City seeking new city solicitor | Respond or Apply by Dec. 2
Nov 06, 2024
The City of Rehoboth Beach is issuing a Request for Qualifications (RFQ) to identify and retain a city solicitor to represent the city.
As a charter position, the city solicitor is the chief legal counsel to the city, which includes city commissioners, the city manager,
various city departments, and various city boards and commissions, except for the city’s Planning Commission and the city’s
Board of Adjustment (each of which has its own independent counsel). The successful candidate hired through the RFQ process
will be an independent contractor of the city. This is an exciting opportunity to work on a variety of important issues facing “the
Nation’s Summer Capital” as it continues to maintain its small-town beachfront charm consistent with the needs of its residents,
property owners, businesses, and visitors. Please review and respond to the RFQ by December 2, 2024.
The Board of Commissioners also seeks applicants who wish to serve as in-house counsel in the city solicitor capacity. If you want
to apply to be a city employee rather than an independent contractor, please apply through our employment opportunities
portal.

CITY SOLICITOR
CITY OF REHOBOTH BEACH
REQUEST FOR QUALIFICATIONS
The City of Rehoboth Beach (“City”) is issuing a Request for Qualifications (RFQ) to
identify and retain a City Solicitor to represent the City. As a Charter position, the City
Solicitor is the Chief legal counsel to the City, which includes the City Commissioners,
the City Manager, various City departments, and various City Boards and Commissions,
except for the City’s Planning Commission and the City’s Board of Adjustment (each of
which has its own independent counsel). The successful candidate will be hired as an
independent contractor of the City. This is an exciting opportunity to work on a variety
of important issues facing “the Nation’s Summer Capital” as it continues to maintain its
small-town beachfront charm consistent with the needs of its residents, property
owners, businesses, and visitors.
CITY SOLICITOR—Code of the City of Rehoboth Beach-Charter Section #19.
“The Commissioners shall select and appoint a City Solicitor for an indefinite term who
shall be removable at the pleasure of The Commissioners of Rehoboth Beach either
with or without due cause stated. The City Solicitor shall be a member in good standing
of the Bar of the State of Delaware. It shall be his duty to give legal advice to The
Commissioners and other offices of The City and to perform other legal services as may
be required of him by The Commissioners.”
REQUIREMENT AND DUTIES:
• The City Solicitor is selected by, reports to, and is evaluated by the
Commissioners of the City of Rehoboth Beach (“Commissioners”).
• The City Solicitor shall be a member in good standing of the Delaware Bar and
be licensed to practice law before all state Courts in the State of Delaware and
the Federal District having jurisdiction over Delaware (or eligible to be admitted to
practice before the Federal District Court as soon as practicable).
• The candidate shall have a minimum of three years of legal experience and be
licensed to practice law in Delaware for three years – five years of experience
representing municipalities and government entities is preferable. The City
Solicitor shall serve as an independent contractor of the City.
• Except for the Planning Commission and Board of Adjustment (each of which
has its own independent counsel), the City Solicitor will manage all the legal
activities and representation of the City. The City Solicitor may utilize other
resources in his or her firm and, in consultation with the Mayor and/or City
Manager, will retain and manage outside counsel/attorneys that may be required
to represent the city in a variety of matters.
• The selected attorney should be familiar with litigation procedures, land use law,
real estate law, personnel and labor law, regulatory and election law, and
expertise as it relates to city financial activities such as borrowing, bonds, etc.,
and other areas as needed.
• In his or her role of advice and consultation to the Mayor and the Commissioners,
the City Solicitor will regularly prepare for and participate in all City Commission
1

