COMMITTEE ACTION FORM
PROCEEDING: Council Committee of the Whole - Utility Committee
DEPARTMENT OF ORIGIN: Electric DATE SUBMITTED: February 1, 2021
PREPARED BY: Paul Waddell, Electric Director
SUBJECT: Evaluation of Bids - Directional Boring Contract
REFERENCE: N/A
RELATED PROJECT: N/A
REVIEWED BY: Matthew Harline, Interim City Manager / Lori Peddicord, Controller
EXHIBITS: Exhibit A – Draft Contract for Directional Boring
EXPENDITURE REQUIRED: As required AMOUNT BUDGETED: N/A
FUNDING SOURCE (Dept./Page in CIP & Budget): Funding will be embedded in Capital Improvement Projects
proposed that will require directional boring and be allocated on a time and material basis only.
TIMETABLE: Award upon Council Approval
RECOMMENDED ACTION: Staff recommends awarding #21-0016EL Directional Boring Contract to Joseph R. Smith
Inc. for three years with a City option to extend it an additional two years (five years total) as per the pricing included in
the bid submittal.
BACKGROUND AND ANALYSIS
The Electric Department maintains contracts with several entities to perform specialized work outside the City’s capabilities.
This contract will be awarded on a time and material basis and the City will only pay for services rendered by the contractor.
The scope of the contract will be for directional boring work that will include underground installation of conduit to protect
primary and secondary cable which provides service to all customer classifications. This method reduces all of the problems
created by opening a trench and reduces the need to restore customer property and right of way and allows for minimized
impact for electrical road crossings.
The average expenditure under the previous contract was approximately $274,231 per year for work done in mostly capital
projects. These projects are estimated and submitted in the annual budget to include the expenses for directional boring.
The Request for Proposal was solicited and advertised per the City Purchasing Policy by the Procurement Manager, posted
on the City website and directly sent out to six contractors. Intent to Bid forms were returned by three contractors however
only one contractor submitted a bid package. Joseph R. Smith was the only bidder to submit a complete bid package and
this is why there is no bid evaluation tab. Joseph R. Smith was awarded the contract in 2016 and has performed the duties
outline in the contract well.
Joseph R. Smith proposed rates for boring by the foot based on the size and number of the conduits being installed. The
quoted rates are an increase over the rates proposed in 2016, the last year the contract was bid out. Applying the 2021
proposed rates to an actual job performed in October, the cost would increase from $11,808 to $16,184. The main cause
of the increase is the per foot boring price. The prices per foot quoted in this proposal are equivalent to the prices
submitted by other contractors in 2016.

given to the CONTRACTOR by the CITY no later than ten (10) calendar days after written
notice of the action, suit or proceeding was received by the CITY.
b. Failure to timely give the required notice will not relieve the CONTRACTOR from its

claim which the CITY may recommend which releases the CITY completely from such
claim.

construed, to be a waiver for any purpose by either entity of any applicable State limits
on municipal liability.

fixtures, materials, or other equipment, all of which are hereby disclaimed. The CITY
makes no other express or implied warranties, except to the extent expressly set forth in

DEPARTMENT OF ORIGIN: Electric DATE SUBMITTED: February 1, 2021
PREPARED BY: Paul Waddell, Electric Director
SUBJECT: Evaluation of Bids – Master Electrician Contract
REFERENCE: N/A
RELATED PROJECT: N/A
REVIEWED BY: Matthew Harline, Interim City Manager / Lori Peddicord, Controller
EXHIBITS: Exhibit A – Draft Contract for Master Electrician Services
EXPENDITURE REQUIRED: As required AMOUNT BUDGETED: N/A
FUNDING SOURCE (Dept./Page in CIP & Budget): Funding will be from applicable Contractual Services budgets.
TIMETABLE: Award upon Council Approval
RECOMMENDED ACTION: Staff recommends awarding #21-0017EL Master Electrician Contract to All State
Electrical Services for three years with a City option to extend it an additional two years (five years total) as per the pricing
included in the bid submittal.
BACKGROUND AND ANALYSIS
The Electric Department maintains contracts with several entities to perform specialized work outside the City’s capabilities.
This contract will be awarded on a time and material basis and the City will only pay for services rendered by the contractor.
This award would be for any Master Electrician work that cannot be performed by City employees. This would include
work done inside residences and businesses beyond the meter pans, panel upgrades, overhead to underground conversions
and work related to improvements inside City facilities. Expenditures have averaged approximately $8,671 per year for
the last 5 fiscal years and the current fiscal year.
The Request for Proposal was solicited and advertised per the City Purchasing Policy by the Procurement Manager,
posted on the City website and sent directly out to six contractors the City knew were capable of the work proposed. The
documents were sent to six potential contractors and the City received a complete bid package from only one contractor.
All State Electrical Services was the only bidder to submit a bid package and this is why there are no bid evaluation tabs.
The staff recommends awarding the contract to All State Electrical Services for the term of three years with the option to
extend for two (2) one (1) year extensions.
Proposed quote for labor and material to convert a 100/200 amp service panel from overhead to underground feed was
$279.00 for the first year with a 2% rate increase per year. This price is approximately 35% cheaper than the expired
contract with the previous contractor.

RECOMMENDED ACTION: Staff recommends awarding the #21-0019EL Underground Linework Contract to Joseph
R. Smith Inc. for three years with a City option to extend it an additional two years (five years total) as per the pricing
included in the bid submittal.
BACKGROUND AND ANALYSIS
The Electric Department maintains contracts with several entities to perform specialized work outside the City’s capabilities.
This contract will be awarded on a time and material basis and the City will only pay for services rendered by the contractor.
The scope of the contract will be for assistance in the performance of underground linework outside the normal capabilities
of City staff, for example, large extension projects or assistance during storm recovery.
Since the last contract was signed, there have been no expenses related to underground linework being performed by the
contractor.
The Request for Proposal was solicited and advertised per the City Purchasing Policy by the Procurement Manager, posted
on the City website and sent directly to eight contractors of whom the City was aware could perform the duties and the City
received complete bid packages from two contractors. Upon evaluation of the two bids, the staff recommends award of the
contract to Joseph R. Smith for the period of three years with the option to extend two additional one year periods.

