HI-21-05 Referral of Demolition Permit #21-1036 for 401 S. Governors Avenue
Architectural Review Staff Report for Historic District Commission
August 19, 2021 Meeting
Permit Proposal
Demolition Permit #21-1036 at 401 S. Governors Avenue Street seeks demolition of a vacant
one-story commercial building. The building was previously utilized for various retail
establishments and personal service establishments. The property is zoned IO (Institutional and
Office Zone) and subject to the H (Historic District Zone) and SWPOZ (Source Water Protection
Overlay Zone). The property is located on the southeast corner of South Governors Avenue and
Bank Lane.
Property Information
The one-story, flat roofed commercial building appears to be of twentieth century construction
with a later exterior finish changes to the building including vinyl siding and a metal clad pent
roof on the west and north elevations. There is a paved parking area at the front of the building
(west side) and a smaller paved area on the building’s north side along Bank Lane. To the south
is a concrete pad area and then some lawn areas wrapping the shed roofed addition on the south
and east sides of the building.
This building is located within a National Register Historic District, specifically the Dover Green
Historic District; however, it is identified as a non-contributing resource. Provided below is the
building summary from the building inventory listing found within the National Register
nomination completed for the Dover Green Historic District (nomination completed 1976 revised
1984).
K0394.64 – 401 S. Governors Avenue – 1929-50; concrete block, 1-story, 3-bay. This commercial
structure (originally built as a filling station) has a flat roof with wide wood shingled, pent eaves. It
is covered in cream colored vinyl siding. (NC)
The property is located within H (Historic District zone) as established by the City of Dover.
A series of historic maps was reviewed by Planning Staff for preliminary information on this
block of South Governors Avenue. The 1868 Beers Map published by Pomeroy & Beers and the
1887 W.B. Roe Map show the established street grid for the area but no buildings on the east
side of Governors Avenue at the subject site. The location appears to have been part of the
parcel where the Farmer’s Bank building stands facing The Green (30 The Green). The series of
Sanborn Fire Insurance Maps could also be a reference source for information on the series of
buildings which occupied this property over time.
PROPOSAL
The applicant has filed a Demolition Permit #21-1036. The Permit submission lists demolition of
the building and the impervious surfaces including the various foundations and asphalt paving
areas. It notes that the site will be temporarily stabilized. An Asbestos Evaluation and Abatement
Report is also required to be submitted as part of the Building Code review process for the
Permit. See attached Permit, photographs, Location Map and Site Plan. The project is described
below.
1. Demolition of Building: The project involves the demolition of the existing one-story
building on the property.
2. Demolition/Removal of Impervious Surfaces: The project involves the demolition and
removal of the impervious surfaces (concrete foundations & paving, asphalt paving) and

disconnection of utilities. It is noted that the property will be bulk graded and temporarily
stabilized.
Information on the stabilization of the surfaces following removal of the building and surfaces
was not provided. The future use of the property is not specifically identified in the permit
submission; however, Planning Staff is aware that the property is involved in the development
area for the proposed Kent County Family Court Building Project by the State of Delaware.
Review of DESIGN STANDARDS AND GUIDELINES
The subject property is located in the Dover Historic District Zone within The Green Historic
Context. The Green Historic Context is described on pages 2-3 through 2-5. Location within the
Dover Historic District Zone requires proposals for specific types of construction activities such
as new construction, additions to existing buildings, exterior renovations, and demolition of
buildings to receive an Architectural Review Certificate.
As stated in the Design Standards and Guidelines for the City of Dover Historic District Zone,
an Architectural Review Certificate will be granted for the project “if it is found that the
architectural style, general design, height, bulk and setbacks, arrangement location and materials
affecting the exterior appearance are generally in harmony with neighboring structures and
complementary to the traditional architectural standards of the historic district.”
The proposal for demolition of the building must be reviewed for conformity with the design
criteria guidelines found in Chapter 4: New Construction, Additions, Demolition and Relocation.
Demolition
The Design Standards and Guidelines gives guidance to the Historic District Commission by
listing specific criteria to be evaluated when considering applications for the demolition of
buildings (or portions of buildings) in the historic district. (Chapter 4: pages 4-10 to 4-12)
These guidelines are summarized below (see Design Standards and Guidelines for the complete
text).
1. Determine the financial implications of maintaining a property versus demolition.
2. Regardless of economic issues the relative significance of the individual buildings
slated for demolition should be evaluated.
3. In development related applications the City should review the schematic plans for
the new structures to weigh the virtues of the new structure versus what exists.
4. Determine the extent of adequate recordation of a property the applicant would be
required to complete if demolition were approved.
5. Lots left vacant by demolition should be treated in a manner that is sympathetic to
the historic context.
The Design Standards and Guidelines note that parking should not be permitted on vacant lots
and suggests alternative uses. Any future development of the property will be subject to the
provisions of the Zoning Ordinance and the Design Standards & Guidelines.

