7/10/23, 8.44 AM Dover, DE Code of Ordinances ARTICLE X1 |, - VACANT BUILDINGS Sec, 22-400. - Purpose; applicability; definitions. (a (b (c (Ord. of Sec. 22-40 (a aboul blank ) Purpose. The purpose and intent of this article is to establish a registration and identification program of vacant buildings within the city. Vacant buildings are detrimental to the surrounding buildings and neighborhoods in which they exist. The article is also to ensure the public health, safety and welfare insofar as they are affected by vacant buildings within the city, The health, safety and welfare of the neighborhoods in which vacant buildings are located are of the utmost importance to the city, as is the general community character in which these vacant buildings are located, Applicability. The provisions of this article shall apply to all matters affecting or relating to vacant buildings. Where, in this article, different sections of this Code may specify different requirements, the most restrictive shall govern. Definitions. The following words, terms and phrases, when used in this article, shall have the meanings ascribe to them in this subsection, except where the context clearly indicates a different meaning. (1) Vacant building means a building, structure, or dwelling that has been unoccupied for more than three consecutive months; or a commercial tenant space greater than 10,000 square feet in an otherwise occupied building, that has been left unoccupied for more than three consecutive months. (2) Actively for sale or lease means the building is being actively marketed through a licensed real estate broker or the owner who is regularly advertising the property in newspapers circulated in and around Dover, it is being offered for sale or lease at a cost of no more than 25 percent over market rate as determined by the city assessor, and the building is in reasonable condition for sale or lease, including but not limited to: no trash has collected inside or outside of the building, the utilities are functional, and it is not being used as storage that is unrelated to the former use. 6-26-2006; Ord, No. 2013-03, 3-11-2013) 1. - Monitoring, inspection and condition standards. The building inspector shall inspect any premises in the city for the purpose of enforcing and assuring compliance with the provisions of this article. Upon request of the building inspector, an owner shall provide access to all interior portions of a vacant building in order to permit a complete inspection. WA

7/10/23, 6.44 AM Dover, DE Code of Ordinances Once a building/structure/unit or residence (hereon after referred to as building) is registerec vacant building, the vacant building shall be inspected annually for as long as it is considered vacant. (b) The vacant building shall be secured; the exterior building and premises shall be maintained in accordance with all City of Dover Code requirements. (c) The vacant building shall be in reasonable condition (all utilities shall be functional, there shall be no trash or debris inside or outside the building and it shall not to be used as storage that is unrelated to the former use). (Ord. of 6-26-2006; Ord. No. 2013-03, 3-11-2013) Sec. 22-402. - Agent-—Responsible person required. (a) Property manager, Any owner of a vacant building, residing outside of the county, shall be required to have a licensed property manager residing or having an office located in the county, or a family member or other designated individual who does not manage any other real estate for a fee and who resides in the county acting a5 a property manager. The property manager, including family members and designated individuals, shall have charge, care and control of the vacant building, and shall provide access to the vacant building for inspection upon request by the building inspector, within 30 days. (b) Corporate or partnership owners. Any corporation or partnership owning a vacant building shall have a designated member, partner, or employee having charge, care and control of the vacant building. The designated member, partner or employee shall reside in or have an office located in the county, or shall be required to have a licensed property manager residing or having an office located in the county, or other designated individual who does not manage any other real estate for a fee, and who resides in the county, acting as a property manager. The properly manager, or other designated individuals shall have charge, care and control of the vacant building, and shall provide access to the vacant building for inspection, upon request by the building inspector, within 30 days. (Ord, of 6-26-2006; Ord. No. 2013-03, 3-11-2013) Sec. 22-403. - Registration and registration fee. aboutblank (a) Registration of building. There are two ways to register the building as vacant. (1) The owner shall register with the city not later than 30 days after any building in the city becomes vacant, as defined. The registration of the vacant building shall include the site address, the name of the current owner or owners, current address of the owner and of all applicable owners, tax parcel number, proof of insurance on the building, description of the condition of the building, plof a | 2A

