Planning Commission Report to City Council for April 12, 2004

Findings and Recommendations of the Dover Planning Commission
This petition was considered at the March 15, 2004 meeting of the Planning Commission. The
following members were present at the time of this application: Mr. Friedman, Mr. Nichols, Mrs.
Horsey, Mr. Sandusky, Mr. Holt, Mr. Winsley, and Mr. DiMondi.
The Planning Commission recommends that this request for rezoning from RG-2 to C-4 be
approved. The motion for approval of the rezoning passed 7-0 of those members present.
The application is to rezone a parcel currently zoned General Residence Zone (RG-2). The land
is currently vacant and owned by the Bramble Charitable Foundation. It is located to the west of
Route [3 approximately 4 mile from the northerly Route 1 interchange, The property measures
approximately 5.86 acres of generally treed land. The equitable owner, Dr. Mukesh Patel,
intends to construct a 4 story hotel with parking for 280 +/- vehicles. The current zoning allows
relatively dense residential uses including one family homes with some offices uses interspersed,
garden apartments and off street parking related to adjacent C-2 uses. Student housing and
multi-family conversions are allowed as conditional uses. The proposed zoning allows a full
range of light and medium commercial uses primarily including services providers, warehousing,
eating venues and auto and transportation type uses, specifically including motels. The
definitions section makes no distinction between hotels and motels.
Surrounding Land Uses:
The site is surrounded by commercial uses, most similar to the proposal. Immediately to the
north is a vacant wooded parcel and then the Holiday Inn Express. The property to the west is
also vacant and wooded and owned by Delaware Technical College. The properties to the east
are commercial on the Route 13 frontage (a combined gas station, convenience store and drive in
restaurant immediately adjacent). The properties to the south are a hotel, a restaurant and a larger
apartment complex.
Comprehensive Plan:
The Comprehensive Plan Update 2003 Land Development Plan identifies this parcel as
Commercial. The proposed use is in compliance with the Plan.
Recommendation of the Planning Staff:
This proposal is consistent with the Comprehensive Plan and is adjacent to similar uses. The
merits of the rezoning are consistent with the evolution of the parcels involved. The Planning
Staff recommends approval of the request.
ADVISORY COMMENTS TO THE APPLICANT:
1) The applicant is made aware that approval of any rezoning request does not represent
Site Development Plan approval. A separate Site Development Plan must be
submitted, considered by the DAC and Planning Commission and approved for the
development of the property. Such a review does require an elevation and rendering
Page 3
2-04-04 Lands of Bramble Charitable Foundation: Rezoning RG-2 to C-4
Planning Commission Report to City Council for April 12, 2004
Page 2
of the proposed building for the site. The applicant is made aware that the proposed
building will be considered in the context of the neighborhood.
2) The applicant is made aware that approval of any rezoning application does not
represent a Building Permit approval. A separate application submission showing all
improvements is required before issuance of a Building Permit by the City of Dover.
3) The applicant should be aware that the subject site may be impacted by the site
development design in the previously approved Site Plan application for S-97-13
Holiday Inn and McDonalds Complex located to the north of this subject property. S-
97-13 may include an easement for a future public road right-of-way connecting the
complex to Cedar Chase Drive to allow for shared access to adjoining properties.
Public Comments:
The application was represented by Mr. Ron Smith, Esq., Attorney for the applicant; Mr. Bill
Stephens, Engineer/surveyor for the project; and Dr. Mukesh Patel, equitable owner.
No one appeared and spoke in regards to the rezoning application.
Agency Comments from DAC Report:
Department of Public Works has no objections to the rezoning. However, they note that
wetlands are likely to exist on the site and site design must provide the appropriate separation
distances. They also advise that as part of the site plan approval that right-of-way be
dedicated for a future public access road along the eastern property boundary.
DelDOT has no objections to the rezoning. Their comments note the requirement for traffic
generation figures and an intersection analysis for Route 13 and Cedar Chase Drive as part of
the site development process.
Kent Conservation District has no objection to rezoning this site. A Sediment and
Stormwater Management Plan is required for any land disturbing activity over 5000 square
feet.

