DEPARTMENT OF ORIGIN: Public Works DATE SUBMITTED: 10/17/14
PREPARED BY: Sharon J. Duca, P.E., Public Works Director / City Engineer
SUBJECT: Disposition of Public Infrastructure to Kent County – Central Transmission Bypass North
REFERENCE: N/A
RELATED PROJECT: N/A
APPROVALS: City Manager
EXHIBITS: Attachment A – List of Public Infrastructure to be disposed of by the City of Dover
Attachment B – Map
EXPENDITURE REQUIRED: $ N/A AMOUNT BUDGETED: $ N/A
FUNDING SOURCE (Dept./Page in CIP & Budget): N/A
TIME TABLE: All referenced public infrastructure will be disposed of by the City of Dover upon action by City
Council and become the responsibility of Kent County.
RECOMMENDED ACTION: Disposal of the referenced public infrastructure, and all easements necessary for
the perpetual maintenance thereof, associated with the County’s Central Transmission Bypass North project,
to Kent County. The estimated replacement value of the referenced infrastructure is $770,000.
BACKGROUND AND ANALYSIS
In accordance with information received from the Kent County Department of Public Works, a failure in the
twenty-four inch (24”) concrete sewer force main (Kent County Central Transmission Main) surfaced causing a
sanitary sewer overflow in the center of Route 13 in front of C.F. Schwartz on July 16, 2014. The root cause
was corrosion of the pipe crown due to high hydrogen sulfide concentrations in the wastewater. Due to the
thinned pipe wall, a slight pressure increase realized during a routine re-routing procedure resulted in
triggering the failure. This occurred on one (1) of the few remaining sections of the Kent County transmission
system, from Smyrna to the wastewater treatment plant in Frederica, that does not have a redundant pipeline
or bypass capability.
The above referenced failure is currently only temporarily repaired. In order to complete a permanent repair
the flow must be rerouted to allow for the installation of a pipe liner. As a result there is an urgent need for a
functioning bypass system. The proposed bypass is to be developed as depicted on the attached map. The
project has been authorized by Levy Court and is currently being fast tracked due to the related urgency. As
part of the project, portions of the City’s existing infrastructure, and all associated easements, must be
disposed of by the City with ownership transferred to the County. The infrastructure to be transferred is
provided in Attachment A. The County will assume ownership and maintenance responsibility of the new
bypass force main from County Pump Station No. 2 to Crawford Carroll Avenue.
Due to the above, the City of Dover Department of Public Works requests that the public infrastructure
improvements referenced in Attachment A, and all associated easements, be disposed of with ownership and
maintenance responsibilities transferred to Kent County.

PROCEEDING: Utility Committee
DEPARTMENT OF ORIGIN: City Manager’s Office DATE SUBMITTED: October 22, 2014
PREPARED BY: Scott D. Koenig, P.E., City Manager
SUBJECT: Dedication of Private Walkway as a Public Walkway – Village of Westover – Mifflin Road to
Trafalgar Drive
REFERENCE: N/A
RELATED PROJECT: N/A
REVIEWED BY: Scott D. Koenig, P.E., City Manager
EXHIBITS: Attachment A – Letter from Representative Scott; Attachment B – Map of the walkway area.
EXPENDITURE REQUIRED: $0 AMOUNT BUDGETED: $0
FUNDING SOURCE (Dept./Page in CIP & Budget): N/A
TIME TIMETABLE: Upon Council Approval.
RECOMMENDED ACTION: Accept the dedication of the existing concrete walkway and authorize the City
Manager to execute any documents necessary to ensure public funds can be used for future maintenance on the
dedicated walkway.
BACKGROUND AND ANALYSIS
As part of the approved subdivision plan for the Village of Westover, the City of Dover required the
construction of a private sidewalk connection from Trafalgar Drive to Mifflin Road to guarantee the pedestrian
interconnection of the existing developments in this area and the newly constructed Village of Westover
Subdivision. Prior to the construction of the new Dover High School, this sidewalk connection primarily served
as a connection for the residents of the Village of Westover and the Village of Cannon Mill to access local
businesses in the vicinity of Route 8. The Village of Westover Homeowner’s Association has inquired for a
number of years about dedicating this walkway for public maintenance; however, staff had previously not
favored such a dedication.
With the construction of the new Dover High School, the pedestrian patterns have changed. This walkway now
represents a safe path to the new Dover High School and related facilities so the “public” interest with respect to
this walkway has changed. Attached (see Attachment A) is a written request from Representative Darryl Scott
requesting consideration of the public dedication of this walkway. Each of the points outlined in Representative
Scott’s correspondence support the City Manager’s reconsideration of this request. Based upon the current and
projected use of the walkway, the City Manager has no objections to the dedication of the walkway as public
walkway. The estimated maintenance cost of the walkway is $1,000 per year which would include costs
associated with winter maintenance.
The existing private walkway is approximately 770 linear feet long and six (6’) feet in width. Therefore, the
estimate value of the dedication is $23,100.00 (770 l.f. x 6 ft. x $5.00 per square feet). Attachment B is a map
of the proposed dedication.
