SPECIAL COUNCIL MEETING - ES ACTION (PUBLIC) - Pending Litigation

SPECIAL COUNCIL MEETING A Special Council Meeting was held on September 23, 2019 at 6:01 p.m. with Council President Hare presiding. Members present were Mr. Anderson (arrived at 6:04 p.m.), Mr. Sudler, Mr. Neil, Mr. Cole, Mr. Polce, Mr. Taylor, and Mr. Lindell. Mr. Slavin was absent. Mayor Christiansen was also present. Council staff members present were Mrs. Mitchell and Mrs. McDowell. Other staff members present were Mr. Harline, Assistant City Manager. ADOPTION OF AGENDA Mr. Neil moved for adoption of the agenda, seconded by Mr. Sudler and unanimously carried. Mr. Sudler moved to recess into Executive Session pursuant to 29 Del. C. §10004(b)(4) - Strategy sessions, including those involving legal advice or opinion from an attorney-at-law, with respect to collective bargaining or pending or potential litigation, but only when an open meeting would have an adverse effect on the bargaining or litigation position of the public body. The motion was seconded by Mr. Neil and unanimously carried. The Special Council Meeting recessed into Executive Session at 6:02 p.m. The Executive Session adjourned at 6:16 p.m. ACTION RESULTING FROM THE EXECUTIVE SESSION Pending Litigation During the executive session, Mrs. Donna Mitchell, City Manager, provided an update on the lawsuit against the pharmaceutical companies. Mr. Polce moved that the City of Dover continue on its own individual lawsuit against the numerous pharmaceutical companies that were named in its initial affidavit and reject the opportunity to join a global settlement with the State. The motion was seconded by Mr. Lindell and unanimously carried. Mr. Neil moved for adjournment, seconded by Mr. Polce and unanimously carried.