Item 7.
meetings and workshops. This will include prior review and comment on all legal
and legislative matters to come before the Commission, including drafting
resolutions, motions, ordinances, and other documents for further action, as well
as assisting with reviewing the agenda prior to being published. The Board of
Commissioners typically meets monthly in a workshop meeting on the second
Monday preceding the regular meeting and the third Friday of each month in
a regular meeting. Special meetings are scheduled as needed. Attendance may
be required at all meetings of the Board of Commissioners.
• The City Solicitor will also advise the City Manager regularly and continuously on
all relevant matters pertaining to City activities. This includes but is not limited to
the review of all contracts, all regulatory activities, code interpretation, all leases,
and other ongoing matters.
• Upon approval of the City Manager or Mayor, the Directors and Department
heads of the City, such as the Planning and Community Development Director,
Chief of Police, and others, may seek direct advice from the City Solicitor.
• The City Solicitor is expected to consult regularly with the Building and Licensing
Department on matters related to code interpretation and issuance of permits
and represent the Building Inspector before the City’s Board of Adjustment,
Parks and Shade Tree Commission, and Planning Commission when deemed
appropriate. For matters requiring the City Solicitor’s involvement, the Board of
Adjustment usually meets the fourth Monday of each month, the Parks and
Shade Tree Commission usually meets the fourth Monday of each month as
needed, and the Planning Commission usually meets the second Friday of each
month. As stated above, the Planning Commission and the Board of Adjustment
each have their own independent counsel.
• The City Solicitor should have adequate familiarity with many of the types of
matters in the City Charter ( https://ecode360.com/12119262 ) and City Code (
https://ecode360.com/RE0659 ), as well as matters addressed in the Delaware
Code including those applicable to municipalities (e.g., Title 22 of the Delaware
Code, https://delcode.delaware.gov/title22/index.html ). For example, such
matters may involve public infrastructure and property, city services, licensing,
zoning, planning and development, personnel and employment, municipal
borrowing, public records, election law, ethical standards, and litigation. It is
preferable, but not required, that the selected candidate be familiar with and/or
have expertise in all of these matters.
• The City Solicitor should have some direct litigation experience and/or should
have worked in coordination with litigators on some litigation, whether that is
court and/or administrative agency litigation. In the past, when there has been
court litigation involving the City, in some instances, the City Solicitor has
represented the City (solely or as co-counsel), but in some instances, the City
has retained separate litigation counsel. Where the Planning Commission or the
Board of Adjustment is a named party to any court litigation, their own respective
counsel may be involved in such litigation, and the City Solicitor may or may not
be involved. An otherwise strong candidate with an absence of direct litigation
experience will not be excluded from consideration.
2
8
Page 9
Item 7.
• Regarding all matters in which the City Solicitor is involved, the City Solicitor (and
any other resources authorized to be used and managed by the City Solicitor)
must provide a high-quality work product in a timely manner.
• Absent a waiver, the City Solicitor and all counsel utilized on behalf of the City or
any of its entities must have no conflict of interest with the business of the city,
and shall take all measures to avoid the appearance of a conflict of interest.
• The City Solicitor is expected to be knowledgeable of Chapter 100, Title 29 of the
Delaware Code, Freedom of Information Act (FOIA), and the ability to interpret
and provide guidance on FOIA compliance and defend the City in any FOIA
violation allegations.
• Overall, and in general, the City Solicitor should view the role as providing the
City with a proactive legal approach that helps it manage its business
and anticipates both long-term and short-term impacts.
SUBMISSION PACKAGE
The Request for Qualifications submission should include at minimum:
• Educational background
• Relevant legal experience, with emphasis on municipal work or related
experience
• List of relevant memberships
• Location of office(s)
• What resources - personnel and others - will be made available to support your
work as the City Solicitor
• Firm resources to assist if the designated Solicitor is not available
• Any client references you are willing to share with the City
• A statement that there is no conflict of interest between the business of the City
and current clients of the firm or disclosure of any conflicts of interest
• Any special skills or expertise that you or your firm may bring to the position of
Solicitor
• Compensation Requirements
RECRUITMENT PROCESS AND SCHEDULE
• Due to recent FOIA opinions by the Attorney General's office, the recruitment,
review of RFQ submissions, and selection process of a new City Solicitor as an
independent contractor must be conducted in an open public meeting.
• The City reserves the right to reject any and all responses to this RFQ.
• The Board of Commissioners is also interested in exploring the option of an in-
house City Solicitor as a City employee rather than an independent contractor. If
3
9

