Well, absolutely the way people pay traffic tickets now, they're going to pay then, you know, they In other words, that's those things won't change, um, that way. They're going to pay them one way or the other.

That's why this But that's why this is superior, in my view, to our current code, because our current code was designed basically in the 1920s and relies fine, fine, fine, and that's our authority. With this, we have the ability to We will, if we define it right, like they said, to re- refer people to drug court, to put people refer people to veterans court, to do community ser- In other words, we will have a probation before judgment, etcetera, and provide and direct people to services. Um, it gives us other options. You know, but the the revenue is going to come from, you know, the traffic ticket, it's going to come from the parking ticket, it's going to come from, you know, that type of thing, that the revenue is not coming from necessarily a person who is, uh, aggressive panhandling. Um, you know, that's not where we're counting on revenue coming from.

But but that's why but that's why we want that's why we're taking the time to have this type of open conversation, because when we shape this, we want it shaped right so we can have a proposal that's actually going to work. Because I know I'm a busy person, I know you all are. Um, and um, you know, I was I was going to uh tease a street magistrate, state former state magistrate, uh, Garfinkel over there and say not not stepped in for him, he's found uh He's retired, you know, but he he does a whole bunch of things after he's retired. But, but this is important and and that's why we wanted a diverse diverse voices at the table so that we get this so that we can get the objectives and that we get a system that has accountability, that has compassion, and that has effectiveness. And if we can achieve all three of those, we can do something really good in our city.

Thank you. Thank you. And one of the important aspects of it is that this uh that the commercial isn't just business. It's commercial, so it applies to the nonprofits, etcetera, that get the same service uh just like the EMS fee does, the service, because we don't want to target our businesses, you know, but it's important. Uh there it costs them a lot less to do this if we do it right than if it does to hire security for sure. Um so um I will, and— Mr. Mayor.

And I I did speak with Chief Carey about it and he had raised no objections to it. In fact, he seemed to like the idea of of it being a full public safety aspect to it, just in case we ever lose the higher education allotment, it would provide a mechanism. Assuming that depending on what we do in the next month, with a different discussion, I'd be very happy if this is temporary and we repeal it, but and replace it with something better, but it's what we have now. Anyway, that's but I did I did speak with him about it. So and and I'm not saying he gave a thumbs up one way or another, but he didn't express any concerns to me, and he did like the back up that that it could be a back up if need be in the future.

Yeah. Thank you- thank you for that question, Councilman Lewis. This is, uh, reason why it's being done in the fund is for transparency, so that the public can have the utmost trust in where the money goes and what it's utilized for. Um, and, um,

It's been moved and
Play from 11:47Mar 24, 2026, Council Committee of the Whole Meeting
Uh thank you, Mr. Chairman. And I'd also would uh recommend, I don't think this needs to necessarily be part of the motion if it's understood that we place the strictly enforced signs uh at the speed limits.
Play from 31:41Mar 24, 2026, Council Committee of the Whole Meeting
I mean if that if that if the cost of it, I don't know it'd have to be, but we can make an amendment.
Play from 32:03Mar 24, 2026, Council Committee of the Whole Meeting
All right, I'd like to make a motion for an amendment.
Play from 32:15Mar 24, 2026, Council Committee of the Whole Meeting
And there's the motion and the seconding.
Play from 32:23Mar 24, 2026, Council Committee of the Whole Meeting
Thank you, Mr. Chairman. It would be quick because Dr. Sudler addressed most of my concerns. I was a little bit curious about if you're going to wait until the study for us to find out what the proposals are for like Slaughter Street. We know where they want to go, Lincoln Street, but Slaughter, it's obviously if you put chicanery like on Lincoln Street, it's going to push people to Slaughter Street because they're parallel. So, pardon me, so I was just curious about that, but-

Uh, thank you, Mr. President. Uh, give just a moment for committee members to get in place. Uh, I see Mr. Shevock's online. Are you are you there, Mr. Shevock?
Play from 48:29Mar 24, 2026, Council Committee of the Whole Meeting
I hear you, thank you. All right, I see you now, too. Good to see you. And Mr. Garfinkel is here, uh, in person and all set. So now, I will entertain a motion to adopt the agenda.
Play from 48:38Mar 24, 2026, Council Committee of the Whole Meeting
Moved by Mr. Shevock and seconded by Dr. Pillsbury, uh, to adopt the agenda. Is there amendment or discussion? Seeing none, all in favor?
Play from 48:51Mar 24, 2026, Council Committee of the Whole Meeting
Aye.
Play from 48:59Mar 24, 2026, Council Committee of the Whole Meeting