Description of Property:
The area of petition consists of a tract of 0.5129 acres +/- (22.341 S.F. +/-) of the larger parcel.
**Note: The area of petition was revised to 0.4938 acres +/- (21.508 S.F. +/-) to comply with
DAC comments. ** The property is currently zoned RC (Recreation & Commercial Zone). The
proposed zoning classification is R-10 (One Family Residence Zone). This area to be considered
for rezoning is located east of Kenton Road at the intersection of Maple Dale Road and a private
access driveway. The owner of record is Maple Dale Country Club. Inc.
Surrounding Land Uses:
A series of residential building lots on the east side of Kenton Road and north of Maple Dale
Road are zoned R-10 (One Family Residence Zone). Further to the north, The Retreat is zoned
RM-2 (Medium Density Residence Zone) and R-10 (One Family Residence Zone). To the east
and south of this subject area is the Maple Dale Country Club which includes an 18-hole golf
course and country club facilities: it is zoned RC (Recreation & Commercial Zone).
Comprehensive Planning:
The Land Development Plan of the 1996 Comprehensive Plan shows this area as Open Space,
Environmentally Sensitive Lands & Recreation. This recognizes the land holdings and land use
of the Maple Dale Country Club facility,
The Comprehensive Plan Update 2003 shows this area as Open Space. Conservation, &
Recreation. This again recognizes the current land use of the Maple Dale Country Club property
as a “golf course and country club.” The Comprehensive Plan Update notes Maple Dale Country
Club as an example of Private Open Space that provides recreational Opportunities for its
members. The R-10 zoning classification is considered Low-Density Residential.
Page 9
7-03-08 Lands of Maple Dale County Club
Planning Commission Report to Council
Page 3
Request for R-10 (One Family Residence Zone):
The types of permitted uses are outlined in Article 3 §1. Agricultural uses, single family detached
dwellings on 10,000 S.F. lots, and public buildings are permitted. Within the R-10 zone, the
conditional uses of the Planned Neighborhood Design — Senior Citizen Housing Option and
Planned Neighborhood Design Developments on twenty (20) or more acres with single family
and multiple family dwellings and a gross density of 3 units per acre; churches; schools;
hospitals; funeral homes; philanthropic and charitable organizations; and country
clubs/membership clubs are permitted. The size of this subject area further limits some of these
conditional uses.
Article 3 $18 of the Zoning Ordinance outlines the permitted uses in the RC zoning
classification. This zone does not permit residential uses. Also the minimum requirement for lot
area in the RC zone is five acres. As stated in the Land Subdivision Regulations, “lot sizes shal?
conform to the requirements of the zoning ordinance” (Article VI §E). In order to subdivide the
land, the subject area must be rezoned.
During the review a correction was identified for the proposed property lines. The property line
will be revised removing the sign located at the corner of Maple Dale Road and the private
driveway from the rezoning subject area. This will also correct the property line to show it at a
right angle or radial to the street in order to meet the requirements of the Land Subdivision
Regulations Article VI $E7. **The revised area calculations were noted during the Planning
Commission discussion of this application. The revised area is given as 0.4938 acres +/- (21,508
S.F.+/-).
Recommendation of the Planning Staff:
The Planning Staff recommends that the rezoning from RC to R-10 be approved. Rezoning is
necessary for the proposed minor subdivision to meet the code requirements. The proposed
zoning classification is compatible with the adjacent properties. The configuration and location
of the subject area limits its use as an integral part of the golf course facility.
Public Comments:
The application was represented by Frank Donnelly and Mike Meiser.
The following appeared and spoke in regards to the rezoning application:
¢ Gene Ruane, City Councilman — He had no comment per say on this application but a
procedural question related to rezoning and the Land Development Plan of the
Comprehensive Plan Update 2003, especially regarding the recent clarification/information
on Delaware Code (as identified in a letter from the Office of State Planning Coordination in
regards to another rezoning application). He questioned whether this rezoning was in
compliance with the land uses depicted on the City’s Land Development Plan Map.
Agency Comments from DAC Report:
¢ Department of Public Works noted the necessity of easements for existing utility poles and a
sign. They also noted the requirement for lot lines at right angles to streets (the applicant
noted linc revisions to account for this during the discussion), Advisory comments also
included information on water and sewer services and a request for easement for maintenance
of the existing sign.
Page 10