Item 7.
you prefer this scenario, please apply to the job posting instead of this RFQ
process at https://www.cityofrehoboth.com/employment-opportunities.
Proposed Schedule
• RFQ will be made available to interested parties.
• RFQ submissions are due Monday after Thanksgiving weekend, December 2nd.
• The City Manager will write an executive summary or cover memo of key points
and qualifications to present to the Commissioners.
• A review of submission packages (shortlist) will occur at a special December
meeting.
• Interviews occur later that month at a special meeting in December.
• As part of the interview day, a staff evaluation committee made up of key staff
that interface with the solicitor on a regular basis would provide additional
feedback to the Commissioners for their decision-making process.
• It is expected that the new City Solicitor will begin their services with the City in
January - February 2025.
INQUIRIES
• We understand and respect that some candidates/firms require that any
questions regarding the opportunity be handled with confidentiality due to their
work status (e.g., current engagements with state, local, or federal government;
current partner, associate or other position with a law firm; current position within
academia or non-profit organization; retired or semi-retired work status).
• If you are in that situation, please contact Taylour Tedder, City Manager, at 302-
227-2737 or ttedder@cityofrehoboth.com with any questions.

BACKGROUND AND ANALYSIS
The City Clerk’s Office received a request for an alley abandonment of part of the alley between S. Governors
Avenue and S. Bradford Street. The alley runs north from Minor Street through the parking lot to the southern
boundary of Robbins Hose Company No. 1 of Dover’s property. The alley abandonment is necessary to provide
enough space for Downtown Dover Partnership’s Downtown Mobility Center project.
Downtown Dover Partnership will have to work with Public Works to find a location to relocate two dumpsters
currently in that alley for downtown business trash removal. Public Works has confirmed with the Department
of Water/Wastewater and Engineering Services that a waterline will also need to be relocated. The
Department of Public Works has no objection to the abandonment of the subject alley

December 16, 2024 where no members of the public spoke, and no
written comments were received regarding the Alley Abandonment
Request. The Planning Commission’s motion to recommend approval
of the proposed Alley Abandonment Request for the Part of the Alley
Between S. Governors Avenue and S. Bradford Street (extending 132
feet north of Minor Street Alley) resulted in a 6-0 vote in favor (three
members absent). (Draft Meeting Minutes attached.)
REQUEST: MI-24-10 Request for Alley Abandonment: Part of Alley Between S.
Governors Avenue and S. Bradford Street
This Request for Alley Abandonment was referred to the Planning Commission as per the Dover
Code of Ordinances. The Planning Commission is required to provide a Recommendation to the
City Council Utility Committee. The following document and attachments are provided as the
Review Report and Planning Commission Recommendation.
I. REQUEST SUMMARY
Alley Abandonment Request:
The Downtown Dover Partnership has requested that the City abandon portions of the Alley
between S. Governors Avenue and S. Bradford Street, Dover DE. This request is being made as
part of the project proposal for the redevelopment of a series of six parcels to the north of the
Minor Street Alley for the Dover Mobility Center Garage (Parking Garage). This Request
focuses on the process for Alley Abandonment only as the redevelopment project will be subject
to separate Site Development Plan applications and reviews.
Existing Area:
The subject area consists of a public alley, owned and maintained by the City of Dover. Recent
property surveys have shown this Alley to be located within right-of-way and also traversing
portions of several of the adjacent parcels. The Alley requested for abandonment is adjacent on
both sides to properties held in the ownership of multiple properties. See Table below and
attached Plan submission diagrams:

