CITY OF DOVER, DELAWARE
ACTION FORM
PROCEEDING: Council Committee of the Whole (Leg & Fin)
DEPARTMENT OF ORIGIN: Public Works SUBMITTED ON: December 3, 2021
PREPARED BY: Mark Nowak, Interim Public Works Director
REVIEWED BY: Dave Hugg, Interim City Manager and Lori Peddicord, Controller/Treasurer
SUBJECT: Evaluation of Bids – Silver Lake Dam Repairs
TIMETABLE: Notice to Proceed to be issued within thirty (30) days of Council approval. Project
anticipated to be completed within thirty (30) calendar days from Notice to Proceed
issuance, weather permitting.
RELATED PROJECT: SW2202- Silver Lake Dam Repairs
REFERENCE: CIP – General Fund Projects
EXPENDITURE REQUIRED: $57,480.00
AMOUNT BUDGETED: $100,000.00
FUNDING SOURCE (Dept./Page in CIP & Budget): Department of Public Works – CIP Project
SW2202 Silver Lake Dam Repairs, Account
No.: 101-12-18-60-000-54030.
STAFF RECOMMENDATION:
Award the contract to Mar-Allen Concrete Products, Inc., for the City of Dover Silver Lake Dam
Repairs, Bid #22-0016PW, for the amount of $57,480.00.
BACKGROUND AND ANALYSIS:
On June 9, 2021 Remington & Vernick Engineers performed an above water inspection and on June 16,
2021, W.J. Castle & Associates performed an underwater inspection of the Silver Lake Dam. These
inspections were performed to assess the functionality of the dam and identify deficiencies and the need
for remedial repairs. The underwater inspections included the concrete spillway, and the drop-inlet outlet
works while visual observations of the above water components included the earth embankment, concrete
spillway and wing walls, pedestrian walkway, drop-inlet outlet works, and the exit channel. Observations
of the dam’s condition and recommendations were compiled in a report dated June 28, 2021. The report
is intended to assist the City of Dover in programming the dam repairs in order to maintain safe operations
of the dam. Many of the recommendations listed in the report were tasks that could be performed by City
staff and have been assigned to the appropriate divisions for their completion.

by an outside contractor. They are as follows:
1. Concrete Spillway – Upstream Face and Wing Walls
a. Repair spalls in concrete wingwalls with epoxy concrete.
b. Repair crack in left wingwall with pressure injected epoxy.
2. Concrete Spillway – Downstream Face and Wing Walls
a. Repair incipient spalls on left wingwall with epoxy concrete.
b. Investigate the source of water leaking and condition of the concrete on the right wing
wall and determine the appropriate repair. (The rust stain, efflorescence and water
leakage appears to be originating from a crack/spall in the concrete which suggests water
is penetrating from earth side of wall. There is no immediate concern but if it is left alone
there could be a potential issue in future.)
3. Pedestrian Walkway
a. Repair joint material delamination on pier 6.
b. Repair topside crack on span 4 and the underside cracks throughout with pressure
injected epoxy.
The bid was advertised to the public as an Invitation to Bid in accordance with the City’s purchasing
policy by the City’s Purchasing Agent under ITB #22-0016PW. Bids were opened on November 8, 2021.
The City of Dover received one (1) lump sum bid for the proposed work to be performed. The contract
values are as follows:
BID PRICE EVALUATED
CONTRACTOR LOCATION
PRICE
MAR-ALLEN CONCRETE PRODUCTS, $57,480.00
EPHRATA, PA $57,480.00
INC.
City staff reviewed this submission and found that Mar-Allen Concrete Products, Inc. bid met the
requirements for the qualifications of the project. Staff recommends awarding the contract to Mar-Allen
Concrete Products, Inc. in the amount of $57,480.00 for the Silver Lake Dam Repairs.

RECOMMENDED ACTION: Approve the new grant program and the intended purchases.
BACKGROUND
This is a follow-up to the Committee Action form for the CJC Grant presented to and approved by the
council on September 14, 2021.
Information from previous review:
The Criminal Justice Council administers Federal pass-through grant programs from the USDOJ for
State of Delaware law enforcement agencies.
In recent years, the City of Dover has been experiencing startling increases in violent crimes and
weapons seizures. Much of the crime is drug related and it is not surprising that the increases in
drugs seizures are also associated with corresponding increases in drug overdoses and deaths.
The Delaware arrest data is noteworthy in that it shows the vast majority of the victims and
suspects involved in these cases have at least one prior drug-related arrest and/or felony
conviction. The data supports the argument that additional measures need to be taken, focused
on individual situations, to promote the prevention of violent crime before it happens.
As a result, the CJC is working in conjunction with police departments across the state, to
facilitate prevention programs rooted in a collaborative effort to divert low level drug offenders to a
community-based, harm-reduction intervention for law violations in lieu of the normal criminal
justice system cycle. The three-year program being implemented at Dover PD will include the
assignment of two Behavioral Health professionals, employed by the successful bidder to a
properly executed RFP, to work within the Community Policing Unit. The program will establish a
prevention and case management component, to compliment an enhanced response model, in
order to reduce the likelihood of tragic outcomes associated with persons battling addiction and/or

mental health challenges. At-risk individuals, when appropriate, will be channeled to a pre-arrest
Item 2.
diversion program, at the point of contact, thus reducing the harm related to arrest and the
creation or expansion of a criminal history. The program will also function proactively in the
absence of criminal conduct in order to realize its full potential within the available resources.
New information:
The Request for Proposal process was completed by the City Purchasing Office. The funding
identified begins with the CJC grant in the amount of $268,380 over three years and another
$75,000 per year anticipated from the State of Delaware budget program for the two positions.
The total is $493,380 over the three year period. The RFP closed on October 27, 2021 at 2 pm
and proposals were received from the following vendors:
RFP Number: 22-00l 4PD
Vendor Name Address
Dover Behavioral 725 Horsepond Road
Health Systems Dover, DE 19901
Mental Edge 1198 S Governors Ave, Bldg. A, Suite 201
Counselling Dover, DE 19904
8610 Broadway, Suite 270
MedTrust, LLC
San Antonio , TX 78217
Police Department personnel reviewed the proposals and Dover Behavioral Health Systems was
the unanimous choice. MedTrust LLC was not considered since the company currently has no
business operations or licensure in place in the State of Delaware. Mental Edge Counselling is a
smaller company, with qualified staff, and is currently licensed to handle services in Delaware.
However, they required Dover PD to provide physical facilities for all the services noted in the
RFP. By contrast, Dover Behavioral Health Systems is also licensed in Delaware and already has
an established physical facility in the City that can handle all the program needs. More
importantly, Dover Behavioral Health Systems offered to provide both clinicians for full-time hours
each week. That was double the amount of hours offered by Mental Edge, which makes Dover
Behavioral Health Systems the best value by far for the financial resources invested.
ACTION REQUESTED
The Council Committee of the Whole approve the award of the contract to Dover Behavioral Health
Systems so the Police Department can begin working through the details of identifying the actual
clinicians to be embedded within Community Policing and drafting operational plans.