HI-21-05 Referral of Demolition Permit #21-1036 for 401 S. Governors Avenue
Architectural Review Staff Report for Historic District Commission
August 19, 2021 Meeting
STAFF COMMENTS AND RECOMMENDATIONS
The following are the Staff comments and recommendations for this application regarding
project activities and an Architectural Review Certificate.
1) The Design Standards and Guidelines outline specific criteria to be evaluated in considering
demolition applications (page 4-10 and 4-12). Demolition of this building is related to a
future redevelopment project for the portion of the block fronting South Governors Avenue
and Water Street. However, more specific information may be requested from the applicant.
a) Staff notes condition of the building is unknown as it up until recent months has been
occupied by various commercial uses. The demolition of the Building may be warranted
depending on the building’s condition (structural soundness, rehabilitation needs, etc.)
b) It is Staff’s observation that the integrity of the original building was somewhat
compromised by additions, reconfigured roof, and newer exterior finishes.
2) Staff is not aware of any documentation/recordation of the existing building. The Historic
District Commission could require additional documentation/recordation of the building if
deemed appropriate.
3) Staff recommends the following pertaining to the demolition of the building to improve the
project’s compliance with the recommended guidelines for consideration of demolition in the
Design Standards and Guidelines and other code provisions:
a) Clarification of the site stabilization of the building footprint/pad area and site following
demolition of the building and impervious surfaces including information on the
following:
i) Identify the type of stabilization proposed for the building area (following removal of
foundations, basement, etc.) and other site surfaces.
b) The estimated timeframe for demolition activities and site stabilization activities.
4) If the property is to remain vacant, then appropriate stabilization and/or beautification
measures may need to be taken to stabilize surfaces, limit access, and to ensure maintenance
until the property is involved in future construction activities.
a) Stabilization of exposed soil with grass, retainment methods, etc. is required.
b) Identify any site elements to be temporarily placed such as fencing or landscaping. Staff
does not recommend installation of solid (opaque) fencing or chain link fencing on the
site unless it is part of active construction activities. If areas need to be
segregated/blocked off on the site, implementation other alternative fence styles such as
ornamental metal fencing, short posts with roping, etc. less than four feet in height may
be more appropriate.
5) This Architectural Review Certification review process is specific to the Demolition Permit
only and does not grant approval for redevelopment of the site. For future redevelopment of
the property, additional plan review and approvals is necessary to address compliance with
the Zoning Ordinance and for compliance with the Design Standards and Guidelines for
development in the Historic District.

August 19, 2021 Meeting
ADVISORY COMMENTS:
1) The applicant shall be aware that a Demolition Permit is required to proceed with any
demolition activities on the property should Architectural Review Certification be granted for
the demolition proposal. The Demolition Permit application must comply with the conditions
of approval granted through the Architectural Review Certification process.
2) In the event, that major changes and revisions to the project proposal occur, contact the
Department of Planning and Inspections. These changes may require resubmittal for review
by the Historic District Commission.
3) Any future construction activities such as redevelopment of the site for a building or for a
parking facility are subject to additional review processes for permitting and plan review.
4) The applicant should be aware of the potential for historic archaeological resources which
may include previous building locations, wells, privies, etc. on this property. The State
Division of Historical & Cultural Affairs can provide technical assistance when dealing with
archaeological resources including previous studies at the subject location.
Historic District Commission Action Required
The Historic District Commission shall consider the Demolition Permit and take action in
regards to the Architectural Review Certification for the demolition proposal. The action should
reflect consideration of the Design Standards and Guidelines.