It is noted that under separate proceedings the City Manager’s Office has presented to Dover
City Council a proposal for the transfer of City owned property to the Downtown Dover
Partnership entity for this redevelopment project. The redevelopment project known as the Dover
Mobility Center (Parking) Garage is identified as a priority project in the Transforming
Downtown Dover: Capital City 2030 Plan.
II. RECOMMENDATION OF THE PLANNING STAFF:
The Planning Staff notes the redevelopment efforts associated with the Transforming Downtown
Dover: Capital City 2030 Plan which focuses on efforts to revitalize and redevelop Downtown
Dover. To the extent that long-term abandonment of the subject Alley area will help accomplish
this objective, staff supports the conceptual request. Staff believes that the requested Alley
Abandonment should be conditioned on abandonment coinciding with appropriate planning for
the relocation of any utility infrastructure in the Alley as associated with future site development
plans.
III. PLANNING COMMISSION REVIEW FOR RECOMMENDATION
The Request for Alley Abandonment is to be considered by the Planning Commission. The
Planning Commission as part of their public hearing and review process will provide a
recommendation on the Alley Abandonment to the Utility Committee (a City Council Committee
of the Whole Subcommittee).
RECOMMENDATION OF THE PLANNING COMMISSION:
At the Hybrid (In-Person and Virtual) Planning Commission Meeting of December 16, 2024, the
Request for Alley Abandonment MI-24-10 was represented by Mike Riemann of Becker Morgan
Group on behalf of the Requestor; Diane Laird of the Downtown Dover Partnership; and JD
Bartlett of EDiS Company. During the Public Hearing, no members of the public spoke, and no
written comments were received regarding the Alley Abandonment Request.
The Planning Commission’s motion was to recommend approval of the proposed Alley
Abandonment Request for the Part of the Alley Between S. Governors Avenue and S.
Bradford Street (extending 132 feet north of Minor Street Alley) and resulted in a vote of 6-0
in favor of rezoning (three members absent) with the condition that the Alley Abandonment
would be effective once the integration is accomplished by deed into one entity. The reasons
cited for the recommendation of approval include the applicant’s presentation and
discussion at the meeting and with reference to the Planning Staff’s Recommendation in the
Development Advisory Committee Report.
See also the included excerpt of the DRAFT Meeting Minutes of the December 16, 2024
Planning Commission meeting. The comments received from the other member agencies of the
Development Advisory Committee (D.A.C.) are also provided.

IV. ADVISORY COMMENTS TO THE APPLICANT:
1. The Planning Commission’s role is to make a recommendation to the City Council on the
matter. City Council has ultimate authority on the request for abandonment.
2. Staff notes that abandonment of the public alley will require relocations or easements for
existing utilities in the area. If the request for abandonment is successful additional
coordination with various City Departments will be necessary to address utility infrastructure
access, the need to maintain emergency access, and the development (and approval) of a
Record Plan documenting a transfer of ownership and any associated infrastructure easements.
3. Abandonment of public alleys does not constitute approval for physical alteration of such
alleys. Any modification or ground-disturbing activity must be reviewed through the
appropriate site plan process and receive all requisite approvals by regulatory agencies.

RE: Alley Abandonment Request
DOVER MOBILITY CENTER GARAGE
Dover, Delaware
2024314.00
Dear Ms. Bennett:
On behalf of our client, Downtown Dover Partnership, please accept this letter as a formal
request for the City of Dover to begin the process to abandon the alley within the existing
City of Dover parking lot located between Governors Ave and Bradford Street. The alley
runs to the north from Minor Street through the parking lot to the southern boundary of
Robbins Hose Company No. 1 of Dover’s property. We are seeking to vacate the portion of
the alley that runs through the project’s boundaries. The areas included in this request are
depicted on the following enclosures to this application:
1. An aerial map, entitled “Alley Abandonment – Aerial Exhibit, Dover Mobility Center
Garage”. This map identifies the section of the alley being requested to be vacated
and the adjacent property owners, and roads over the current aerial photography.
2. A smaller scaled drawing exhibit entitled “Alley Abandonment Exhibit, Dover
Mobility Center Garage”. This exhibit identifies the section of the portion of the alley
requested to be vacated as well as the tax parcels involved, parcel owners and
topography.
3. A legal description of the portion of the alley included in this request.
This request is being made to allow for the consolidation of the six (6) parcels involved in the
project into one parcel, as well as the construction of the garage facility, as the garage will
span from Governors Ave. to Bradford Street. Additionally, a parcel consolidation plan
showing the consolidation of all six (6) parcels and the alley into one parcel will be prepared
and submitted to the City’s Planning Department with the site development plans.
The portion of the alley included in this request is exclusively within the project’s property
boundaries and several of the properties extend to the centerline of the alley currently. Under
Section 27 of the Dover Charter, it allows the City Council to authorize the solicitation of
bids for the sale of the land or street being vacated or abandoned. The portion of the alley
proposed for abandonment is located entirely within the project’s outer property boundaries
and given that The Downtown Dover Development Corp. is the owner of the six (6) parcels
that make up the project boundary, we request that Council not offer them for public or
private sale and that it be allowed to be consolidated in the overall parcel for the project.
Based on previous discussions, it is our understanding that the abandonment procedure begins
with a formal request to your office. From there the request is added to the Development