® City of Dover Electric Department notes that the parcel can not served with electric service
until it is subdivided.
e DelDOT has no comments on the rezoning.
e Kent Conservation District has no objection to the rezoning.
ADVISORY COMMENTS TO THE APPLICANT:
1. The rezoning subject area should reflect compliance with the locational requirements for
property lines outlined in the Land Subdivision Regulations Article VI §E7. This will
remove the existing sign from the rezoning subject area and slightly reduce the totai area
of rezoning. The applicant noted during the discussion that the subject area has been
revised to remove the existing sign thus reducing the subject area to 21,508 S.F.
2. The applicant shall be aware that approval of the Rezoning does not represent
Subdivision or Site Plan approval. A separate application process for Subdivision or Site
Plan approval is required for the development of this property.
3. Planning Commission will provide a recommendation regarding the rezoning application.
The City Council will also conduct a public hearing and take fina! action on the
application.

MEMORANDUM OF UNDERSTANDING
WITH REGARD TO THE
REAL ESTATE TAX ASSESSMENT FOR
TAX PARCEL NO. ED-05-077.05-04-40.00-000
This Memorandum of Understanding (“Memorandum”) is made this __ day of
, 2004, by and between Michael A. Zimmerman and Connie Jo
Zimmerman (the “Zimmermans”), husband and wife, and The City of Dover.
BACKGROUND
The Zimmermans are the sole owners in fee simple of certain real property in the
City of Dover, Kent County, State of Delaware, being Tax Parcel No. ED-05-077.05-04-
40,00-000 which is set forth as Exhibit A to a Conservation Easement which is attached
hereto and made a part hereof by this reference (the “Entire Property”). A portion of the
Entire Property which is more particularly depicted as the darkened triangular area on
Exhibit A to the Conservation Easement (the “Property’”) possesses historical and scenic
values of great importance to the Zimmermans, the City of Dover and both the people of
the City of Dover and State of Delaware (collectively “Conservation Values”). The
Property preserves a historically important land area within a registered historic district
that contributes to the significance of that district.
In furtherance of the preservation of the historical significance of the Property, the
Zimmermans and the City of Dover executed a conservation easement dated
December 31, 2003 (“Conservation Easement”). It is the intention of the parties to record
the Conservation Easement shortly after this Memorandum is executed. The
Conservation Easement provides in part that the City of Dover “agrees by accepting this
grant to honor the intentions of [the Zimmermans] ... and to preserve and protect in
perpetuity the Conservation Values of the Property for the benefit of current and future
generations.” The Conservation Easement sets forth in detail the rights and obligations of
the parties.
The Zimmermans acknowledge that the City of Dover entered into the
Conservation Agreement as an accommodation to them. The City of Dover has sought
assurances from the Zimmermans that they will not apply to the City of Dover now or in
the future for a reduction in the real property tax assessment of the Entire Property based
solely upon any diminution in value as a result of the Property being subject to the
Conservation Easement.
At the time of the grant of the Conservation Easement, the Zimmermans orally
acknowledged that they would not seek a reduction and they now wish to memorialize
their agreement in writing.

1.
Commitment Not to Seek Reduced Tax Assessment. The Zimmermans shall not