Thank you. Uh Dr. Sudler?
Play from 1:08:20Mar 24, 2026, Council Committee of the Whole Meeting
Now, now uh before we do that, um I believe it was that it that is similar to what we have already, that is marketed for sale or lease. So um they can, as long as if they have if they can keep it, we're not forcing the sale. But we just want it actively marketed, um whether they want to lease it or to a client, tenant, or sell it, whatever their option is. Just want to make sure that that's correct, right?
Play from 1:11:14Mar 24, 2026, Council Committee of the Whole Meeting
So you wouldn't get have to pay the fee, so you would considered it's sort of like the exempt it's clarifying the existing exemption.
Play from 1:11:53Mar 24, 2026, Council Committee of the Whole Meeting
I just I just wanted to make sure that we're on the same page on that.
Play from 1:12:02Mar 24, 2026, Council Committee of the Whole Meeting
All right. Okay, uh before I entertain a motion, I had uh was going to recognize uh Councilwoman Arndt.
Play from 1:12:05Mar 24, 2026, Council Committee of the Whole Meeting
Thank Thank you uh. Yeah, I I do think that newspapers sort of out-dated that that anything that an MLS is probably more, you know, impactful as well as other forms of marketing, so I I like actively marketing, but in the area, so we can figure that out exactly what that means. Uh Dr. Sudler might have a comment, uh but then I'll unless somebody else has something, I'll entertain the motion. Dr. Sudler?
Play from 1:13:41Mar 24, 2026, Council Committee of the Whole Meeting
Um you you could uh you could make a motion that it be advanced uh on the condition of amendments uh reflecting the sentiment of expressed by uh Council President Neil and Councilwoman Arndt. Um that would be uh appropriate. That's one way to do it. And the other way would be to uh just uh defer for a couple weeks and and uh see what the amendments look like. It's it's up to the committee how the committee wishes to do it.
Play from 1:14:55Mar 24, 2026, Council Committee of the Whole Meeting
Thank you. I have some comments, but before I do, do any members of the public have any comments?

Play from 1:15:59Mar 24, 2026, Council Committee of the Whole Meeting
I I want to thank you for the work that you've done, and I I find it uh uh I find both of these ordinances I think you've done due diligence with the proposals. I I think, obviously, um um it's fair to address the policy aspect when it comes to, because uh vacant buildings is a very touchy issue.
Play from 1:16:08Mar 24, 2026, Council Committee of the Whole Meeting
Mm.
Play from 1:17:02Mar 24, 2026, Council Committee of the Whole Meeting
Uh have you heard any input from um in dialogue permitted, um have you heard any input from the DDP, or the folks downtown, the merchants, or anything? Because this has been put out for a little bit. I have not.

All right. Thank you.
Play from 1:17:35Mar 24, 2026, Council Committee of the Whole Meeting
Thank you. I'm sure I'm sure they'll have that opportunity, and I'm sure we'll hear something.
Play from 1:17:38Mar 24, 2026, Council Committee of the Whole Meeting
Um the uh I I do have uh a another question. Something that has been brought up uh a while ago in the uh in the code board property code needs this code board of appeals um was that when we did an adjustment to the uh vacant building ordinance, that we needed to put in a a a section addressing the difference between vacant and uh temporarily unoccupied homes so that it could would say that if uh a home is being um maintained properly, that as long as the owner occupies it at least 6 months of the year, it would not be considered vacant. Um because that way, uh we we're getting people moving in, retired people, we're likely more and more people uh who are um living part of the year in their old home or in Florida, or Arizona, right, exactly. And they come back here. Now, several of them, technically, by our vacant building ordinance, technically, it's a vacant building, and they should get a accelerating fine. It usually doesn't happen, but sometimes it does, and they end up before the Code Board of Appeals and proving that they they are owner occu-