Advisory Committee and Planning Commission agendas. After being discussed at the
Planning Commission, their recommendation will be forwarded to the Utility Committee and
then Council for discussion. If the Council feels the abandonment request is appropriate, it
can then be scheduled for a public hearing for the next Council meeting. The Council will
then make a decision on the abandonment after the public hearing.
Please include this request on the Development Advisory Committee agenda and Planning
Commission agenda for December 16, 2024 and feel free to contact us with any questions or
concerns with this request.
Sincerely,

NEW APPLICATIONS
MI-24-10 Request for Alley Abandonment: Part of Alley Between S. Governors Avenue and S.
Bradford Street – Public Hearing and Review for Recommendation to City Council on a Request
for Abandonment of a portion of the improved alley, located between South Governors Avenue
and South Bradford Street and extending approximately 132 feet north of the Minor Street Alley,
consisting of 1,550 square feet in area. The portion of the alley to be abandoned is adjacent to the
properties located at 133 S. Governors Avenue, 139 S. Governors Avenue, 145 S. Governors
Avenue, 136 S. Bradford Street, 148 S. Bradford Street, and 150 S. Bradford Street, Dover DE.
Representatives: Mr. Mike Riemann, Becker Morgan Group; Ms. Diane Laird, Downtown
Dover Partnership; Mr. JD Bartlett, EDiS Company
Mrs. Melson-Williams stated that this is a Request of Alley Abandonment. It’s not your typical
application to the Planning Commission; however, you are called upon to participate in the
process for consideration of Alley Abandonments. You can see in the image on the screen; we
are located between S. Bradford Street and S. Governors Avenue to the north of Loockerman
Street and to the north of the Minor Street Alley. We are talking about an area that springs north
from the Minor Street Alley. On the image on the screen, it is a shaded hatched area that shows.
There are a series of six parcels that are either adjacent to or the alley actually crosses the
property itself. They have done some of the deed research and some of the alley portions here are
located specifically in the right-of-way but in other instances, it traverses parts of the adjacent
parcels. She will list those adjacent parcels that are adjacent to this alley segment. They are
specifically moving from left to right and top to bottom. 133 S. Governors Avenue referenced as
owned by the Downtown Dover Development Corporation and we now know that as the
Downtown Dover Partnership. The property at 139 S. Governors Avenue, again, referenced with
the Downtown Dover Development Corporation and the Dover Parking Authority now
recognized as the Downtown Dover Partnership. The property at 145 S. Governors Avenue is
actually owned by the City of Dover. Moving over to the eastern side, again, from the top to the
bottom. The property at 136 S. Bradford Street is owned by the City of Dover. The property at
148 S. Bradford Street is now owned by the Capital City Transformation Alliance Inc. and then
the property at 150 S. Bradford Street is currently or soon to be formally owned by CEI
Properties LLC. The applicants making the request collectively were the Downtown Dover
Partnership. The Request for Alley Abandonment moves through the review process with the
Development Advisory Committee for some initial comments and review. The Planning