If any information changes the owner is responsible for informing the city of those changes in a timely manner. (2) The building inspector or his designee, shall investigate any property that may be subject to registration. Based upon his findings, the building inspector may register the properly asa vacant building subject to this chapter. a. Notice of registration. Within five business days of such registration, the licensing and permitting office shall notify the owners of the registered property by certified mail at their last known address according to the records of the city and Kent County. b, Registration fee. (i) The annual registration fee shall be paid at the time of registration. If the building inspector registers the building as vacant the fee shall be due not later than 30 days after the building is registered as vacant. The annual registration fee will then be due on the registration anniversary date every year after that as long as it remains vacant. The starting point for counting a building as being vacant will begin on the date of the enactment of this article [June 26, 2006]. (ii) The annual fee is as provided for in Appendix F—Fees and Fines. (Ord. of 6-26-2006; Ord. of 4-14-2008; Ord. No. 2009-09, 6-22-2009; Ord. No. 2013-03, 3-1 1-2013) Sec. 22-404. - Violation and penalties. (a) If the registration fee is not paid within 30 days of being due, the owner shall be in violation of this article. (1) Alien can be assessed against the property. Such fees shall be entered in the municipal lien docket as a lien owing the city, and the same may be turned over to the city solicitor for collection. (2) The fee will be assessed to the parcel's tax bill. (3) The fee shall be paid in full prior to the transfer of title, (4) The fee shall be paid in full prior to the issuance of any building permits for the subject building and for any other building that is owned by the owner within the city. (a) The following are exempt from the registration: The building has fire damage. After such time this article will be in effect. Proof of activity shall fall on the owner to provide. See definition. (2) The owner has obtained a building permit and is progressing in an expedient manner to prepare the premises for occupancy. (3) The property is in probate or where the owner has entered a long term care facility within six months of the building being vacant. (4) The property is undergoing currently environmental cleanup or assessment. (c) Failure to register. If the owner of the property fails to register the property with the City of Dover within 30 days of notification to do so by the City of Dover staff, then the property owner/agent may not be entitled to exemption from the fees. An appeal of the 25 percent over market rate (from the actively for sale or lease definition) can be considered through an appraisal using accepted appraisal standards to determine market rate. The inspection was done then they restored the Electricity. The Water was the only thing that they decided to release one day, and restraine another. Maybe as a form of punishment to me, am not sure why are doing that. I called and was told to wait at home, but no body showed up. My usage is usually low because I am using it alone. And each time am home I make sure I get enough Sleep because I am undergoing though a Medical Treatment that has course my Doctor to authorize me to do only certain Jobs. And I don't get enough Sleep at Work. It is called Leave-in Job, as an Aide Or Helper, also called House Sitter, wherby I stay over at an Elderly Patient's Home and e the Companion for an assigned Period. Also I make sure to switch the Main Switch Off before I go to Work because People were Stealing my Electricity and coursing me to pay more my Mom and my Nephew wanted to stay with me, but your Boss Ms Alison insisted No. She wanted my Mom to sign as my Tenant which will be contrary to my Culture. So they went back to Philly. I explained to two of your assistants, Mr.Charlce Smith, and Mr.Delance Ross, who came to my house at 6:45 am respectively wanting to Measure the inside of the house. And insisted on going upstairs to the Rooms, but I refused. Two weeks later Mr. Chard showed up also from City of Dover.

