SPECIAL COUNCIL MEETING - ES ACTION (PUBLIC) - Pending Litigation and Personnel Matters

SPECIAL CITY COUNCIL MEETING A Special City Council Meeting was held on September 8, 2021 at 5:28 p.m. with Council President Sudler presiding. Members present were Mr. Anderson, Mr. Boggerty, Mr. Neil (via WebEx), Mr. Hare, Mrs. Arndt, and Mr. Rocha. Mr. Lindell and Mr. Taylor were absent. Mayor Christiansen was also present (departed at 7:15 p.m.). Council staff members present were Mr. Harline (departed at 6:53 p.m.), Mr. Rodriguez and Mrs. Sapp. The other staff member present was Mrs. Hawkins (departed at 6:53 p.m.). ADOPTION OF AGENDA Mr. Hare moved for adoption of the agenda, seconded by Mr. Rocha and unanimously carried. Mr. Hare moved to recess into Executive Session pursuant to 29 Del. C. §10004(b)(4) - Strategy sessions, including those involving legal advice or opinion from an attorney-at-law, with respect to collective bargaining or pending or potential litigation, but only when an open meeting would have an adverse effect on the bargaining or litigation position of the public body, 29 Del. C. §10004(b)(6) - Discussion of the content of documents, excluded from the definition of "public record" in §10002 of this title where such discussion may disclose the contents of such documents (§10002(o)(1) - any personnel, medical or pupil file, the disclosure of which would constitute an invasion of personal privacy, under this legislation or under any State or federal law as it relates to personal privacy) and 29 Del. C. §10004 (b)(9) - Personnel matters in which the names, competency and abilities of individual employees are discussed, unless the employee requests that such a meeting be open} The motion was seconded by Mr. Boggerty and unanimously carried. The Special Council Meeting recessed into Executive Session at 5:29 p.m. The Executive Session adjourned at 8:02 p.m. ACTION RESULTING FROM THE EXECUTIVE SESSION Personnel Matters During the executive session, members of Council reviewed submitted complaints. Mr. Hare moved to authorize the City Solicitor to get a quote from the IVY Group to conduct an investigation into submitted complaints and act as the liaison between the IVY Group and City Council. The motion was seconded by Mr. Boggerty and carried with Mr. Neil abstaining. By unanimous consent, the meeting was adjourned. The Special Council Meeting adjourned at 8:04 p.m. JANELLA MAE T.