Commission takes a look at the Alley Abandonment Request and provides a Recommendation.
That Recommendation will be forwarded to City Council and its appropriate City Council
Committees who will have their own consideration of this Request moving into the new year.
The Alley Abandonment is brought forth because these properties are to be involved in a project
known as the Dover Mobility Center Garage. It is a parking garage project which will eventually
come before this body but right now we are just dealing with the Alley Abandonment. The image
on the screen shows that for the most part, we’ve got a series of parcels that are functioning as
surface parking lot areas. There are two properties that currently have buildings but their
demolitions were authorized by other Applications already considered. The Alley Abandonment,
again, is located in the middle and as noted, some of it is right of way and some of it just crosses
some of the properties including some that are City owned. It is also noted that a couple of these
properties, as she mentioned, are owned by the City of Dover. The City Manager’s Office under
separate proceedings has been working with City Council to transfer some of this land ownership
in the City of Dover to the Downtown Dover Partnership and associated entities for this
redevelopment project. So, you are not really considering that issue at the moment but the alley
is a separate matter per our Charter and Code. This redevelopment project is identified as a
priority project in the Transforming Downtown Dover: Capital City 2030 Plan. The Planning
Staff is recommending that the Alley Abandonment happen because it is part of those longer-
term efforts to revitalize Downtown Dover. They do note and recognize that appropriate
planning is going to have to occur related to utility infrastructure that may be located in this alley
segment here. There actually is a fairly substantial water line that they have already been in
discussion with the City’s Department of Water/Wastewater in regards to. Tonight, the Planning
Commission is charged with conducting your own public hearing and making a recommendation
on this Alley Abandonment Request which will then be forwarded to the Utility Committee and
City Council.
Mr. Witham stated that the assumption that he has here and the assumption that he thinks that
they need to understand is that there are six different addresses and six different tax parcel
numbers some of which are owned by different entities other than the Downtown Dover
Partnership. The assumption that he has here is that all of these entities have an agreement to the
development of these six parcels. Responding to Mr. Witham, Mrs. Melson-Williams stated that
the short answer to that is yes, there is a collective effort. Even as part of this request for Alley
Abandonment, the City Clerk’s Office was required to reach out to each of those involved parcel
owners to gage their participation in this Alley Abandonment process. The short answer is, she
believes that all of the property owners are well aware of this request that is being made this
evening.
Mr. Witham stated that some of these parcels were subject by this Commission for a Request for
Demolition which was considered earlier. Responding to Mr. Witham, Mrs. Melson-Williams
stated yes, there are two properties.
Mr. Riemann stated that Mrs. Melson-Williams has done an excellent job of summarizing the
Application. He asked Mrs. Melson-Williams to zoom in on the easement itself so you can get a
little better of a look about what’s actually on the ground versus the black and white. The area in
question is this hatched area in the middle that’s got this yellow cross hatch. It’s actually in an
easement; so, it’s not a separate deeded right of way. It is actually an easement of about 1,500 SF
that is on the six parcels in question that were referenced. The Downtown Dover Partnership
either owns, has already acquired, or is contracted to purchase all of the parcels in question. They

have settled on one of the parcels there and are going to settlement on Wednesday on the last
parcel. They will own and have them under their control, all of these particular properties. The
alley, at this point, really is no longer needed. It doesn’t really serve a purpose with the parking
lot in its current configuration. It certainly would impact the future Mobility Hub that is planned
to go there that will come before this Commission soon in another Site Plan Application. This
was really the first step to get through that process that needed to be accomplished first; so, we
are going through this process now. As part of any application, this was sent to all of the same
agencies as part of the Development Advisory Committee. They received no objections from all
of the other agencies. They were all supportive of this Request as has been the Staff. The only
item of mention that Mrs. Melson-Williams mentioned was a water line that exists. They have
already met with Public Works on that and there will be a plan to relocate that waterline outside
of that which would happen as part of that Mobility hub project anyway. So that is not an issue
and will be solved as part of this project. We are asking for the Commission’s support.
Mrs. Denney stated that when she is looking at the parking and realizing that the intent is for a
parking garage building for which she is certain there should be a charge because she
understands that it might be Colonial and they would certainly charge. She actually volunteered
for many years at Catholic Charities that used to be in one of the buildings on Loockerman
Street. They utilized the parking behind it as did employees from the accountant and the bridal
shop. She can’t remember what all was down there, but they had access to free parking. It is
especially important in Catholic Charities because people are volunteering their time and the
majority of clients that come in there really can’t afford to park. But at any rate, that said, at this
point in this design there will be no free parking because Loockerman Street is not going to have
parking on the street. So, there will be no free available parking for somebody who just wants to
go and do something with their EZ Pass. Does everybody have to park in the garage and pay?
Responding to Mrs. Denney, Mr. Riemann stated that the Application that is before us tonight is
not the parking garage. It is the Alley Abandonment and so he thinks that would be more
appropriately addressed at the time that we come before you with the parking garage application.
Mrs. Denney stated that the Alley Abandonment is a step towards a final result which would
include elimination of the free parking as her understanding. Responding to Mrs. Denney, Mr.
Riemann stated that he is honestly not prepared to answer that particular question this evening.
The Alley that is in question that they are proposing to abandon is no longer needed given the
configuration of the parcels and the ownership of the parcels being a singular owner at this time.
There is access to the parcels currently from both sides, S. Governors Avenue and Bradford
Street; so, the Alley itself is no longer needed. There is no purpose for the Alley any further.
Mrs. Maucher stated that she used to work on State Street. Does this Alley continue further
north? Responding to Mrs. Maucher, Mr. Riemann stated it does but it terminates at the fire
station. It doesn’t go all the way out.
Mrs. Maucher stated that the elimination of that section of the Alley is going to have limited
impact on properties. She used to work on State Street and utilized the alley to get to the parking
behind her building on State Street. With that elimination, are there properties that would be
affected to the north? Responding to Mrs. Maucher, Mr. Riemann stated no, there really
wouldn’t be. They are only eliminating the portion from Minor Street up. The Alley does
continue behind Harry Louie’s, but it terminates at the fire station.

