SPECIAL COUNCIL MEETING
A Special Council Meeting was held on May 28, 2013 at 8:44 p.m. with Council President Bonar
presiding. Members present were Mr. Dixon, Mr. Lynn, Mr. Perza, Mr. Slavin, Mrs. Williams,
Mr. Hare, and Mr. Hutchison. Mr. Anderson was absent.
Council staff members present were Mr. Koenig, Chief Hosfelt, Mr. Rodriguez, and Mrs. McDowell.
Mayor Carey was also present.
AGENDA ADDITIONS/DELETIONS
By unanimous consent, the agenda was approved as presented.
Mrs. Williams moved to recess into Executive Session pursuant to 29 Del. C. §10004(b)(4) to
discuss legal matters, seconded by Mr. Hare and unanimously carried.
Meeting recessed at 8:44 p.m.
Mr. Hare moved to adjourn the Executive Session, seconded by Mr. Dixon and unanimously
carried.
Executive Session adjourned at 8:51 p.m.
PENDING LITIGATION - JUSTICE V. CITY OF DOVER
During the Executive Session, City Solicitor Nicholas Rodriguez provided an update on the
Justice v. City of Dover suit.
Mr. Hare moved to direct staff to prepare a Code amendment that would remove the
requirement for offenders residing or employed within 500 feet of a day care center at the time
of adoption of Ordinance #2012-08 (April 9, 2012) to move or resign their employment. The
motion was seconded by Mrs. Williams and carried by a roll call vote of six (6) yes (Dixon,
Slavin, Williams, Hare, Hutchison, and Bonar), two (2) no (Lynn and Perza), and one (1)
absent (Anderson).
By motion of Mr. Hare, seconded by Mr. Hutchison, the Special Council Meeting adjourned
at 8:54 p.m.
