CONSTRUCTION AND PROPERTY MAINTENANCE
CODE BOARD OF APPEALS
The Construction and Property Maintenance Code Board of Appeals meeting was held on
June 19, 2019 at 4:03 p.m. with Chairman Anderson presiding. Members present were Mr. Neil and
Mr. Martin.
ADOPTION OF AGENDA
Mr. Neil moved for approval of the agenda, seconded by Mr. Martin and unanimously carried.
Property Maintenance Code Citation (Chapter 22 - Buildings and Building Regulations,
Article XII - Vacant Buildings, Section 22-403 - Registration and Registration Fee) - Appeal
of Decision and Registration Fee - 40 Ridgely Street (Robert A. & Nancy H. Kauffman)
Mr. Ron Coburn, Code Official, reviewed the case history for 40 Ridgely Street.
Mr. Phillip McGinnis, McGinnis Commercial Real Estate Company, advised that he would represent
Mr. Robert A. and Nancy H. Kauffman for the appeal. Responding to Mr. Coburn’s review of the
case history, Mr. McGinnis stated that the property was not occupied because of current code
violations. Mr. Greg Akers, Chief Building Inspector, noted that the code violations needed to be
addressed prior to occupancy and that no permits had been obtained for the property.
Mr. Neil moved to uphold the decision of the Building Inspector to declare this property in its
seventh year of vacancy, but to apply the registration fee for buildings vacant for more than
one (1) year but less than two (2) years. The motion was seconded by Mr. Martin and
unanimously carried.
Property Maintenance Code Citation (Chapter 22 - Buildings and Building Regulations,
Article XII - Vacant Buildings, Section 22-403 - Registration and Registration Fee) - Appeal
of Decision and Registration Fee - 848 Horsepond Road (Robert H. Tudor II)
Mr. Ron Coburn, Code Official, reviewed the case history for 848 Horsepond Road.
Mr. Robert H. Tudor II stated that the property is vacant and that he was unaware that the Code
stated that a vacant building is a building, structure, or dwelling that has been unoccupied for
more than three (3) consecutive months. Mr. Tudor noted that he purchased the property three (3)
months ago and the Code does not allow enough time for new buyers to make the appropriate
improvements for occupancy.
Mr. Coburn confirmed that Mr. Tudor purchased the property three (3) months ago.
Mr. Anderson advised that the board must abide by the Code; however, Mr. Tudor’s concerns
would be taken into consideration for future changes to the Code.
Mr. Martin moved to uphold the decision of the Building Inspector to declare this property
in its first year of vacancy and to apply the registration fee for buildings vacant for one (1)
year or less. The motion was seconded by Mr. Neil and unanimously carried.
Mr. Martin moved for adjournment, seconded by Mr. Neil and unanimously carried.