Item 1.
Mrs. Melson-Williams stated that if we scan back out on the plan shown on the screen.
Mrs. Maucher asked if the Alley came out to Reed Street. Responding to Mrs. Maucher, Mrs.
Melson-Williams stated that the Alley does not. You would run into the back side of the Fire
Department’s building before that would happen; it kind of melds into those adjacent parking lot
areas to the north at the top of the page.
Mr. Witham stated that he thinks it is safe to say that once all of the parcels are owned by one
entity, not only will the Alley not exist on paper, it will not physically exist because it will be
gone. Responding to Mr. Witham, Mr. Riemann stated correct and all of the parcels would be
combined into one.
Mr. Witham further stated that there would be no need of an alley, period. Responding to Mr.
Witham, Mr. Riemann stated correct.
Mr. Witham opened a public hearing and after seeing no one wishing to speak, closed the public
hearing.
Mrs. Maucher moved to recommend approval to City Council for MI-24-10 Request for Alley
Abandonment: Part of Alley Between S. Governors Avenue and S. Bradford Street. With the
upcoming project, it’s pretty much necessary.
Mr. Witham asked if Mrs. Maucher would entertain an amendment to note that the Planning
Commission recommends that once the full integration of the alley is accomplished by deed into
one entity the Abandonment would be affective. As of right now, they are still in the process of
combining those lots so there could be a limited need for the alleyway until they are all
combined. Responding to Mr. Witham, Mrs. Maucher stated understood but it’s a joint
application of the individual property owners and they are jointly requesting Abandonment of
their Alley.
Mr. Witham stated that it’s a joint request in the sense that all of the individual property owners
are a part of the Downtown Dover Partnership but that would be a legal document which is not
before us. Responding to Mr. Witham, Mrs. Maucher stated the Amendment to the motion is
accepted.
Mrs. Maucher moved to recommend approval to City Council for MI-24-10 Request for Alley
Abandonment: Part of Alley Between S. Governors Avenue and S. Bradford Street. With the
upcoming project, it’s pretty much necessary. Once the full integration of the alley is
accomplished by deed into one entity, the Abandonment would be effective, seconded by Mrs.
Welsh and the motion was carried 6-0 by roll call vote with Mr. Roach, Dr. Jones and Mr.
Reaves absent. Mrs. Maucher voting yes; based on Staff recommendation and reasons stated in
the motion. Mr. Baldwin voting yes; based on Staff recommendation. Mrs. Welsh voting yes; for
reasons previously stated. Mr. Lewis voting yes; for reasons previously stated. Mrs. Denney
voting yes. Mr. Witham voting yes; based on Staff recommendation and the documents submitted
to the Planning Commission and based upon the oral discussion before the Commission today.

PROCEEDING: Council Committee of the Whole (Utility)
DEPARTMENT OF ORIGIN: Water & Wastewater SUBMITTED ON: January 3, 2025

SUBJECT: Meeting House Branch Drainage Improvement Project Update
TIMETABLE: Staff will proceed with project after direction is provided by City Council
RELATED PROJECT: X
REFERENCE: X
EXPENDITURE REQUIRED: n/a
AMOUNT BUDGETED: n/a
FUNDING SOURCE (Dept./Page in CIP & Budget): n/a
STAFF RECOMMENDATION:
Staff recommends that the Committee provide a recommended direction, based upon the two (2) options
provided by staff, to City Council for acceptance and implementation.
BACKGROUND AND ANALYSIS:
This capital investment project involves the improvement of a stormwater basin known as Meeting House Branch.
The scope of the project runs from S. Governors Avenue to St. Jones River. This area is prone to flooding.
Additionally, the eastern end of the project is subject to an Environmental Improvement Project (EIP) with Delaware
Department of Natural Resources and Environmental Control (DNREC).
Recently, the City of Dover canceled the collection of the stormwater utility. This utility was to be a revenue source
to help pay for the above referenced improvements.
Staff is requesting direction from this committee (and eventually City Council) on the path that we should take with
this project. Essentially, we have two (2) options; 1-proceed with the intended design – which would require a
funding source such as a tax increase or a modified stormwater utility fund or 2-reduce the scope of the project to
meet the minimum requirements of the EIP.

