6:02 p.m. Mr. Anderson moved to adjourn the Executive Session, seconded by Mr. Hosfelt and unanimously carried. Executive Session adjourned at 6:38 p.m. ACTION RESULTING FROM THE EXECUTIVE SESSION Request for Approval of Extension of Pay Benefits During the Executive Session, members of Council considered a request for approval of an extension of 100% pay for Corporal Thomas Hannon, in accordance with Section 12, On-the-Job Injury, of the Fraternal Order of Police (FOP) contract. Mr. Cole moved that on or before November 1, 2016 Corporal Thomas Hannon will return to light duty and a Special Council meeting will be held on October 24, 2016 to review the status. The motion was seconded by Mr. Hosfelt and unanimously carried. Potential Land Acquisition During the Executive Session, Mr. Scott Koenig, City Manager, advised members of the potential purchase of two (2) parcels of land.

SPECIAL COUNCIL MEETING OF SEPTEMBER 26, 2016 PAGE 2 Mr. Hutchison moved to authorize the City Manager to proceed with negotiations on those parcels mentioned as the first set of properties discussed with the figures the City Manager had used. The motion was seconded by Mr. Neil and unanimously carried. Mr. Cole moved to adjourn the Special Council Meeting, seconded by Mr. Hare and unanimously carried.