DEPARTMENT OF PLANNING AND INSPECTIONS
ACTION FORM
MEETING City Council Committee of the Whole: MEETING DATE: February 9, 2021
TYPE: Legislative, Finance, and Administration
Committee
SUBJECT: Update on Comprehensive Rezoning 2021 Project
AGENDA Update on the implementation of the 2019 Comprehensive Plan by proceeding with
DESCRIPTION: the Comprehensive Rezoning.
PROCEEDING: Informational Item from Planning Office
FUTURE MEETING Planning Commission Public Hearing: TBD
SCHEDULE: City Council Public Hearing: TBD
BACKGROUND AND ANALYSIS:
City Council adopted the 2019 Comprehensive Plan on January 13, 2020. Under State law the City is
required to review and ensure that the Land Development Plan of the Comprehensive Plan and the
City’s Official Zoning Map are in alignment. This project is known as the Comprehensive Rezoning
2021 Project. This evaluation is to be completed within eighteen months of the Comprehensive Plan’s
adoption/certification; for the City of Dover this is to be complete by June 2021.
Part of this project is to go through a parcel-by-parcel evaluation and make sure that the Zoning Map
and Land Development Plan Map match up. To do this Staff used GIS technology to compare the two
maps. The Land Development Plan Map (Map 12-1 in the Comprehensive Plan) has broader general
land use categories for all properties within the City. See attachment Map 12-1 as adopted. There is a
Matrix within Chapter 12: Land Development Plan of the 2019 Comprehensive Plan presented as Table
12-1: Land Use and Zoning Matrix that includes the zoning districts that are appropriate within those
larger land use categories. See attachment for Table 12-1 as adopted. Using GIS, the Planning Staff put
the Zoning layer and Land Development Plan layer together to determine where there were
inconsistencies. After the initial analysis Staff sifted through results to determine which parcels should
be corrected by correcting the land use on the Comprehensive Plan’s Land Development Plan Map;
where there may have been an error with the Plan text or something overlooked in the Land Use and
Zoning Matrix; or where the correction should be addressed through rezoning.
Our preliminary findings have resulted in over 160 parcels identified for rezoning. Of these identified
parcels, around 100 parcels are proposed to be rezoned to ROS (Recreation and Open Space Zone). The
reason for this high number of parcels needing to be rezoned to ROS (Recreation and Open Space Zone)
is that as residential subdivisions have moved to completion all designated open space within the
33
Page 34
Item 4.
subdivision is to be taken to the ROS zone to further protect it from further development. These areas
were identified as having an Open Space, Conservation and Recreation Land Use when the Land
Development Plan was created and now the zoning must be changed to match the Land Use Category.
Other parcels that may have been identified for rezoning are parcels that have uses that are not
compatible with the current zoning or may have had to get Conditional Use approval in the past, but
after the rezoning could be a permitted use. Another common scenario was parcels that were split zoned,
or single parcels that straddle two or more zoning districts. In these cases, one zoning type may have
been suitable for the Land Use Category, but the other was not. We have decided to take these parcels
through the rezoning process to streamline the zoning for some parcels with split zoning so that the
zoning across the parcel would be compatible with the land use.
The next step in the Comprehensive Rezoning 2021 Project is to reach out to property owners whose
properties have been identified for rezoning. Staff will be mailing letters to all property owners with
information about the Comprehensive Rezoning process and giving them an opportunity to learn more
from Staff. The Planning Office is working to develop an Informational Session to be held virtually at
three different time slots on February 23, 2021 and other outreach activities. After the outreach to
property owners, we will begin the preparation for the formal review process for consideration of the
Comprehensive Rezoning 2021. The formal review process will involve public notice tasks, preparation
of the Comprehensive Rezoning package (lists and maps identifying parcels), and scheduling of Public
Hearings with the Planning Commission and City Council in order to accept or deny the proposed
rezoning of parcels identified. After a decision has been made by City Council, the City’s Zoning Map
will be edited to reflect the parcels that have been rezoned.
As a companion piece to the Comprehensive Rezoning 2021 Project, Staff also anticipates bringing
forward series of Amendments to the 2019 Comprehensive Plan. These Amendments will address Plan
text changes and revisions to Land Use Category designated on the Map 12-1: Land Development Plan
discovered during this parcel-by-parcel analysis and/or Comprehensive Rezoning process.
The following Summary is a listing of a general Timeline of Events for the Comprehensive Rezoning
2021 Project:
• August 2020 – Staff began the initial GIS analysis to identify discrepancies between the Land
Development Plan Map and the Zoning Map.
• September to December 2020 – Staff met on several occasions to identify areas that were missed
by the initial GIS analysis and ground truth other parcels that were identified for rezoning.
• January 2021 – Staff has finalized the list of properties to 162 parcels identified for rezoning in
order to match the Land Development Plan as adopted as part of the 2019 Comprehensive Plan.
• February 2021 – Public Outreach Activities: Letters will be drafted and mailed to identified
property owners and a Virtual Information Session will be held to answer questions about the
rezoning process.
• February 23, 2021 – Virtual Information Sessions tentatively scheduled.
• February - June 2021– Preparation for Formal Review & Public Hearing Process with Planning
Commission and City Council.