Item 2.
Project Goals /
Requirements
• We are required to perform an Environmental
Improvement Project (EIP) at the site, due to
an agreement with DNREC.
• At a minimum, meadow on the site with a riparian
buffer.
• Goal is to improve the drainage from the St.
Jones River towards State Street, through the
Bayhealth Parking Lot and connect into S.
Governors Avenue.
• Potentially develop site for future development 36
for community.
Page 37
Item 2.
Current Status
• Design for the drainage improvement project is
approximately 70% complete.
• Feasibility Study for site remediation is on hold
until the drainage project design is complete.
• Redesign of area in Bayhealth parking lot is
forthcoming.
• Need to work with DNREC and the Army Corps of
Engineers to determine if any wetland areas are
directly connected to the St. Jones River.
• This work would require a change order to the original
engineering design contract of approximately $15,000.
37
Page 38
Item 2.
Funding Obstacles
• The project has obtained $8.3M of Bond Bill
money to improve the drainage issues on the
site. This money cannot be used for the EIP.
• Staff has budgeted $6.1M to assist with both
the EIP and the Drainage Improvement aspects of
the project.
• This funding was originally to be collected through
the Stormwater Utility Fund.
38
Page 39
Item 2.
Direction
• The City must make a decision on whether we continue with
the whole project or focus on the remediation project only.
• Looking at the stormwater utility model in terms of capital
improvement projects only, removing the Meeting House Branch
project could reduce the Equivalent Runoff Unit from $6.00
to $4.00.
• If the $6.1M of city funds required for the project were
paid for out of the tax base, we would have to increase
taxes by $0.05/$100 assessed value over the period. In
addition, the project would need to be postponed, which
would likely result in increased costs, as taxes are to be
revenue neutral during a reassessment.
• Other considerations:
• We have entered into an agreement with Bayhealth to fund portions of
this drainage design.
• If we do not increase the drainage capacity of this area, 39
redevelopment will be difficult.
Page 42
Item 2.
Council Decision
• City Staff would like a direction from City
Council based upon two (2) options:
1) Move forward with the total design which would require
a sustainable revenue source (either tax increase or
modified stormwater utility proposal).
2) Truncate the design to meet the minimum requirements
of the EIP, which may cost around $3M.

STAFF RECOMMENDATION:
Award contract to Century Engineering for the White Oak Pump Station Grit Removal System
Engineering Support, RFP #25-0013WW, for the amount of $65,620.
BACKGROUND AND ANALYSIS:
This capital investments calls for an upgrade to the existing White Oak Road Pump Station. The grit that is being
deposited into the station is causing operational issues. This project would install an automated grit removal system.
The pump station is currently located on the east side of Nimitz Road, within the White Oak Farms development.
This upgrade will improve the City’s wastewater system by increasing the efficiency of the pump station.

Item 3.
The proposal was advertised to the public as a Request for Proposals in accordance with the City’s purchasing
policy by the City’s Purchasing Agent under RFP #25-0013WW. Proposals were opened on November 21, 2024.
The City of Dover received three (3) proposals. Each proposal was rated in six (6) categories and evaluated by
two (2) staff members. The proposal evaluations are as follows:
AVERAGE

* - Century Engineering and Verdantas claimed local vendor preference which provided a 3% reduction on their evaluation
score.
The shortfall will be covered by the following breakdown:

City staff reviewed the submissions and found that the Century Engineering proposal met all requirements for the
qualifications of the project and received the highest average score from the evaluators. It should be advised that
$17,000 of the total cost is a contingency for the firm to assist during the construction bidding phase, it may not be
utilized. The staff recommends awarding the contract to Century Engineering in the amount of $65,620 for the