Dear Applicants:
This letter is to inform you that Demolition Permit Application #21-1036 has been referred
to the City of Dover Historic District Commission for consultation. Demolition Permit #21-
1036 was filed on August 6, 2021 for demolition of the existing building at 401 S. Governors
Avenue in Dover, Delaware. The Permit submission lists demolition of the building and
impervious surfaces.
The location of the subject property within the City of Dover’s Historic District zone requires the
review and issuance of an Architectural Review Certificate (ARC) for construction and
demolition activities (Zoning Ordinance, Article 3 §21.3). Minor demolitions are eligible for
Staff review of the ARC during the Demolition/Building Permit application process. Project
activities are reviewed for compliance with the Zoning Ordinance and the Design Standards and
Guidelines for the City of Dover Historic District Zone as stated in Zoning Ordinance, Article 10
Section 3.25(A).
3.25 Architectural review standards.
(A) An architectural review certificate may be issued if it is found that the architectural
style, general design, height, bulk and setbacks, arrangement, location and materials
and structures affecting the exterior appearance are generally in harmony with
neighboring structures and complementary to the traditional architectural standards of
the historic district as set forth in the historic district design guidelines and standards
adopted by the planning commission and as set forth in the United States Secretary of
the Interior's Standards for Rehabilitation.
In reviewing the proposed project for Architectural Review Certification, Staff referenced the
Chapter 4: New Construction, Additions, Demolition and Relocation of the Design Standards
and Guidelines which present the Recommended, Not Recommended, and Inappropriate
approaches to activities in the Historic District. For Demolition activities, the Design Standards
and Guidelines also gives guidance by listing specific criteria to be evaluated when considering
applications for the demolition of buildings (or portions of buildings) in the Historic District.
Therefore, as related to the location and visibility of this demolition, Staff is referring the
Demolition Permit application to the Historic District Commission for consultation. See Zoning
Ordinance, Article 10 Section 3.22 (A) and (B) listed below.

Project Narrative FFY2019
Addendum to Design Standards & Guidelines for the City of Dover Historic District Zone: Modern
Materials & Technologies
The City of Dover is proposing a preservation planning project to evaluate and update portions of the
Design Standards & Guidelines for the City of Dover Historic District Zone document. The result of
the project will be a Draft Addendum document focusing on modern and technological advancements
in materials and construction activities of items discussed in the Design Standards & Guidelines.
The current Design Standards & Guidelines for the City of Dover Historic District Zone document
was created1 and adopted in 1992-1993 with the formal establishment of the City’s Historic District
Commission (HDC) by ordinance adopted July 26, 1993. The ordinances of the City of Dover allow
for the designation and protection of historic properties. The purpose of Historic District regulations
is:
“to preserve and enhance that unique character and value of the old portion of Dover as an area of
special charm and interest. It is particularly intended that the regulations prevent, in the historic district,
any change of conditions that would be deemed to be a disfigurement or degradation of the present
unique visual and architectural qualities of the district.” (Zoning Ordinance, Article 3, Section 21)
The geographic boundaries of the Historic District (H) zone are established as a zoning
classification. The original boundaries of the Historic District established in 1961 were generally
described as extending from just north of Division Street south to South Street inclusive of the
properties fronting on South State Street and The Green then east to the St. Jones River. In 1997, the
boundaries of the Historic District Zone were expanded to include properties fronting on West
Loockerman Street from Bradford Street to the railroad corridor and areas in the vicinity of South
Governors Avenue, South Bradford Street, North Street, and Bank Lane. The areas of expansion
included many commercial and residential properties listed in the National Register of Historic
Places as part of the Victorian Dover Historic District. See attached Map of City of Dover Historic

As a preservation and redevelopment tool, the Design Standards and Guidelines provide guidance
for property owners, design professionals, staff and the Historic District Commission (and Planning
Commission). The “historic district design guidelines and standards” are defined by the Zoning
Ordinance as follows:
“Historic district design guidelines and standards: The document adopted by the City of Dover
Planning Commission as being the source reference document for construction and maintenance of
buildings, structures, and additions with the Dover Historic District and which is the guiding document
for the historic district commission and city planner in their review of applications for architectural
review certification.”
Therefore, it is utilized as a guiding document in the decision making process of reviewing of
construction activities in the Historic District zone for issuance of Architectural Review
Certification (Zoning Ordinance, Article 10 Section 3). Applications for Architectural Review
Certification are reviewed by the City Planner (Staff), the Historic District Commission, and
Planning Commission. See the following code excerpt regarding the architectural review standards.

