Item 1. 20 October 2023 MEMORANDUM FOR: City of Dover Inspections Department. SUBJECT: Citation Appeal Request FROM: Mike Snodgrass 406 Cold Spring Place Dover, DE 19904 Good afternoon. I am requesting the fines levied in Citation 23-00003973 be dismissed based on the following information. BACKGROUND INFORMATION: I have a tenant, Ms. Kim Elkins, who is currently residing at 406 Cold Spring Place, Dover DE 19904. Ms. Elkins was hired to work at Dover Behavioral Health under a three-month contract with the possibility of a three- month extension. Ms. Elkins was living in Texas at the time of hire and traveled to Dover, Delaware where she resided at a local hotel. A previous co-worker, Ms. Jane Quein, who I worked with at the Family Support Center before I retired from active duty, learned about Ms. Elkins residing at a hotel who had sleep insomnia. Ms. Elkins worked the night shift at Dover Behavioral Health who had struggled to sleep during the day at the hotel due to the noise level. Ms. Jane Quein was aware of my current situation at the time where I had taken on the responsibilities as a full-time caregiver for my mother-in-law who had congestive heart failure. Ms. Quein knew I had someone try to break into my home by throwing a cinder block through my window while I was away. I filed a police report with the Dover Police Department. Ms. Quein explained to me Ms. Elkin's current situation at the time and recommended I could rent my home to her temporarily for three months and then I wouldn't have to worry about the security of my home. I had serious reservations letting someone move into my home fully furnished with all my personal belongings still there as I had never contemplated renting my home. I ultimately agreed to rent my home for three months knowing there was the possibility of a three-month extension. Since Ms. Elkin was only going to reside at my place for three months, we both agreed the utility bill would remain in my name and my mailing address would remain the same with the intention I was moving back into my home after Ms. Elkins departed. However, due to complaints filed against Ms. Elkins, Dover Behavioral Health terminated Ms. Elkin's contract early. Due to Covid-19, Ms. Elkins informed me that she was not required to move at the time even though she was 7 months behind in rent. It has now been two years. I have been trying to get her to move for a year and actively working thru JP16 Court for over 5 months to get her to vacate. I now have a stipulated agreement that she must move by 17 Nov 23. If not, I'm required to file an affidavit with the court and a judgement will be issued. CITATION APPEAL INFORMATION: An inspection of my property was conducted June 22 by The City of Dover Planning & Inspections: I had several writeups, from 7

Page 8

Item 1. breaker box not labeled, fire alarms needed to be installed in each bedroom, pond not running, inside stairwell handrail was loose, and an overgrowth of vegetation need to be cleaned up. I was reinspected and passed. However, I was unaware that I was required to request an annual rental permit from the City of Dover and an annual inspection had to be completed. I take full responsibility for being ignorant to this process and not taking the time to understand what was required of me. According to citation letters I now have in my possession, The City of Dover Code Enforcement initially cited me on 29 Aug 23 for not obtaining a rental permit and fined me $100. I received additional citations for the same offense on 7 Sep 23, fined $200, 15 Sep 23, $400, 9 Oct 23, $1000. There was a citation issued sometime between 15 Oct 23 and Oct 23 that I do not have in my possession. I'm requesting you consider the following information for removing the current fines that have been assessed for failure to obtain a rental permit. On 15 Oct 23, I had to appear at JP16 Court for a Landlord/Tenant dispute. I made an agreement with Ms. Elkins' attorney to forfeit $2000 in back rent owed in order to get a stipulated agreement signed by the judge for Ms. Elkins to vacate by 17 Nov 23. After court adjourned, Ms. Elkins reached into her purse and handed me three certified letters from the City of Dover Code Enforcement. I immediately departed for the Planning & Inspections Office and met with Ms. Lauren Eisenbraun. I explained how I had just come into possession of the three unopened certified letters. Ms. Eisenbraugn went over my case file and explained each citation. I explained there was no way I could address the situation or appeal the citations in the allotted 14 days because I was never privy to the citations. Ms. Eisenbraun explained she was not authorized to remove any fines and I had to appeal to the City of Inspections. During the conversation, she informed me another citation for weeds, vegetation, and high grass in exterior area of property was recently mailed to me and probably had not been delivered as of 13 Oct 23. On 16 Oct 23, I immediately took care of the write-ups in the citation regarding the exterior area. While working on the exterior part of the yard, Ms. Elkins came out side and handed me three more letters from The City of Dover Code Enforcement and two of them were certified. She felt compelled to tell me that she was aware that I failed to obtain a rental permit because she called Code Enforcement. She never told me she had been holding onto the certified letters, or did she tell me she contacted the Code Enforcement Office. It wasn’t until 13 Oct 23 when I became privy to any of the citations regarding failure to request a permit. Please consider that I never ignored the citations or I would have taken care of the situation. My belief is Ms. Elkins made a conscientious decision to withhold the citations from me that would result in fines levied on me. NOTE: On 16 Oct 23, I relayed to Ms. Elkins that I need to schedule an inspection of the property and what we be good for her. She told me not to have the property inspected while she is in the process of preparing to move by 17 Nov 23 and therefore did not provide me a date that would work for her. However, at this point I only want to meet requirements set forth by the Planning & Inspections Office. 8

Item 2. 1m rn (Q1jnW~~ David L. Miller J.ffi OCT 2 5 2023 JY) 170 Hazel Road Dover, DE 19901 By: _.--- 302-396-2050 October 24,2023 fRl~rc~llW~[D) Ronald Coburn, Code Enforcement Officer City of Dover OCT 262023 Department of Inspections A-w Division of Code Enforcement OFFICE OF THE CITY CLERK. 15 Loockerman Plaza Dover, DE 19901 Subject: Appeal of Fine in Citation # 23-00001299 Dear Mr. Coburn: I am writing in regard to your letter of October 11, 2023, specifically to appeal the fine imposed. Neither I nor Mary Miller, nor our contractor, Charles Gibson, removed or authorized the removal of the condemnation placards posted by the City on the buildings at 44 Girl Scout Lane. Contrary to removing them, we felt the presence of the signs might actually deter or give pause to the teenage vandals and homeless people who have broken into the buildings in the past. We thought the signs would give the impression that the buildings might be in danger of collapse or be a health hazard, posing a physical risk to anyone who entered. Additionally, we thought trespassers might be reluctant to violate the order of a governmental authority. While some placards might have been removed by trespassers or mischief makers, we believe wind, rain, and extremely hot summer days played a role, loosening the adhesive. Early on, some placards showed signs of curling up at the corners. Ultimately, the signs did not disappear, but were on the ground nearby, not torn up or tossed in the trash. Therefore, we appeal the fine for unlawful removal of a condemnation placard. Thank you for your consideration. Please feel free to contact me at the number above. Respectfully, 38