These unnecessary Situations is to the point that when | go to pay my Bills, She would run outside to the parking [ ten. | approach me to know whether or not am going to be in the house. | have pleaded with this Woman to forgive me if! ever offended her in anyway, yet the Harassments continued. The Code violation | received was after | went to her for permission as the contractor was to complete the Work at the House. She authorized that the Electricity connection be held off during this time. Then She turned around and reported this House as Vacant which was Shocking to me to see someone in her position behave in that manner. This is very UnAmerican. These type of things did not take place when Ms. Denise was the Manager. | have had relentless Anonymous Texts massages and phone calls asking me to vacate the house because they want to buy it. | have replied, Over and Over that this House is Not for Sale nor for Rent. It has already been assigned to those who will take over from me. And they are clearly not people that would be patient like | have been. This is the only place where | can come to have Peace and Quiet and get enough Sleep after spending days and hours at other People's Houses for a little Pay Check, with little or No Sleep during my Scheduled Stays serving the Sick and Elderly. For now, | don't have the Luxury of 9am--5pm Jobs. This is the only type of job that the Doctors recommended for me to do due to my Ongoing Health Situation. It is Ordered that | receive Medical Treatments Out of State with different Doctors for the Injury that | sustained. This type of Job is regarded as a "Light Duty" because of it's ability to minimize Stressful Traveling Periods, and encourages Savings Money on Utilities Bills, Food, as well as not having the needs to Own a Car or buying Gas. The pay is usually minimal, but incorporated to cover all the Room and Board for the amount of Days, Hours, or Weeks that the Elderly Patient needs the help. Another house usually starts right after one ends. Leaving--in Job will mean that When at work, even if it's my time to Sleep and the Patient needs help to use the Bathroom, am still required to get up and assist him or her, even though | am still recovering from my own Injury and have to Comply with every Doctors Appointments Out of State as authorized. For me, not being in the house 24/7 does not make the house Vacant. In as much as | would like to stay home and watch TV all day, | still need to make a leaving. When | get Home, | Only use One small Fan, turn the Light on and off, Pick out New Clothes, change to new Outfit, then | get some Sleep. | alone do not have Appliances to Course High Electricity Bills. My Bills have always been small. For years, | have Saved Money doing this type of Jobs even when | worked in the Hospital Setting. | still worked in the same way ona part time basis. That's how | was able to Save Money. | usually bring Home Cooked Food from Work. My Mom and my Nephew wanted to stay with me, around enough to Create Electricity Bills for Ms. Allison and City of Dover, but Ms. Allison didn’t want them here unless they sign Paper as my Tenants which my Mom did not appreciate so they both went back to Philly where they don't have to deal with such rules, and where People feel Free to leave their lives. Family should always be family. On one occasion, my Monthly Bills became very high and am usually Working Or out. I came home on this day and the light was Cut Off. | went to the Office, to ask why and your Boss, Ms, Allison refered me to Mr. Adams for inspection. When Adams got here he picked up fight with me while talking to Someone on the phone. It seemed like this Person was basically directing him on what to say to me. He then started claiming that my Meter would have to be changed because the Colour is BROWN and that | would have to pay $600.00 to get it done and that he knows someone who will do it. So | reminded him that every other Neighbor's Meters has the same Color as mine, He then acted angry and left. So | decided to consult an Independent Electrician who said nothing was wrong with my Meter. Another City Inspector came in and completed the Inspection and delcared that nothing was wrong with the Meter. After which, | was charged a $100.00 to reconnect. It was then that | decided to turn the Main Switch Off each time that I left the House to prevent Ms. Felicia who happens to be affiliated with The City of Dover from using her Long Cords to plug my Electric while Seated inside of her Big Truck in front of my house and using my Electric when am away for Work or elsewhere. Le]

Now a similar incident is happened again, on June 26 2023, on the same Week that | went into the Office paid my Cash, the same exert Bill was sent again to my phone to be due in the same Month. She must have seen me when [ came inside to pay. | was unable to pay through the Window, because it will not be accepted unless | drive through. | did not have my Car on that day. A Person by the name Mr. Chard called me on a Number that is not related to my City of Dover records, said that he was at the house to remove the Meter, but the gate was locked. So 1 explained to him that People have been going inside of the Yard vandalizing and throwing dirt's in the Yard, this is why | luck the gate. On getting to the House same Week Friday as | had agreed with the said Mr. Chard, Ms. Allison had already Ordered for my Flectric to be Cut off again and the Usage on the online record now showed as 00 (zero) Usuage. Quite different from the Numbers seen online on the same Week that | paid my Bills. On the day | paid, my light was still on when I turned the Main Switch on. In addition to all the Intimidations, | would receive Water some days and Non other days. | had to look for elsewhere to stay during this Holiday Week end. Right now | have (48) Forty Eight Gallons of Water filled up and Saved. | usually Shower at Work and bring home Cooked Food. So She can keep her Utilities. But | have written to the NAACP with all my Receipts in regards to these ongoing Mistreatments, Harassments, Stress inducing Situations, and life Threats Two Men who previously showed up at my House as early as 6:45am respectively during the Month of June 2023, showed me a City ID and your Card that states your Name Mr. Ron Coburn and said thal they were your Assistants. And tried to get up stairs for Measurements. They also said that you will be holding on to my Deed until the Measurements are done. Both of these Men including Mr. Chard came to me with out any Formal Notice from the City of Dover. Things like this should not happen in a place like USA. Because in the Third World Country where | came from, Americans are known for their Big Hearts and not the Opposite. Please see how you can get involved and help me as you had promised in 2015.