The current document Design Standards and Guidelines for the City of Dover Historic District Zone was prepared in
1992 by John Milner Associates Inc. with funding by a grant from the National Park Service, U.S. Department of the
Interior and administered by the State Historic Preservation Office. City Planning Staff, the State Historic Preservation
Office, the Friends of Old Dover, Main Street Dover, and other interested parties participated in the development of
the document. 24

Item 6.
Zoning Ordinance, Article 10 Section 3.25 Architectural review standards.
(A) An architectural review certificate may be issued if it is found that the architectural style,
general design, height, bulk and setbacks, arrangement, location and materials and
structures affecting the exterior appearance are generally in harmony with neighboring
structures and complementary to the traditional architectural standards of the historic
district as set forth in the historic district design guidelines and standards adopted by the
planning commission and as set forth in the United States Secretary of the Interior's
Standards for Rehabilitation.
(B) The city planner, historic district commission or planning commission shall not consider
normal maintenance and repair (see definitions, article 12), interior arrangement, or
building features not subject to public view.
The Zoning Ordinance references the Design Standards & Guidelines when establishing the
Architectural Review Certification process for the City of Dover’s Historic District zone (H). An
Architectural Review Certificate is required for a demolition, erection, reconstruction, alternation,
restoration or exterior repairs on properties within the Historic District. Most projects within the
Historic District are eligible for administrative review of the Architectural Review Certificate as
part of the Building Permit process for such projects as signs, roof and door or window
replacement, and exterior finish/siding/trim work renovations. Project activities only involving
interior renovations are not subject to the Architectural Review Certification process. For example,
in calendar year 2018, a total of forty-seven (47) applications (permit activity in the Historic
District) were reviewed under this process with 38 Permits requiring Architectural Review
Certification and 9 Permits not requiring Architectural Review Certification. 2
Historic Preservation Planning is part of a comprehensive approach to land use planning in the City
of Dover. In Dover’s current plan, the 2008 Comprehensive Plan (as amended) this information is
presented in Chapter 6 - Historic Preservation and associated Map 6-1. The 2008 Comprehensive
Plan includes sets forth goals and a series of recommendations for each goal. The Historic
Preservation Goals are as follows:
Goal 1: Preserve and Protect Historic Resources
Historic Goal 2: Provide and Promote Incentives for Preservation Activities
Preservation Goal 3: Increase Public Information on Historic Resources
Goal 4: Collaborate with Diverse Groups and Governments
2008 Comprehensive Plan, excerpt from Table 1-1: Plan Chapter Goals
To achieve Goal 1, one of the adopted Recommendations was the Evaluation of Design Standards
and Guidelines since the original document was adopted in the early 90s. The recommendation also
suggested consideration of the standards and guidelines for the levels of protection for The Green
and the Loockerman Street areas.
For this project for an Addendum to the Design Standards & Guidelines, the City of Dover will
seek to hire a consultant through a Request for Professional Services process to assist the Historic
District Commission and Planning Staff with the project. The consultant will be required to have a
Principal Investigator (PI) who meets the professional qualification standards in 36 CFR 61. Also
involved in the project, the Historic District Commission consists of five (5) appointed members
and the Planning Commission3 consists of nine (9) appointed members. The Planning Staff serves
as staff support to the Historic District Commission and will manage the activities of this project.
2
The volume of Permit Activity in the Historic District over the past five years has averaged 52 applications a year with
a majority of them eligible for Architectural Review Certification review by Staff.
3
The Planning Commission, per the Zoning Ordinance, Article 10 Section 3.25(A), is involved in the formal adoption
process for the Historic District guidelines. 25

Item 6.
With the project, we hope to create an Addendum to the Design Standards & Guidelines that
focuses on the modern and technological advancements in materials and construction activities. In
recent years, the use and role of alternative and composite materials in construction has increased
with options for wood composites, PVC/vinyl products, and others. In addition, features like solar
panels and other conservation related measures have become more common place. This Addendum
will focus on these types of materials and items as associated with the practices for maintenance,
preservation and construction activities within the Historic District. Components of the Addendum
document will continue to provide guidelines for treatment of historic properties and features
focusing on maintenance, repair, alternations, and preservation or restoration of existing buildings;
guidelines for new construction activities (additions and new buildings), guidelines for demolition
activities; guidelines for landscaping and site elements, and guidelines for signage. The document is
to be consistent with the Secretary of Interior Standards for Treatment of Historic Properties
(Rehabilitation Standards and Guidelines).
The project will consist of a series of phases: Planning, Public Outreach, Guidelines Revision and
Refinement, and Preparation of Draft Addendum Document. The following chart outlines the
anticipated activities of the project.
